Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the CO will make the full text available.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

The below Tiered Evaluation language only applies to Contract Line Item Numbers (CLINs) associated with VISNs 1, 2, 4, 5, 6, 7, 8, 10, 17, and 22. CLINs associated with Veterans Integrated Service Networks (VISNs) 1, 2, 4, 5, 6, 7, 8, 10, 17, and 22 will be set-aside for Small Business concerns using a Tiered Evaluation approach. All other CLINs associated with remaining VISNs will utilize Full and Open Competition procedures.

This is a Small Business Set-Aside that will convert to Full and Open Competition if NO Acceptable Offers are received from responsible, Small Business Concerns. The Government will award to the Small Business whose offer is most advantageous to the Government, based on the requirements and evaluation criteria set forth in this Solicitation. If only one acceptable offer is received from a responsible, Small Business Concern, the CO will award directly to that firm, prior to the dissolution of the Small Business Set-Aside. No amendment will be issued to convert the Solicitation to Full and Open Competition. If the Small Business Set-Aside is dissolved, the Government will award to the Large Business whose offer is most advantageous to the Government, based on the requirements and evaluation criteria set forth in this Solicitation. All interested parties are encouraged to respond, regardless of business size; However, it must be noted that THIS IS A SMALL BUSINESS SET-ASIDE FIRST AND FULL AND OPEN COMPETITION ONLY AFTER THE ABOVE CRITERIA IS NOT MET.

NOTICE: THIS PROCUREMENT (VISNs 1, 2, 4, 5, 6, 7, 8, 10, 17, and 22 only) WILL BE CONDUCTED USING A TIERED EVALUATION OF OFFERS. THE FOLLOWING PROCEDURES WILL BE UTILIZED:

This set-aside procurement is based on a tiered or cascading order of precedence for evaluating offers. If a sufficient number of awards cannot be made at the first tier, the contracting officer may evaluate offers at the next lower tier, until a sufficient number of awards can be made. Consideration shall be given to tiers in the following order of priority:

(1) Service-Disabled Veteran-Owned Small Business (SDVOSBs);

(2) Veteran-Owned Small Business (VOSB);

(3) all other small business concerns;

(4) other than small businesses (unrestricted).

Best value will be determined per VISN, and a single-award Indefinite Delivery Indefinite Quantity (IDIQ) per VISN will be established based on the Offeror who has been determined responsible, whose offer provides the best value within the applicable socioeconomic cascading group.

The above Tiered Evaluation language is only applicable to CLINs associated with VISNs 1, 2, 4, 5, 6, 7, 8, 10, 17 and 22. All other CLINs/VISNs will utilize Full and Open Competition procedures.

7. Section E.6.2.9.2. will now read as follows:

The CO is the official point of contact for this solicitation. The CO has assigned Contract Specialists to coordinate with Offerors for solicitation questions, receive past performance questionnaires, and proposal deliveries. All solicitation documents for this requirement are available on the beta.sam.gov website under the “Contract Opportunities” section (formerly Federal Business Opportunities [FBO]) website at https://beta.sam.gov/.

8. Section E.6.2.9.3. will now read as follows:

9. Section E.6.8.7. will now read as follows:

Under CLINs utilizing Full and Open Competition procedures and under Tier 3 or Tier 4 in the Tiered Evaluation CLINs, evaluation preference will be given to those Offerors having SDVOSB and VOSB socio-economic status, and those Offerors who propose to meet SDVOSB, VOSB, small business subcontracting goals identified in Section E.8 “Factor 4 – Veterans’ Involvement.”

