- Contractor shall provide all manpower, tools, equipment, and material to seal windows, perform mold remediation, and repair any damage caused by the remediation at the VBA Regional Office in Jackson MS

- Remediation/Construction shall be in accordance with OSHA, Federal, State, and Local codes and/or requirements.

- Wage Determination for Hinds County MS is applicable.

- This project is 100% set-aside for CVE certified Service Disabled Veteran Owned Small Business' (SDVOSBs) capable of meeting the requirements set forth in this solicitation.

- This requirement is a Total Service Disabled Veteran Owned Small Business set-aside in accordance with Public Law 109-461, Veterans First Program. Only offers from SDVOSB concerns that are registered and verified by the Center for Verification and Evaluation (CVE) Vendor Information Pages (VIP) website at https://www.vip.vetbiz.gov/ of offers shall be considered for award. Offers from contractors that are not registered in VIP shall be rejected as non-responsive and shall not be considered for award.

2.1 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT 2018)

(a) Definitions. As used in this provision— "Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

"Federal contracts and grants with total value greater than $10,000,000" means—

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).

"Principal" means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

2.2 52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a Firm-Fixed-Price contract resulting from this solicitation.

2.3 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.4 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is

2.5 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

2.6 52.228-1 BID GUARANTEE (SEP 1996)

(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.

(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds—

(1) To unsuccessful bidders as soon as practicable after the opening of bids; and

(2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.

(c) The amount of the bid guarantee shall be 20 percent of the bid price or 3,000,000, whichever is less.

(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

2.7 52.228-17 INDIVIDUAL SURETY—PLEDGE OF ASSETS (BID GUARANTEE) (FEB 2021)

(a) Offerors shall obtain from each person acting as an individual surety on a bid guarantee—

(1) A pledge of assets that meets the eligibility, valuation, and security requirements described in the Federal Acquisition Regulation (FAR) 28.203–1; and

(2) Standard Form 28, Affidavit of Individual Surety.

(b) The Offeror shall include with its offer the information required at paragraph (a) of this provision within the timeframe specified in the provision at FAR 52.228–1, Bid Guarantee, or as otherwise established by the Contracting Officer.

(c) The Contracting Officer may release the security interest on the individual surety’s assets in support of a bid guarantee based upon evidence that the offer supported by the individual surety will not result in contract award.

2.15 VAAR 852.233-70 PROTEST CONTENT/ALTERNATIVE DISPUTE RESOLUTION (OCT 2018)

(a) Any protest filed by an interested party shall—

(1) Include the name, address, fax number, email and telephone number of the protester;

(2) Identify the solicitation and/or contract number;

(3) Include an original signed by the protester or the protester’s representative and at least one copy;

(4) Set forth a detailed statement of the legal and factual grounds of the protest, including a description of resulting prejudice to the protester, and provide copies of relevant documents;

(5) Specifically request a ruling of the individual upon whom the protest is served;

(6) State the form of relief requested; and

(7) Provide all information establishing the timeliness of the protest.

(b) Failure to comply with the above may result in dismissal of the protest without further consideration.

(c) Bidders/offerors and Contracting Officers are encouraged to use alternative dispute resolution (ADR) procedures to resolve protests at any stage in the protest process. If ADR is used, the Department of Veterans Affairs will not furnish any documentation in an ADR proceeding beyond what is allowed by the Federal Acquisition Regulation.

2.16 SUBMISSION INSTRUCTIONS

INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS/QUOTERS

The Government anticipates award of a firm fixed price contract resulting from this solicitation.

Bidding materials are available in electronic format only and are available to prime contractors that meet the SBA size standards for a small business under NAICS code 562910 Remediation Services. Prime contractors may share bidding materials with subcontractors and suppliers as necessary. However, all questions shall be submitted through/by the prime contractors on behalf of their subcontractors and suppliers.

Bonding: A Performance Bond, Payment, & Bid are required.

System for Award Management: Quoter must be currently registered in SAM (System for Award Management) or expect to be registered at time of Contract Award, which may occur immediately after the solicitation close date.

Service Disable Veteran Owned Small Business (SDVOSB) Set Aside: This solicitation is set-aside exclusively for SDVOSB concerns. To be considered for award prospective Quoters must be a verified SDVOSB concern in the VA Center for Verification and Evaluation (CVE) Vendor Information Pages (VIP) pages at the date and time set for receipt of offers. An Quoter who is not a verified SDVOSB concern at the date and time set for receipt of offers will have their quote rejected as non-responsive, and will not be considered for award.

Period for acceptance of quotes: The Quoter agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the solicitation.

Oral Statements: No oral statements made by the Veteran, VA employees other than the Contracting Officer, or other interested parties will take precedence over the written terms and conditions of the solicitation or resultant contract.

Prebid Conference and Site Visit: A site visit is scheduled for Thursday Dec 1, 2022. One at 10AM.

