About this file

This document contains questions and answers related to solicitation number 36C10A23Q0082 for a Records Storage and Retrieval System. The Department of Veterans Affairs is seeking a commercially available off-the-shelf software solution to modernize its records management system. The deadline for submitting Volume I, demonstrating the virtual technical capabilities of the solution, has been extended to March 7, 2023. Pricing information will be requested later in the evaluation process. While the solicitation language refers to liquidated damages, this does not apply as the vendor will only provide installation, configuration and technical support services, and will not host or manage any VA data or systems. Federal acquisition regulations would govern any resulting contract.

36C10A23Q0082 Amendment 0001 – Industry Questions and Answers

Question 1: Does the Volume 1 only include the Video or also the pricing? We noticed that the other volumes include pricing, but Volume 1 does not. Just wanted to make sure that all that is required in Volume 1 (due Feb 28) is the video?

Answer: Step 1 only requires the submission of a video demonstration. Pricing is not required until Step 2. The deadline to submit Volume I – Virtual Technical Demonstration is extended to March 7, 2023 @ 10:00AM Eastern Standard Time.

Question 2: To confirm, it appears that section c. liquidated damages was removed from this RFQ?

Answer: Based on Section C on page 33 of the PD – this paragraph pertains to Vendors or Contractors that are hosting a solution and have operational control. It does not apply in this situation. The language is standard in the event of such a situation. The solution (application) will be hosted within the FSC boundary and managed by VA administrators. The vendor will be providing installation and configuration guidance during the process. We will be using the commercially off-the-shelf (COTS) software in our VA enclave, most likely the VA Enterprise Cloud (Azure). The vendor will not host any data and will not have any access to the VA network or any systems. They will not be issued Personal Identity Verifications. They will only provide technical support and guidance.

Question 3: Total Recall is licensed as a COTS. If we were to win the RFQ, could we have [vendor specific license agreements] added to the contract?

Answer: Per the Governing Law on Page 2 of the RFQ, Federal law and regulations, including the Federal Acquisition Regulations (FAR), shall govern this Contract/Order.

Commercial license agreements may be made a part of this Contract/Order but only if both parties expressly make them an addendum hereto, as permitted by FAR 12.212.
