About this file
This is an Informal Bid Request (ITB) document issued by the City of Sioux Falls, South Dakota, for the procurement of chlorine for water treatment purposes under Request No. 26-0012. The City of Sioux Falls seeks qualified suppliers to provide chlorine supplies through a contract effective from the award date through December 31, 2026, with four optional one-year renewal periods available thereafter. Bidders must submit responses through the City's e-procurement portal at siouxfalls.bonfirehub.com, and all bids must include unit prices and proposed delivery times in days, including weekends and holidays. The solicitation requires bidders to provide complete product literature and brand names for proposed items, with specifications representing minimum standards that all delivered materials must meet or exceed. Award decisions will be made within 45 days of bid opening to the lowest total responsive and responsible bidder, and bid results will be publicly available on the e-procurement portal and at siouxfalls.gov.
All pricing must be submitted on an FOB destination basis to Sioux Falls, South Dakota, with no sales tax included in bids, as the City is exempt from such taxes. However, use and excise taxes applicable to the contract are the bidder's responsibility and must be included in the bid price. Unit prices awarded shall remain firm for the entire contract period. South Dakota has a local preference provision that favors materials, products, and supplies produced within the state, and South Dakota bidders receive preference equal to preferences enforced by other states. If federal funds are involved, awards must be made to the lowest responsive and responsible bidder without regard to state preferences. Invoices should be submitted to financeap@siouxfalls.gov, and payment will be processed upon receipt and acceptance of deliveries. The contract includes provisions allowing the City to request price increases or decreases based on manufacturer cost changes or market conditions after 90 days of contract effectiveness, with tariff-related increases permitted at any time with appropriate documentation. No bid guaranty is required, and the City reserves the right to reject any or all bids and to order quantities greater or less than the estimated amounts based on actual needs.

This evidence must be presented to the City Finance office, and if approved, the new pricing will become effective after the date of approval of the extension. Price increases will be allowed for the actual cost of the price increase from the manufacturer to the supplier only and must be presented as a percentage of increase, which will be used to adjust vendor pricing to the City. The City may request a price decrease if it determines market conditions have changed to benefit the City. If an agreement cannot be reached by the vendor and the City on escalation or de-escalation, the City reserves the right to terminate the contract.
e. Price increases will not be considered until the contract has been in effect for 90 days. Price increases will only be allowed for the actual cost of the price increase from the manufacturer to the supplier.
Price increases due to tariffs may be requested at any time after the contract is in effect. 1. Official government notice or publication imposing the tariff.
2. Customs documentation or duty payment receipts reflecting the tariff.

S:\AS\Pur\2026\22- Water Pur\26-0012 Water Treatment Chemicals\26-0012 ITB.docx 6
The request and documentation must be presented to the City Finance office, and if approved, the increase will become effective after the date of approval, unless otherwise stated. Price increases may be presented as a fixed dollar amount or percentage of increase, which will be used to adjust vendor pricing to the City. No price increase will be permitted to increase the vendor’s profit.
A price increase due to tariffs will end if the tariff is reduced or terminated. For changing market conditions, the City may request a price decrease if it determines that market conditions have changed to benefit the City. If an agreement cannot be reached by the vendor and the City on an increase or decrease, the City reserves the right to terminate the contract.
