About this file

This is a Brand Name Justification document (FAR Part 13.106-1(b)(1)(i)) submitted by the Department of the Navy's Strategic Weapons Facility Pacific (SWFPAC) located at Naval Base Kitsap–Bangor in Silverdale, Washington.

SWFPAC seeks to procure preventative maintenance and emergent repair services for three existing mission-critical Uninterruptible Power Supply (UPS) units manufactured by American Power Conversion (APC). The services must be performed by an Original Equipment Manufacturer (OEM) authorized and certified service provider for APC equipment. The estimated dollar value of the requirement is redacted in the document. The justification authority cited is FAR 8.405-6(b) (Brand Name), permitting a single-source award based on the essential nature of the specified brand. The Government determined that only APC-authorized providers can guarantee compatibility with the proprietary hardware, software, and diagnostic tools specific to the APC UPS units, and that use of third-party components would void the manufacturer's warranty and introduce unacceptable risks of incompatibility and system failure. Market research confirmed that no alternative brand can maintain or repair APC products. The requirement will be competed at a minimum among all vendors identified through a Small Business Dynamic search. All quotations will be evaluated for price reasonableness in accordance with FAR 13.106-2. The document includes technical certification by Brittany Nicole Kirkham and contracting officer approval by Lillian Austin Tabbatha, both digitally signed on March 30, 2026.

1. Agency and Contracting Activity

The agency and contracting activity for this effort is the United States Department of the Navy’s Strategic Weapons Facility Pacific (SWFPAC) located on Naval Base Kitsap – Bangor, at 6401 Skipjack Circle, Silverdale, WA 98315-6499.

2. Description of the Action Being Approved

The acquisition of the supplies/services is peculiar to one manufacturer where the particular brand name, product, or feature is essential to the Government’s requirements, under a Brand Name Justification.

3. Description of Supplies/Services and Estimated Value

SWFPAC requires preventative maintanence and emergent repairs for three existing mission critical Uninterruptible Power Supply (UPS) units. To ensure system reliability and preserve the manufacturer's warranty, the services must be performed by an Original Equipment Manufacturer (OEM) authorized and certified service provider for American Power Conversion (APC) equipment. The total estimated dollar value is

4. Statutory Ordering Authority and Limited Source Justification

The justification authority for this limited source action is FAR 8.405-6(b) (Brand Name).

5. Rationale Supporting Use of Cited Statutory Authority

Three APC UPS units are integrated into SWFPAC’s existing Internet Technology network structure. Maintenance and repair services must be fully compatible with the proprietary hardware, software, and diagnostic tools specific to the APC model of the UPS units. The reliability of these mission-critical systems is paramount. Only an APC-authorized provider can guarantee that all replacement components, including batteries, fans, and capacitors are genuine OEM parts that meet the exact specifications required for safe and reliable operation and to avoid the existing warranty from being voided. Use of third-party parts introduces an unacceptable risk of incompatibility, premature failure, and potential damage to the UPS and the critical loads it protects.

6. Market Research Conducted

In summary, market research did not yield another brand that could provide the required maintanence and repair requirements without voiding the manufacturer’s product warranty, due to the proprietary design of the hardware. Market research has determined that no other brand can maintain or repair APC products.

7. Description of Efforts Made to Solicit Offers from as Many Potential Sources as Practicable

In addition to the market research described in Section 6 above, this requirement will be competed at a minimum among all vendors identified utilizing the Small Business Dynamic search.

8. Fair and Reasonable Determination

All quotations or offers will be evaluated in accordance with FAR 13.106-2 and award will not be made unless the Contracting Officer can find the price fair and reasonable.

9. Actions to Remove or Overcome Barriers to Competition

Based upon the aforementioned facts and details identified in Paragraphs 5 and 6 above, the Government does not foresee a feasible alternative to the selected brand.

SWFPAC will continue to monitor the marketplace for viable, cost-effective options to meet this requirement.
