About this file

This is a Conformance Statements attachment for Pinal County, Arizona's on-call traffic engineering services solicitation (Contract #262931SOQ). The document requires responders to indicate their acceptance or exceptions to the County's Scope of Work, Terms and Conditions, and any proposed supplemental agreements. Responders must clearly mark YES or NO to confirm compliance with the Scope of Work and Terms and Conditions. Those taking exceptions must identify the specific section, paragraph referenced, propose alternate language, and provide rationale for each proposed change. Responders selecting NO must revise Attachment A (Scope of Work) and Attachment C (Draft Contract) with tracked changes and submit these revised documents with their proposal. The document also requires responders to declare whether they are proposing any supplemental agreements, such as End User License Agreements or Lease Agreements, and if so, must provide a Word version that does not conflict with or duplicate existing terms in the Scope of Work or Draft Contract.

The document emphasizes that any exceptions not included in the conformance statement will be without force and effect in any resulting contract unless specifically accepted in writing by the Procurement Officer. The County explicitly states that responder's preprinted or standard terms will not be considered as part of any resulting contract. The document warns that taking exceptions may negatively impact proposal evaluation and that proposals taking exception to any solicitation requirement may be rejected. The conformance statement must be signed by the responder's authorized representative before submission with the proposal offer documents.
