St. Clair Firehouse Addition Project Manual

This is a Project Manual prepared by Alfred Benesch & Company for the Borough of St. Clair, Pennsylvania, detailing a public works construction contract for a firetruck garage addition to Alert Fire Company No. 1 in Schuylkill County. The project involves constructing a firetruck garage structure adjacent to the existing firehouse on Second Street, including building foundations, grading, electrical, HVAC, insulation, and concrete floors. Sealed bids were to be received online via the PennBid Program until Thursday, May 28, 2026, at 1:00 PM prevailing time, with public bid announcement scheduled for Tuesday, June 2, 2026, at 6:30 PM during the regularly scheduled Borough Council meeting. Bid results were to be available online at http://PennBid.bonfirehub.com following the meeting. The project manual includes a pre-bid conference option, site visits permitted upon request, and the entire project was to be awarded to one contractor. The contract time for substantial completion is October 16, 2026, with final completion by October 30, 2026. The Owner reserves the right to award the contract to the lowest responsive and responsible bidder within 60 days of bid opening, or 120 days if delayed by governmental approvals or bond closings.

The bid must be accompanied by bid security equal to 10 percent of the bidder's maximum bid price in the form of a certified check, bank money order, or bid bond. The successful bidder must furnish Performance and Payment Bonds, each in the amount of 100 percent of the contract price with a corporate surety approved by the Owner, within ten calendar days of receiving the Notice of Award. The contract includes unit price work with prices based on estimated quantities, and final payment will be based on actual quantities determined during construction. Progress payments will be made with retainage of 10 percent until 50 percent of work is complete, then 5 percent until substantial completion, followed by 2 percent until final payment. Final payment shall bear interest at six percent per annum (or the bond issue rate if less) from the date payment becomes due. Liquidated damages are assessed at $500 per day following the substantial completion date and $250 per day following the final completion date. This is a public works contract subject to the Public Works Employment Verification Act (43 P.S. 167.1-167.11), Pennsylvania prevailing wage rates, the Pennsylvania Human Relations Act regarding non-discrimination in employment, and the State Contractor Responsibility Program requirements.

ARTICLE 7 – INTERPRETATIONS AND

ADDENDA

7.01 Bidder shall submit all questions about the

meaning or intent of the Bidding Documents via the “Messages/Vendor Discussions” feature in PennBid. Interpretations or clarifications considered necessary by

Engineer in response to such questions will be issued by Addenda posted to PennBid to all parties recorded by Engineer as having received the Bidding Documents. Questions received less than ten days prior to the date for opening of Bids may not be answered.

Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect.

7.02 Addenda may be issued to clarify, correct, or

change the Bidding Documents as deemed advisable by Owner or Engineer.

ARTICLE 8 – BID SECURITY

8.01 A Bid must be accompanied by Bid security

made payable to Owner in an amount of

10 percent of Bidder’s maximum Bid price and in the form of a certified check, bank money order, or a Bid bond (on the form attached) issued by a surety meeting the requirements of Paragraphs 5.01 and 5.02 of the General Conditions.

8.02 If a surety Bid Bond is utilized, it shall be

mandatory that the Bid Bond specifically identify the Bid, and the date of the Bid which it accompanies; additionally, it shall be mandatory that the power of attorney accompanying a Bid Bond evidencing the authority of the person signing on behalf of the surety company to sign the Bid Bond shall be dated the same date as the Bid Bond;

further, it shall be mandatory that the Bid

Bond itself be dated the same date as the Bid, as well as signed by the principal bidder and the surety company through its authorized representatives. Failure to comply with any of the aforesaid positions shall result in the disqualification of the Bid, which Bid shall not thereafter be considered.

8.03 As soon as each of the Bids received has been

reviewed and the Bids have been compared, Owner will return the Bid security of all

Bidders except the three apparent lowest responsive and responsible Bidders. Bid security provided by Bidders who are not among the apparent three lowest responsive and responsible Bidders will be returned within ten (10) calendar days following the date of Bid opening. When the Agreement has been executed by the successful Bidder, the Bid security of the other Bidders will also be returned. The Bidder to whom the Notice of Award is given will be required to submit to Owner the required Bonds within ten (10) calendar days from the date of receipt of the

Notice of Award. In case of a failure of

Bidder to whom a Notice of Award has been given to execute and deliver in a timely manner the required Bonds, Owner may at its option consider such Bidder in default, in which case the Bid security accompanying the proposal shall become the property of

Owner. The successful Bidder to whom a

Notice of Award is given will be required to execute the Agreement and deliver it, together with the required evidence of insurance coverages, to the Owner within ten

INSTRUCTIONS TO BIDDERS Section 002000 – Page 6

(10) calendar days from the date when the

Notice of Award is delivered to the successful Bidder. In case of failure of the successful Bidder to execute the Agreement, or to submit the required evidence of insurance coverages in accordance with the

Contract Documents, Owner may consider the successful Bidder in default, in which case the Bid security accompanying the Bid shall become the property of Owner.

