About this file

This is an E-Verify Requirement document issued by the Town of Palm Beach, Florida, establishing compliance mandates for contractors and subcontractors on municipal contracts. The document requires all proposers to be registered with the E-Verify System (E-Verify.gov) and to use the system to electronically verify employment eligibility of all newly hired workers beginning January 1, 2021. Proposers must ensure that all workers, subcontractors performing contract duties, and obligations are similarly registered and compliant with the E-Verify System. The Town of Palm Beach specifically relates this requirement to the Sole Source Procurement for the MVB3X Modular Vehicle Barrier System awarded to Advanced Security Technologies LLC.

Proposers are required to obtain affidavits from each subcontractor stating that the subcontractor does not employ, contract with, or subcontract with unauthorized aliens as defined under Florida Statutes Section 448.095(1)(k). Contractors must maintain copies of subcontractor affidavits for the duration of the subcontract and any extensions thereof. The Town of Palm Beach reserves the right to terminate contracts if it has good faith belief that a contractor has knowingly violated Section 448.095, Florida Statutes. Upon contract termination for such violations, the contractor is barred from being awarded future Town of Palm Beach contracts for one year from the termination date and remains liable for any additional costs incurred by the Town resulting from the termination. Subcontractor violations must be reported to the primary contractor, who must immediately terminate the subcontractor relationship upon Town notification.
