About this file

This is an Iran Contracting Act Certification form required by the State of California for RFB #3922 related to the Eastern Municipal Water District's Scale Computing HCI Cluster Replacement procurement. The certification applies to all bidders submitting proposals for contracts valued at $1,000,000 or more. Bidders must complete and submit the certification with their bid proposal; failure to do so may result in the bid being deemed non-responsive. The form requires bidders to certify under penalty of perjury that their company is not on the California Department of General Services' current list of persons engaged in investment activities in Iran and does not qualify as a financial institution extending $20,000,000 or more in credit to another person for 45 days or longer for energy sector services in Iran.

The certification form provides two options for compliance: Option #1 requires the authorized company representative to certify eligibility and sign the form with company name, Federal ID Number, printed name, title, and execution date; Option #2 allows companies that have obtained a case-by-case exemption under Public Contract Code Sections 2203(c) and (d) to submit documentation of exemption approval instead. California law establishes significant penalties for false certifications, including civil penalties equal to the greater of $250,000 or twice the contract amount, contract termination, and a three-year ineligibility period to bid on state contracts.