ARTICLE 9 – CONTRACT TIMES

9.01 The number of days within which, or the

dates by which, Milestones are to be achieved and the Work is to be substantially completed and ready for final payment are set forth in the Agreement.

of materials and equipment specified or described in the Bidding Documents without consideration of possible substitute or “or-equal” items. Whenever it is specified or described in the Bidding Documents that a substitute or “or-equal” item of material or equipment may be furnished or used by

Contractor if acceptable to Engineer, application for such acceptance will not be considered by Engineer until after the

Effective Date of the Agreement. The procedure for submission of any such application by Contractor and consideration by Engineer is set forth in Paragraph 6.05 of the General Conditions and may be supplemented in the Supplemental

Conditions.

Bidder so requested, shall within five days after Bid opening, submit to Owner a list of all such Subcontractors, Suppliers, individuals, or entities proposed for those portions of the Work for which such identification is required. Such list shall be accompanied by an experience statement with pertinent information regarding similar projects and other evidence of qualification for each such Subcontractor, Supplier, individual, or entity if requested by Owner. If

Owner or Engineer, after due investigation, has reasonable objection to any proposed

Subcontractor, Supplier, individual, or entity, Owner may, before the Notice of Award is given, request apparent Successful Bidder to submit a substitute, without an increase in the

Bid.

12.02 If apparent Successful Bidder declines to

make any such substitution, Owner may award the Contract to the next lowest Bidder that proposes to use acceptable

Subcontractors, Suppliers, individuals, or entities. Declining to make requested substitutions will not constitute grounds for forfeiture of the Bid security of any Bidder.

Any Subcontractor, Supplier, individual, or entity so listed and against which Owner or

Engineer makes no written objection prior to the giving of the Notice of Award will be deemed acceptable to Owner and Engineer subject to revocation of such acceptance after the Effective Date of the Agreement as provided in Paragraph 6.06 of the General

Bidder will be disqualified from further bidding on the Work.

15.03 After the commencement of opening of Bids, no Bid may be withdrawn during the period specified for the holding of Bids as set forth in “Bids to remain subject to acceptance” below, except as provided in Pennsylvania

Act 4 of 1974, P.L. 9, relating to withdrawal of a bid in the event of a mistake.

ARTICLE 16 – OPENING OF BIDS

16.01 Bids will be announced at the time and place

Bidders after the opening of Bids.

ARTICLE 17 – BIDS TO REMAIN SUBJECT

TO ACCEPTANCE

17.01 Owner shall award the contract to the lowest

responsive and responsible Bidder or shall reject all Bids within forty-five (45) days of the date of the Bid opening, and no Bidder may withdraw his Bid before the expiration of such forty-five (45) day period; provided, however, if the award of contracts is delayed by required approval of another government agency, the sale of bonds closing on project loans or the award of a grant or grants, Owner shall reject all Bids or award the contract to the lowest responsive and responsible Bidder within seventy-five (75) days of the date of

Bid opening, and in such event no Bidder may withdraw his Bid before the expiration of such seventy-five (75) day period.

Extensions of the date for the award of the contract may be made by the mutual written consent of Owner and the lowest responsive and responsible Bidder.

ARTICLE 18 – EVALUATION OF BIDS AND

AWARD OF CONTRACT

18.01 Owner reserves the right to reject any or all

Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to not be responsible. Owner may also reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that Bidder. Owner also reserves the right to waive all informalities not involving price, time, or changes in the Work and to negotiate contract terms with the Successful Bidder.

Discrepancies between the unit price and the corresponding extended total will be resolved in favor of the unit price, provided that the

BIDDER agrees to the correction of the extended total and subsequent correction of the base bid price. Discrepancies between the indicated sum of any column of figures and the correct sum thereof will be resolved in favor of the correct sum. Discrepancies between words and figures will be resolved in favor of the words.

18.02 More than one Bid for the same Work from

an individual or entity under the same or different names will not be considered.

Reasonable grounds for believing that any

Bidder has an interest in more than one Bid for the Work may be cause for disqualification of that Bidder and the rejection of all Bids in which that Bidder has an interest.

18.03 In evaluating Bids, Owner will consider

whether or not the Bids comply with the prescribed requirements, and such alternates, unit prices and other data, as may be requested in the Bid Form or prior to the
