About this file

This is a Notice of Intent to Award issued by the Oregon Department of Transportation (ODOT) Procurement Office for Mini-Solicitation 35687 / 73000-00007022, dated September 18, 2023. The notice announces that Kittelson and Associates, Inc. has been selected as the top-ranked firm for negotiations of a Work Order Contract (WOC) to provide personal services for the City of Dallas Transportation System Plan Update. ODOT's Project Manager, Mark Bernard, will serve as the primary contact for negotiating the statement of work (SOW), schedule of performance, and costs. The contracting phase is expected to follow a defined schedule, with negotiations anticipated to be completed and ready for legal sufficiency review within the timeframe outlined in the notice. No work is authorized until the WOC is executed and the consultant receives a written Notice to Proceed (NTP) from the ODOT Project Manager.

The negotiation schedule establishes specific timelines for key activities, including establishing work sessions within 5-10 business days, consultant response to SOW comments within 5 days, ODOT response within 3 days, and submission of a Breakdown of Costs (BOC) within 5-10 days of final scope approval. The BOC submission must demonstrate subcontractor utilization to meet Disadvantaged Business Enterprise (DBE) goals, which require approval from ODOT's Office of Civil Rights prior to contract execution. Legal sufficiency review is anticipated within 20 business days of submission, with signature routing and execution expected within 6-8 days thereafter. The award submittal requirements include a final BOC, final SOW, and committed DBE Breakdown with certification forms and OCR approval. If agreement on costs, tasks, or other WOC requirements cannot be reached within the specified timeframe and parties are negotiating in good faith, additional time may be mutually agreed upon; otherwise, ODOT may terminate negotiations and begin discussions with the next highest-ranked firm.
