QUESTIONS/RESPONSES

1. PG 39, Section C 3.52.213-3 - If products submitted have a Country of Origin of the People's Republic of China, will they automatically be disqualified from consideration, assuming that there are 'most favored nation' alternatives available?

Response: Yes, they will be disqualified from consideration.

2. PG 77, Section E.5 - Volume I - Technical, section a) states "The Cross Reference index (Attachment 6) shall cross- reference the product literature location (page numbers/paragraph) to the MTRs." Attachment 6 of the solicitation is this Question Submission Format. Please provide the document referenced or provide instructions for satisfactory completion. One proposed solution is a table in the format of the provided tables containing Minimum Technical Requirements that shows actual technical specifications of the proposed products, as certified by the manufacturer.

Response: This is an error. The attachment should state attachment 9, which is included with this amendment.

3. PG 80, Section E.5 - Volume IV - Price states "The spreadsheet does require that the unit pricing be reflected showing the price with and without the 3% Service Level Agreement (SLA) Fee." What column does the price without the 3% fee go into? Column C?

Response: Page 80 has been corrected to remove the requirement for unit pricing without the SLA Fee.

4. PG 81, Section E.5 - Volume V - SF 1449, Amendments & Other Documents, section a.

states, "An official authorized to bind the firm shall sign the SF1449…" Does the rest of the RFP need to be included, or can the SF1449 be exported from the RFP and saved as a single page?

Response: Only the 1st page of the SF1449, needs to be returned as part of your proposal package.

5. PG 82, Section E.5 - Volume V - SF 1449, Amendments & Other Documents, section d.

states, "Volume V - SF 1449, Amendments & Other Documents, section d. states, "Volume V - SF 1449, Amendments & Other Documents, section d. states, "All offerors shall be certified in SAM (www.sam.gov) under NAICS code 336991." According to the SF1449, this RFP is for NAICS code 334220. Please confirm which NAICS code is required.

Response: The NAICS code for this requirement is 334220 Radio and Television Broadcasting and Wireless Communications Equipment Manufacturing. (SEE PAGE 82

OF THE REVISED RFP 36C10G24R0005 REVISED 022124)

6. PG 7, Section B.2 Payment Terms and Conditions Item (d) Reports - This section requires extensive reporting to the VA to include the SLA. We do not see a line item to price this program management. Since there is no line item in the pricing tables for this task, how shall program management be priced?

Response – All admin and related costs will be included in the proposed unit pricing of the individual products.

7. PG 11, Section B.7 Product Description Warranty Support - With regards to the Warranty Support, it is not clear to this vendor if the requirement of the contractor to pack and pick-up the device for return as well as provide delivery and in-home setup for repaired devices returned to the veteran applies to all products being ordered by the VA such as Desktop and Portables.

Please clarify.

Response - The requirement to pack and pick-up the device for return as well as provide delivery and in-home setup for repaired devices returned to the veteran only applies to the Desktop devices, not the Portable Video Magnifiers (small, medium, or large).

8. PG 14, Section B.8 Product Identification and Minimum Technical Requirements - The specification 'HD OR LCD Or HD LCD' mandates 'HD' for small devices. However, for the small devices, this 'HD' requirement conflicts with the specified minimum resolution of 800 x 480 (or greater), which is not recognized as high definition (HD) by the Advanced Television Systems Committee (ATSC) standards. Therefore, we recommend amending this requirement to 'LCD' to align with the 800 x 480 resolution specification and prevent conflicting requirements.

Response - The requirement for the Small Portable Video magnifier category shall be changed to standard definition “SD or greater” instead of “HD” The magnifier category for the Medium and Large categories shall remain “HD”. (SEE PAGE 14 OF THE REVISED

RFP 36C10G24R0005 REVISED 022124)

9. PG 56,Section C.8 52-216-22 Item (b) Indefinite Quantity - We understand that the Government can order at least the quantity of supplies or services designated in the Schedule as the "minimum". What is the maximum? And how are we to price the Quantity Discounts?

Response - On page 81 of the RFP, there is an Historical Tend table showing the spending by the VA. This table gives you historical data of the quantities purchased by the VA. There is no guarantee that annual spending will remain at those levels but based on the presented data contractors can provide discounts.

10. PG 2, Attachment 5, item (b) - We understand the intent of HIPPA, of Attachment 5 of the solicitation but we do not see any process, defined by the Government, which will ensure contract-life compliance. Therefore, we recommend that the Government mandates a standard which will ensure compliance, or at least demonstrate the contractor’s commitment to compliance. Such a standard is the Information Security ISO Standard 27000, of a NIST counterpart.

Response – The requirement for the completion of the BAA will only be a requirement for the winning contractor. After award is made, the winning contractor will work with the VA BAA Office to finalize a BAA.

11. PG 1, Attachment 5 - We understand the requirement of the Certificate of Confidentiality and Non-Disclosure signatory of Attachment 5 of the solicitation, but we do not see any process, defined by the Government, which will ensure contract-life compliance. Furthermore, we recommend that the Government mandates a standard which will ensure compliance, or at least demonstrate the contractor’s commitment to compliance. Such a standard is the Information Security ISO Standard 27000, of a NIST counterpart.

Response – The requirement for the completion of the BAA will only be a

12. PG 1, Attachment 5 - When the VA states "All Contractor personnel performing under the contract" please clarify who this requirement applies to. Is it the installers, administrators of the program? Please clarify. Also, how quickly will the vendor be required to submit all of the Certificate of Confidentiality and Non-Disclosure as requested?

Response – The requirement for the completion of the BAA will only be a

13. PG 1, Attachment 5 - As the contractor will be responsible for collecting data for "All Contractor personnel performing under the contract" this will require extensive reporting to the VA. We do not see a line item to price this program management.

Since there is no line item in the pricing tables for this task, how shall program management be priced?

Response – All admin and related costs will be included in the proposed unit pricing of the individual products.

14. PG 1, Attachment 1, Invoice Inquiry Tracker - As this task is to be provided at award and we do not know the size and scope of this requirement, how shall this task and program management be priced?

Response – The Attachment 1 is a template that the Government will provide to the winning contractor to assist them in tracking their invoices if needed.

15. PG 80, Volume 3 Socio-Economic Considerations - What evaluation credit will be assigned to offerors that are 1)SDVOB, 2)VOSB, 3) Non-veteran contractors using SDVOB's/VOSB's subcontractors. 4) Non-veteran contractors NOT utilizing SDVOB's/VOSB's subcontractors.

Response – There is no numerical credit assigned. The Socio-economic Consideration allows the evaluators to take into consideration those SDVOSBs/VOSBs and in the event of a close evaluation there could be a leaning towards awarding to those small businesses.
