About this file

This file contains bid specifications and instructions for a fixed-price construction contract issued by Ada County Procurement for the removal and installation of five (5) rooftop units (RTUs) at the Ada County Victim Services Center located at 417 S. 6th Street, Boise, Idaho. The base bid scope includes the removal and installation of the five RTUs, with an additive alternate bid required for the installation of two additional RTUs, though the owner reserves the right to award the alternate only if funding permits. A mandatory pre-bid meeting is scheduled for March 2, 2026, at 2:00 p.m. at the project site, with attendance required for bid responsiveness. Written questions and substitution requests must be submitted by March 4, 2026, at 4:00 p.m., with an addendum to be posted by March 6, 2026. Sealed bids must be submitted electronically through the Bonfire platform no later than 4:00 p.m. on March 13, 2026. The Ada County Board of Commissioners will make the award recommendation on March 24, 2026, at 9:00 a.m., with the successful bidder required to present execution documents by April 1, 2026, for board consideration on April 7, 2026. Substantial completion is required by May 6, 2026, with final completion by May 13, 2026, with liquidated damages of $500 per day for late completion.

The contract price must include a $10,000 owner's contingency allowance in addition to the base bid amount. Bidders must be licensed under Idaho's Public Works Contractor Act and must list all proposed HVAC, plumbing, and electrical subcontractors with their addresses and subcontract amounts; failure to provide complete subcontractor information will render the bid non-responsive. The successful bidder must furnish performance and labor and material payment bonds equal to 100% of the contract amount from a surety with an A-VIII or better AM Best rating or current Treasury Department certification. Comprehensive insurance coverage is required including workers' compensation, employers' liability, commercial general liability with $2,000,000 general aggregate limits, business automobile liability of $1,000,000, builder's risk, installation floater, equipment floater, and riggers liability, with Ada County named as an additional insured on applicable policies. The award will be based on the lowest base bid amount submitted by a responsive bidder, and no state or federal funding will be utilized for this project.

Additive Alternate work will be included in the final Construction Contract will be made at

Owner’s sole discretion.

Bid non-responsive.

d. No Bid will be considered unless submitted as required herein.

e. Before being uploaded to the Bonfire platform, all forms must be completely filled out in ink or typewriting with signature in long hand, and the completed forms shall be without interlineations, alterations, or erasure. Forms shall contain no recapitulation of the work to be done.

f. The Total Bid Amount shall include an Owner’s Contingency Allowance of

Ten Thousand Dollars ($10,000.00), added to the Base Bid Amount. Said Contingency Allowance is to be used as directed by the Owner for Owner’s purposes, and only by Change Orders that indicate the amounts to be charged to the Contingency Allowance. Any and all unused amounts remaining from the Contingency Allowance upon completion of the Project will be credited to the Owner by deductive Change Order.

g. Bidders shall:

(i) carefully examine the Instructions to Bidders, Bidder’s Bid Form, Contract Documents, and any addenda issued subsequent thereto;

(ii) attend the mandatory pre-bid meeting at Ada County Victim Services

Center, located at 417 S. 6th St., Boise, Idaho 83702 (meet out front of the main entrance for meeting, then roof tour), on March 2, 2026 at 2:00 p.m. local time, and fully inform themselves as to the existing conditions and limitations;

(iv) make certain that they can meet the Project milestones established in the Contract Documents.

Construction Contract is attached hereto as Exhibit B.

i. No Bid shall be withdrawn for a period of thirty (30) days after the time scheduled for receipt of Bids.

j. An electronic copy of all information and specifications for the Project may be obtained free of charge at https://adacounty.bonfirehub.com.

k. Data contained in the Bid and all documentation provided therein becomes property of the County and the data becomes public information. If the Bidder wishes to have any confidential or proprietary information withheld from the public, such information must fall within the definition of “trade secret” contained within the Idaho Public Records Act, Idaho Code § 74-101 et seq. All “trade secret” information a Bidder wishes the County to withhold must be clearly marked “Trade Secret,” with each page of such information being clearly marked. Failure to mark such information as “Trade Secret” shall deem such information open to public inspection. Should Ada County be challenged in court by a third party for a decision to withhold or redact information so identified by Bidder, Bidder agrees, by submitting its Bid, to indemnify, defend, and hold harmless Ada County for any judgments, attorney fees, and/or court costs associated with asserting the documents contain “trade secret” information. Bidder agrees and acknowledges that the

Bidder’s Bid Form and Total Bid Amount (BT-93WH) are disclosable public records. Ada County reserves the right to make an independent discretionary decision whether or not the documents

marked as “Trade Secret” qualify as such pursuant to the Idaho Public Records Act. All documents not marked as “Trade Secret” are subject to release in compliance with the Idaho Public Records Act.

