About this file

This is a State Corporation Commission (SCC) requirement form for the Virginia Food Service Fresh Bread contract opportunity. The document establishes compliance requirements for bidders organized as corporations, limited liability companies, business trusts, limited partnerships, or registered limited liability partnerships that seek to transact business in the Commonwealth of Virginia. All bidders must provide either their SCC identification number, confirm they are not a business entity requiring registration, certify that they are an out-of-state entity without regular business presence in Virginia, or submit legal counsel opinion explaining why their Virginia contacts do not constitute transacting business in the state. Bidders may also request a waiver if they have a pending SCC application for authority to transact business in Virginia.

The form requires mandatory disclosure of business entity status and SCC registration information as a condition of bid submission. Any awarded contractor must maintain continuous compliance with these registration requirements throughout the contract term, and the contracting public body reserves the right to void any contract if the business entity fails to remain registered or authorized to transact business in Virginia as required by Title 13.1 or Title 50 of the Code of Virginia. Failure to provide the required information may result in bid rejection unless a waiver is granted by the Department of General Services Director or the relevant local governing body chief executive.
