About this file

This is a Project Labor Agreement (PLA) Market Survey Notice issued by the 354 Contracting Squadron/Purchasing at Eielson Air Force Base (AFB) under the Department of the Air Force Pacific Air Forces. The notice solicits feedback from the construction community regarding the potential use of PLAs for four large-scale construction projects and one large-scale demolition project at Eielson AFB, with each project potentially exceeding $35 million in value. The Government seeks input to determine whether implementing PLAs will advance economy and efficiency in federal procurement, promote adequate competition at fair and reasonable prices, and comply with applicable statutes, regulations, and laws.

The survey targets both unionized and non-unionized contractors, as well as contractors experienced in the federal marketplace and new entrants interested in competing for these procurements. The notice indicates this is an informational solicitation designed to gather market intelligence rather than a formal competitive bid opportunity. No specific response deadline, award date, or pricing terms are indicated in this notice, as it functions as a pre-solicitation mechanism to inform the Government's decision-making process regarding PLA implementation for the identified projects at Eielson AFB.

Project Labor Agreement (PLA) Market Survey for Eielson AFB, 354 CONS/PKA – Multiple Projects THIS IS A PROJECT LABOR AGREEMENT (PLA) SURVEY ONLY. This is not a Request for Proposals (RFP), Request for Quote (RFQ), or an Invitation for Bid (IFB) and it shall not be construed as an obligation on the part of the Government. There will be no solicitation, specifications, or drawings available at this time. This is not an announcement of the availability of a solicitation nor is it a means of generating a plan holder’s list.

Definitions:

RFO 22.502-1

Large-scale construction project means a Federal construction project within the United States for which the total estimated cost of the construction contract to the Federal Government is $35 million or more.

Project labor agreement means a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f).

The 354 CONS/PKA is soliciting feedback from the construction community addressing the potential use of PLA for four (4) large scale construction and one (1) large scale demolition projects (each potentially >$35 million) on Eielson AFB (See Attachment 1). The information collected will be used to determine if the use of project labor agreements will (1) advance the Federal Government's interest in achieving economy and efficiency in Federal procurement; (2) promote adequate competition at a fair and reasonable price; and (3) be consistent with statutes, regulations, laws, etc. The Government is seeking information from both unionized and non-unionized contractors, as well as contractors familiar with the federal marketplace, as well as new entrants, that may be interested in participating in competition for these procurements.

The projects are planned to be executed via the design/bid/build process. General period of performance is anticipated to be approximately 12-36 months for each project.

REVOLUTIONARY FEDERAL ACQUISITION REGULATION OVERHAUL (RFO) 22.501 requires:

RFO 22.502-1 POLICY:

(a) Executive Order (E.O.) 14063, Use of Project Labor Agreements for Federal Construction Projects, requires agencies to use project labor agreements in large-scale construction projects to promote economy and efficiency in the administration and completion of Federal construction projects.

(b) When awarding a contract in connection with a large-scale construction project, agencies must require use of project labor agreements for contractors and subcontractors engaged in construction on the project, unless an exception at 22.502-2(d) applies.

22.502-2 (d) Exceptions to project labor agreement requirements —

(1) Exception. The senior procurement executive may grant an exception from the requirements at 22.502-1(b), providing a specific written explanation of why at least one of the following conditions exists with respect to the particular contract:

(i) Requiring a project labor agreement on the project would not advance the Federal Government's interests in achieving economy and efficiency in Federal procurement. The exception must be based on one or more of the following factors:

(A) The project is of short duration and lacks operational complexity.

(B) The project will involve only one craft or trade.

(C) The project will involve specialized construction work that is available from only a limited number of contractors or subcontractors.

(D) The agency's need for the project is of such an unusual and compelling urgency that a project labor agreement would be impracticable.

(ii) Market research indicates that requiring a project labor agreement on the project would substantially reduce the number of potential offerors to such a degree that adequate competition at a fair and reasonable price could not be achieved. (See 10.002(b)(1) and 36.104). A likely reduction in the number of potential offerors is not, by itself, sufficient to except a contract from coverage under this authority unless it is coupled with the finding that the reduction would not allow for adequate competition at a fair and reasonable price.

(iii) Requiring a project labor agreement on the project would otherwise be inconsistent with Federal statutes, regulations, Executive orders, or Presidential memoranda.

In consideration of the above factors, and any others which may be deemed appropriate, the construction community is invited to comment on the use of PLAs for the above projects at Eielson. The Government intends to use the responses to the attached questionnaire for the (1) attached list of projects and (2) any other projects in same geographical area (not yet identified) of similar scope/magnitude (for 18 months).

Accordingly, the construction community is requested to respond to this survey regarding PLA. Please fill out Attachment 1 as thoroughly as possible. Attachment 1 contains drop down menus to help ensure consistency and accuracy for most general questions. Utilize the comment tab to elaborate or provide additional details to support your responses for each project as needed. We may reach out to the responders directly to ask follow-up questions or get additional clarity for responses.

LETTERS SIMPLY INDICATING SUPPORT FOR, OR OPPOSITION TO, LABOR UNIONS AND/OR PLAs DO NOT OFFER ANY USEFUL INFORMATION AND WILL NOT BE CONSIDERED.

After reviewing the responses to this special notice, the Government intends to decide whether to pursue an exception to the mandatory use of a PLA or not. This survey is for planning purposes only and shall not be construed as a Request for Proposal or as an obligation on the part of the Government. The Government does not intend to award a contract based on this market survey or otherwise pay for the requested information. The Government will not provide a debriefing on the results of this survey. All information will be held in a confidential manner and will only be used for the purposes intended. Please provide your comments via email to David Pfau, at david.pfau.2@us.af.mil and Darnell Holliman, at darnell.holliman.1@us.af.mil NOT LATER THAN 11 JUNE 2026.