3. Taxes. Bidders shall include in their Bids all taxes which are levied by Federal, State, or Municipal Governments upon labor and for material entering into the Work, including materials purchased by Owner, if any, and the Contractor shall pay all such taxes and show evidence of payment as described in the Construction Contract. Bidders are referred to Idaho Code § 63-3609 for further information.

4. Condition Precedent for Public Works Contract. Bidders must, as a condition precedent to entering into the Construction Contract, review and comply with Idaho Code § 63-1502.

5. Right to Reject Bids. The right to reject any or all Bids or to accept the Bid judged by the Owner as most satisfactory for its requirements is expressly reserved by the Owner. The

Owner reserves the right, in its sole discretion, to waive any informality or technical defect in Bids received when the defect is deemed immaterial to the potential acceptance of the Bid by the Owner and a waiver of the defect would not give the Bidder an unfair advantage in the bid process.

6. Objections. Written objections to specifications or bidding procedures must be received by Ada County Procurement at least one (1) business day before the date and time the Bids are scheduled to be received.

7. Requirements for Signing Bids. A signature on the Bid Form certifies that Bidder accepts and agrees to the terms, conditions, and requirements contained in this solicitation, including but not limited to, the Contract Documents and these Instructions to Bidders. Further, signing party certifies that it is authorized to sign and submit this Bid on behalf of the Bidder, and further acknowledges that he/she is responsible for reviewing and acknowledging any addenda that have been issued for the solicitation.

BID 26035 INSTRUCTIONS TO BIDDERS – PAGE 6

8. Explanation to Bidders and Addenda.

a. A mandatory pre-bid meeting will be held for all potential Bidders on March

2, 2026, at 2:00 p.m. local time, at Ada County Victim Services Center, located at 417 S. 6th St., Boise, Idaho 83702 (meet out front of the main entrance for meeting, then roof tour). Potential

Bidders will be given the opportunity to view the Project areas and ask questions of County staff managing the Project. Bidders interested in bidding on the Project must attend. A Bid from a Bidder failing to attend the mandatory pre-bid meeting shall be deemed non-responsive.

b. Prior to or following the pre-bid meeting, neither the Owner nor Owner’s

Representative will give verbal answers to any inquiries regarding the meaning of the Contract

Documents or provide verbal instructions prior to the award of the Construction Contract. Any verbal statement regarding same by any persons, prior to the award, shall be unauthoritative.

c. Any and all questions, substitution requests, requests for clarification, or explanations desired by potential Bidders must be submitted in the Vendor Discussions section of the

Bonfire project listing, and must be received no later than March 4, 2026, at 4:00 p.m. local time.

An addendum will be made available on the Ada County website at https://adacounty.bonfirehub.com on or about March 6, 2026. Notice of any addenda will be sent to only those persons who have registered as a vendor on Bonfire for this Project.

d. All addenda issued to Bidders prior to date of receipt of Bids shall become a part of these Instructions and/or the Contract Documents and all Bids are to include the work described in all addenda issued. Each Bid submitted must specifically list all addenda in the Bidder’s

Bid Form.

9. Qualifications of Bidders.

BID 26035 INSTRUCTIONS TO BIDDERS – PAGE 7

a. Bidders must be licensed in the State of Idaho in accordance with the Public

Works Contractor Act, Idaho Code §§ 54-1901 et seq. The Owner waives the requirements of Idaho

Code § 54-1902(2) that the Contractor self-perform at least 20% of the Work. Bidders are invited to consult with the Idaho Division of Occupational and Professional Licenses for further requirements of state law. Bidders shall enter on their Bid Form each HVAC, plumbing or electrical subcontractor called for on the Bid Form that the Bidder proposes to use during construction, the amount of the subcontract, and the subcontractor’s address. This includes any Owner required subcontractors that are identified in the plans or specifications. If the Bidder intends to self-perform any HVAC, plumbing or electrical work, both the Bidder’s public works license number and the trade license number for the HVAC, plumbing or electrical work to be self-performed must be stated on the Bid

Form. Failure to list each subcontractor trade, subcontract amount, the Bidder’s current public works license number, and the Bidder’s trade license number(s) (if applicable) as called for on the Bid Form will disqualify the Bid. Upon award, the successful Bidder will be required to submit a complete list of all subcontractors and specialty contractors that will do work on the Project under the Construction Contract. All subcontractors and specialty contractors will be required to be properly licensed under the Idaho Public Works Contractor Act, except subcontractors performing work of a value of One Hundred Thousand Dollars ($100,000) or less under the direct supervision of an Idaho licensed public works contractor who holds a Class “Unlimited,” “AAA,” “AA,” or “A” license under the Idaho Public Works Contractor Act. The successful Bidder may thereafter substitute subcontractors only as allowed by Idaho Code § 67-2310(3).

b. Bidders shall be responsible for complying with all applicable provisions of the Idaho Code as it relates to bidding of this project or construction of the Work.

c. No state or federal funding will be utilized on this Project.