Questions Regarding the Solicitation and Project: All questions shall be submitted in writing to Jeff Reed, contracting officer, via e-mail only at jeffrey.reed@va.gov. Questions will be accepted up to 4:00 PM (EST) on Dec 6, 2022. The Government will not answer any questions submitted after this date and time. i. Technical - Contractor Approach & Project Schedule (limit to 3 pages) A project schedule is required– Each offeror’s proposal must address the following:

a Order of work elements to include project phasing b Number of days for each work element c Identification of work elements in the critical path d Identification of long lead time materials

ii. Past Performance – 3 References utilizing attached questionnaire.

a Past performance shall provide adequate information on completed or current contracts considered most relevant in demonstrating the ability to perform the proposed work describing the offeror’s previous experience in residential home modification or related tasks as identified within the Performance Work Statement, both commercial and Government. Offerors are required to explain what aspect of each contract is deemed relevant to the complexity and magnitude as related to the requirements of this solicitation and in accordance with Section M.

b Each proposal shall provide current and relevant information regarding offerors actions under previously awarded contracts. Offerors shall identify past contracts (including Federal, State, local government, and private) for efforts similar to the Government requirement as stated in the RFP. Limit reference for work performed to the last three (3) years. All references for work that have not been performed within three (3) years of the issue month of the solicitation will not be evaluated. In addition, past performance information on contracts not listed by the offeror may be solicited and used in determining the overall past performance rating.

c Lack of any past performance will not automatically disqualify an offeror, but is a factor that is considered as part of the responsibility determination required by regulation.

2.18 BASIS FOR AWARD

EVALUATION FACTORS FOR AWARD

I. This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection methodology. By submission of its offer, the Offeror accepts all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. All technically acceptable offerors, with satisfactory past performance, shall be treated equally except for their prices. Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation and conditions and provide complete accompanying rationale.

II. The Government intends to select ONE contractor for award of this effort. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make an award based on initial offers received, without discussions of such offers.

III. For the purpose of award, the government shall evaluate offers based on the factors described below:

A. Cost/Price Evaluation

i. Proposals will initially be ranked according to price from lowest price to highest price.

ii. Rejection of Unrealistic Offers:

a While the Government intends to utilize a lowest price technically acceptable methodology to award, the Contracting Officer must make a determination that the pricing is fair and reasonable for the project effort. The Contracting Officer will review pricing to ensure that offers are not unrealistic in terms of project requirements, including contract terms and conditions, or unrealistically high or low in cost/price when compared to Government estimates, or are unbalanced, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the project B. Past Performance:

i. A potential awardee must have an “Acceptable” past performance record. Offerors should submit three past performance references by utilizing the attached past performance questionnaire. This should detail residential construction and work similar to that detailed in the PWS for projects of similar magnitude completed within the last three years.

ii. Past Performance will be considered on an Acceptable or Unacceptable basis.

iii. The Government may seek relevant performance information on all responsive and otherwise Technically Acceptable Offerors through sources such as CPARS or PPIRS or other government data bases and other sources that are available. The government shall not be limited in its search for performance data.

C. Technical Acceptability:

i. Each Offeror’s technical proposal will be evaluated to determine if the Offeror provides a sound, compliant approach that meets the requirements of the Performance Work Statement (PWS) and demonstrates a thorough knowledge and understanding of those requirements.

ii. The ability of the Offeror’s plan to deliver a quality product and effectively manage their team and coordinate all work throughout the project shall be evaluated by relevant technical abilities in the following area:

a Work Schedule/Methods; the offeror’s proposed construction schedule will be evaluated relative to overall coordination of the construction phase, to include ability to identify all required activities of the specific project, identification of critical path work elements, identification of long lead time materials, and the offeror’s ability to schedule the activities in a logical sequence and within the time required in this solicitation.

b The awarded company must demonstrate the ability to execute the Multi Step mold removal remediation process.

c Inspection: Visibly detect visible signs of mold. Take air samples to measure the levels of spores as well as determine and needed.

d Containment: Contain the contamination This can be done by shutting of air systems and installing physical barriers to keep the mold in its physical location(s) e Filtration: Once the infestation is contained the GC must filer spores out to the air. If the mold infestation is extensive, we will also vacuum up spores that have settled onto any surfaces.

f Clean up: Use a combination of anti-fungal and anti-microbial treatments to clean the colonies of mold. If the mold has grown into any porous material, such as wood or walls, remove and replace it.

g Sanitation: Once, we've finished the remediation process, sanitize the space using fogging machines to deodorize the air as well as furnishings.

iii. Additionally, the GC must provide certification of Level IV and Level V certification for mold removal.

iv. The GC must also provide proof as a Licensed mold removal professional that is equivalent or hire to the state of Florida Mold removal licensing requirements.

v. GC must also provide examples of past relevant work and experience in the act of mold removal.

vi. Financial Suitability: Due to the size and extent of the Scope of work the GC and or sub GC’s also provide proof of licensing and bonding to do mold removal, replacement of drywall and wood, patch and paint.

vii.

viii. The Technical Evaluation subfactors will be evaluated as Acceptable or Unacceptable per the definitions below:

a Acceptable - The proposal clearly meets the minimum requirements of the solicitation.

b Unacceptable - Proposal does not clearly meet the minimum requirements of the solicitation.

ix. An evaluation rating of Technically Acceptable / Unacceptable will be assigned upon completion of the technical proposals evaluation. If an Offeror receives a technical rating of “Unacceptable” they will not be considered for award.

IV. Source Selection Decision:

A. Proposals will initially be ranked according to price from lowest to highest. The lowest priced offer will be evaluated to determine the past performance rating. If that offeror receives an acceptable past performance rating, the proposal will be evaluated for technical acceptability. If that offeror receives an acceptable technical rating, award will be made to that low price offeror. Should the low price offer receive a unacceptable rating for past performance or technical acceptability, evaluation of the offer will stop and the process will begin again with the next lowest-price offeror until the lowest-priced offer with technical and past performance acceptability is reached.

B. The Government shall select the source based upon an evaluation of the Offeror’s price, past performance acceptability, and technical acceptability. The Government shall choose the lowest realistically priced offer meeting non-price requirements.
