About this file

This is a Justification for Other Than Full and Open Competition (Sole Source) document from the Department of the Navy, Strategic Weapons Facility Pacific (SWFPAC), issued under reference SPJA26-51.

SWFPAC requires professional assistance to migrate a mission-critical 2003 Microsoft Access database to Nintex Automation (K2) platform. Microsoft no longer supports 2003 Access without extended subscription, and SWFPAC's extended support ends July 2026 with no further subscriptions authorized. The migration must be completed under a compressed timeline while maintaining data integrity, database access, and solution operability. The justification cites FAR 13.106(b)(1)(i), asserting only one source is reasonably available. The sole source is justified because Ai Global Solutions holds exclusive rights to the proprietary form building tools Apper and FlowBase, which are essential to successfully perform the database migration within the required timeframe. These tools were previously used in a similar migration under Navy contract N0040625PS379 awarded to Flowcision LLC in August 2025. When Ai Global Solutions hired the developer of these tools from Flowcision in FY26, it acquired exclusive rights to them. Market research confirmed no other company can provide services using these proprietary tools. The requirement will be posted to SAM.gov to allow potential sources to submit quotes. Award determination will be based on fair and reasonable pricing per FAR 13.106-3(a). The document was technically certified by Kirkham Brittany Nicole on March 31, 2026, and approved by Contracting Officer Austin Tabbatha Lillian on April 2, 2026. The estimated dollar value is redacted.

WASHINGTON NAVY YARD, DC 20374-5127

IN REPLY REFER TO

SPJA26-51

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLE SOURCE FAR PART 13.501

1. Agency and Contracting Activity

The agency and contracting activity for this effort is the United States Department of the Navy, Strategic Weapons Facility Pacific (SWFPAC) located on Naval Base Kitsap – Bangor, at 6401 Skipjack Circle, Silverdale, WA 98315.

2. Description of the Action Being Approved

The acquisition of the supplies/services particular to one manufacturer or company because the supplies/services are unique or highly specialized under a Sole Source Justification.

3. Description of Supplies/Services and Estimated Value

SWFPAC currently supports a mission-critical 2003 Microsoft Access database which is in need of immediate migration to Nintex Automation (a.k.a. K2). Microsoft products no longer support 2003 Microsoft Access without a separate extended support subscription for Windows 11.

SSP/SWFPAC’s extended support subscription ends in July 2026, and no further subscriptions are authorized, which is driving the requirement for immediate migration of all SWFPAC legacy 2003 Microsoft Access databases to Nintex Automation. SWFPAC requires professional assistance to accelerate the migration in order to meet the deadline while ensuring required data integrity, database access, and solution operability.

Due to both the critical nature of the data to be transferred and the compressed timeline in which the migration must occur, SWFPAC requires professional assistance for the migration of its Microsoft Access legacy database to the Nintex Automation product. The knowledge and skill required to perform this crucial data migration under a compressed timeframe far exceeds that of SWFPAC’s personnel.

The total estimated dollar value is

4. Statutory Authority Permitting Sole Source Justification

This action is being executed in accordance with FAR 13.106(b)(1)(i) as only one source is reasonably available.

Enclosure FAR Part 8 GSA Order LSJ

Rev 8 dtd 22 Sep 2023

5. Rationale Supporting Use of Cited Statutory Authority

In August 2025, SWFPAC contract N0040625PS379 was awarded to Flowcision LLC, for a similar data migration using the contractor’s proprietary form building tools; Apper and FlowBase. In FY26, Ai Global Solutions acquired exclusive rights to these proprietary tools when it hired the developer of these tools from Flowcision. Ai Global Solutions is now the only vendor with rights to the Apper and FlowBase tools used in the Nintex Automation On-Premise platform, which SWFPAC currently utilizes.

6. Market Research Conducted

In summary, market research did not yield another company that could provide services with the form building tools Apper and FlowBase which are a requirement to successfully and seamlessly perform the database migration under the required timeframe.

7. Description of Efforts Made to Solicit Offers from as Many Potential Sources as Practicable

In addition to the market research described in Section 6 above, the requirement will be posted to the SAM.gov allowing as many potential sources as practicable to review the requirement and submit a quote or offer.

8. Fair and Reasonable Determination

All quotations or offers will be evaluated in accordance with FAR 13.106-3(a) and award will not be made unless the Contracting Officer can find the price fair and reasonable.

9. Actions to Remove or Overcome Barriers to Competition

Based upon the aforementioned facts and details identified in Paragraphs 5 and 6 above, the Government does not foresee a feasible alternative to the selected source

SWFPAC will continue to monitor the marketplace for viable, cost-effective options to meet this requirement.