10. Added Section E.6.8.7.2.:

Unless otherwise stated, all Clauses/Provisions will apply. The following additional guidance is provided:

52.204-5 only applies to Tier 4 and all Full and Open Competition/Unrestricted CLINs 52.219-6 only applies to Tiers 1, 2, and 3 52.219-14 only applies to Tiers 1, 2, and 3 52.219-27 only applies to Tier 1 852.219-10 only applies to Tier 1 852.219-11 only applies to Tier 2 852.219-74 only applies to Tiers 1, 2, and 3

11. Section E.8. ADDENDUM to FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS, Added the following language after “Proposal Evaluation” section:

TIERED EVALUATION APPROACH:

The following Tiered Evaluation approach only applies to CLINs associated with VISNs 1, 2, 4, 5, 6, 7, 8, 10, 17, and 22. CLINs associated with VISNs 1, 2, 4, 5, 6, 7, 8, 10, 17, and 22 will be set-aside for Small Business concerns using the below Tiered Evaluation approach. All other CLINs associated with remaining VISNs will utilize Full and Open Competition procedures.

All proposals shall be subject to evaluation by a team of Government personnel. Any proposals that do not meet the following criteria will be eliminated from consideration:

1. All SDVOSB and VOSB concerns must be VetBiz Verified at the time of proposal submission and certified in SAM under NAICS code 423450 to qualify for Tier 1 and Tier 2, respectively. Offerors are solely responsible for obtaining this verification. The CO will not intervene with the Center for Verification and Evaluation (CVE) regarding the processing of applications.

1. All Small Businesses must be certified in SAM under NAICS code 423450 to qualify for Tier 3. Verification in VetBiz alone does not meet the requirements for size standard authentication. Offerors and subcontractors must also be certified in SAM.gov following SBA guidelines for certification as a small business.

After this initial assessment, all remaining proposals will be evaluated in accordance with the evaluation factors contained in this solicitation using a tiered approach based on an order of priority as established in 38 U.S.C. 8127. The review will consist of four tiers. The tiers are defined as follows:

Tier 1 – SDVOSB Concerns Tier 2 – VOSB Concerns Tier 3 – Small Business Concerns Tier 4 – Other Than Small Businesses (or Unrestricted)

1. Tier 1 proposals will be evaluated first. After review of Tier 1 proposals, if award can be made at a fair and reasonable price that offers best value to the United States, award will be made. If no offers are submitted at Tier 1 or if none of the Tier 1 proposals would result in award at a fair and reasonable price that offers best value to the United States, the Government will evaluate Tier 2 proposals for award.

1. After review of Tier 2 proposals (if needed), if award can be made at a fair and reasonable price that offers best value to the United States, award will be made. If no offers are submitted at Tier 2 or if none of the Tier 2 proposals would result in award at a fair and reasonable price that offers best value to the United States, the Government will evaluate Tier 3 proposals for award.

1. After review of Tier 3 proposals (if needed), if award can be made at a fair and reasonable price that offers best value to the United States, award will be made. If no offers are submitted at Tier 3 or if none of the Tier 3 proposals would result in award at a fair and reasonable price that offers best value to the United States, the Government will evaluate Tier 4 proposals for award.

Each tier represents a distinct set‐aside and will be evaluated as such.

If only one proposal is received and evaluated in a tier, the CO may award to that offeror if the proposal meets the requirements of the solicitation and the proposed price is fair and reasonable in accordance with FAR 19.502-2, VAAR 819.7005, VAAR 819.7006(c). If the proposal does not meet the requirements of the solicitation and the proposed price is not fair and reasonable in accordance with FAR 19.502-2, VAAR 819.7005, VAAR 819.7006(c), the CO will evaluate proposals received at the next tier.

The above Tiered Evaluation approach is only applicable to CLINs associated with VISNs 1, 2, 4, 5, 6, 7, 8, 10, 17 and 22. All other CLINs/VISNs will utilize Full and Open Competition procedures.

12. Section E.8. ADDENDUM to FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS, Added the following language to the beginning of “Factor 4 – Veterans’ Involvement” section:

This factor only applies to Full and Open Competition CLINs and any Tiered Evaluation CLINs that reach Tier 3 or Tier 4. For this factor, the offers will determine if the Offeror meets any of the following:

13. Section E.17 52.252-1 SOLICITATION PROVISIONS INCORPORATED BY REFERENCE (FEB 1998): FAR provisions 52.203-11, 52.204-5, 52.209-2, and 52.225-25 are added.