BID 26035 INSTRUCTIONS TO BIDDERS – PAGE 8

10. Bonds. Before the Construction Contract is signed, the successful bidder must furnish performance and labor and material payment bonds in the amount of 100% of the Construction

Contract amount, as allowed in Idaho Code § 54-1926. The bonds shall be provided by a surety company or companies with AM Best rating(s) of A-VIII or better. If the surety does not have a current AM Best rating it must be currently certified by the U.S. Department of Treasury as an approved surety with an underwriting limitation greater than the bond amount. All sureties must be authorized to do business in the state of Idaho. All bonds shall name the County as obligee with copies of the bonds provided to Ada County Operations. The Bidder shall include the premiums for such bonds in its Bid.

11. Examination of Bids. After the Bids are received by Ada County Procurement, Procurement will review the Bids for compliance with these Instructions and Idaho Code. After that review, Ada County Procurement will provide a written recommendation to the Board of Ada County

Commissioners. Bidders will be supplied with a copy of the recommendation on or about March 17, 2026.

12. Basis of Recommendation. Ada County Procurement will recommend the

Construction Contract be awarded to the responsive Bidder submitting the lowest Base Bid Amount.

13. Protest of Recommendation. Any Bidder’s protest of the recommendation must be in writing and received by Ada County Procurement at procurement@adacounty.id.gov no later than

4:00 p.m. local time on March 20, 2026.

14. Award of Contract. The Construction Contract shall be deemed as having been awarded when the Bid has been accepted by formal motion made by the Board of Ada County

Commissioners during the open business meeting commencing at or about 9:00 a.m. local time, March 24, 2026, in the Commissioners Conference Room, 200 W. Front Street, Room 3255, Boise, mailto:procurement@adacounty.id.gov

Idaho 83702. The Bid award meeting may also be viewed via livestream at:

https://www.youtube.com/channel/UCmREyet73vxhBFCffWClEKA. The successful Bidder shall present all documents required for executing the Construction Contract to the Ada County Operations

Department, c/o Director, no later than 4:00 p.m. local time on April 1, 2026, unless otherwise provided, so that the Board of Ada County Commissioners may consider the Construction Contract on April 7, 2026. The Bidder selected for the Project must execute a contract in substantially the form provided in Exhibit B. Bidders should read the Construction Contract carefully, as the selected

Bidder will be subject to all contract requirements contained therein, including the provision of insurance coverages. The terms of the Construction Contract will not be negotiated.

15. Time of Starting and Completion.

a. Owner estimates issuing a Notice to Proceed no more than ten (10) days after executing the Construction Contract. Substantial Completion of the Work is required no later than

May 6, 2026. Final Completion of the Work is required no later than May 13, 2026. Bidders are referred to Article VI of the Construction Contract for definitions of Substantial Completion and Final

Completion (see Terms and Conditions available at https://adacounty.id.gov/SmallConstructionTC).

Owner reserves the right to adjust these times as provided in the Construction Contract. After commencement of work on the Project, Contractor shall be expected to diligently perform the work needed to complete the Project, without undue delay or interruption.

b. During the course of the Project, Contractor will be required to use Owner’s project management platform, Procore, to communicate, document, and manage matters related to the Project work.

16. Security Clearance and Confidentiality Requirements. No employee, agent or subcontractor of the selected Bidder will be permitted access to designated restricted areas prior https://www.youtube.com/channel/UCmREyet73vxhBFCffWClEKA https://adacounty.id.gov/SmallConstructionTC

BID 26035 INSTRUCTIONS TO BIDDERS – PAGE 10

to: (1) obtaining security clearance from the appropriate County agency, and (2) returning signed copies of the confidentiality agreements and acknowledgements provided by the County, as may be required by Owner. Owner reserves the right to change the restricted areas as needed.

Security clearance requires passing a background check that includes fingerprinting. Ada

County may, in its sole discretion, refuse to allow an employee, agent or subcontractor access to a restricted area. The following reasons are examples of possible reasons for security clearance denial:

a. Felony convictions and some misdemeanor convictions (depending on particular charges and circumstances);

b. Connection with current criminal investigation or prosecution;

c. Outstanding warrants (including traffic and parking violations); or

d. Currently on parole or probation.

Ada County Operations will provide the successful Bidder with all forms and instructions needed for security clearance checks, and Owner will not charge Bidder, its employees, agents or subcontractors for background checks or fingerprinting.
