About this file

This is a Technical Specifications document for the Maryland Environmental Service (MES) detailing a dredging and dewatering project at the Cox Creek Dredged Material Containment Facility (DMCF) in Anne Arundel County, Maryland, located on the Patapsco River. The project seeks to recover approximately 50,000 cubic yards of sediment from the Cox Creek DMCF waterside cell through hydraulic dredging and dewatering operations. The contractor must provide all labor, materials, equipment, and services necessary to complete dredging, debris handling, dewatering, stockpiling, and material management within the designated staging area. Key contract pay items include mobilization and demobilization (Item 101), staging area preparation (Item 102), dredging/capacity recovery (Items 103 and 201), dewatering (Items 104 and 202), and contingent harmful algal bloom decontamination (Item 203). The project requires submission of a comprehensive Dredging and Dewatering Plan at least 30 calendar days prior to work commencement, contractor organizational documentation seven calendar days before the pre-construction meeting, and daily activity reports. The contractor must attend weekly progress meetings and maintain updated project schedules with two-week look-ahead forecasts.

Payment for unit price items such as dredging and dewatering will be based on actual in-place cubic yards of material as measured by topographic surveys conducted by the Service, with progress payments made monthly subject to a 5% retainage. Mobilization and demobilization costs cannot exceed 20% of other base bid items, with 60% payment upon physical site occupation and approval of schedules and 40% upon final demobilization. The contractor must comply with all applicable permits and the Cox Creek DMCF Standards and Procedures for Placement of Dredged Material (August 2023), including dewatering to meet the Paint Filter Liquids Test. All dredged materials must be dewatered using only ANIONIC additives, polymers, or coagulants from an approved Maryland Department of the Environment list. The contractor is responsible for all equipment cleaning prior to mobilization, pipeline installation and maintenance, water management systems, and final site cleanup and restoration. Final payment occurs only after completion of all punch-list items and issuance of a Certificate of Substantial Completion by the Service.

A. The Contractor must provide the Service with all submittals required for review as described in these Technical Specifications. Submittals must be provided promptly and in an orderly sequence to not cause a delay to the Work. Failure to submit a submittal in ample time is not considered sufficient reason for extension of Contract duration, and no claim for extension by reason of such default will be allowed.

B. The Service may request submittals in addition to those listed in Table A when deemed necessary to adequately describe or modify the Work covered in the Contract Documents. The Contractor must provide these requested submittals at no additional cost to the Service.

C. The Contractor must develop and maintain a submittal tracking register that includes, at a minimum, a complete listing of all required submittals (see Table A), including the subject matter of each submittal (submittal name), the corresponding Technical Specification name and number(s), preparer, applicable unique tracking numbers, planned dates of submittal submissions, the actual date of submissions with listing of subsequent resubmissions, and the Service’s approval action. The submittal tracking register must list submittal dates for Shop Drawings, product data, and samples, and must indicate the dates by which the Service’s review will be required. 5. Apply the Contractor’s certification, signed or initialed, certifying that review, approval, verification of product selections and designations, compatibility with field conditions and dimensions, adjacent construction work, and coordination of information is in accordance with requirements of the Contract Drawings and Technical Specifications. If a submittal requires an engineer’s stamp, the Contractor must ensure that the submittal has been prepared and signed by an engineer licensed to practice in the State of Maryland. The Contractor must verify compatibility of submittal with requirements of the Contact Drawings and Technical Specifications and must return non-conforming submittals to prepare for revision rather than submitting for review by the Service. Incomplete or improperly packaged submittals and submittals from sources other than the Contractor will not be accepted for review by the Service.

6. Coordinate submission of related items and group submittals of related products in a single transmission. Coordinate submittals to avoid conflicts between various items of the Work and provide submittals to not interfere with Project Construction Schedule.

7. Include all submittal material requested for each Technical Specification.

8. Clearly identify variations from requirements of Contract Drawings and Technical Specifications in all submittals. Failure to identify variations from the Contract Drawings and Technical Specifications does not relieve the Contractor of responsibilities to comply with Technical Specifications and Contract Drawings and will result in the submittal being marked “Revise and Resubmit.”

9. Clearly identify any proposed substitutions for materials or modifications to the procedures specified in the Contract Drawings and Technical Specifications in each submittal. State product or system limitations that may be detrimental to successful performance of completed Work. Failure to do so will result in the submittal being marked “Revise and Resubmit.”

10. Mark or show dimensions and values in same units as specified.

11. Submittals requiring the Service’s acceptance must be scheduled and accepted prior to acquisition of the material or equipment covered thereby

Cox Creek DMCF Capacity Recovery November 2025 Page 4 of 9 MES Project ID No. 1-26-5-18-8 and before any Work described is initiated. The Contractor must begin no fabrication or Work requiring the submittals until return of the submittals with the Service’s approval/comments. No delays, damages, or time extensions will be allowed for time lost in late submittals.

E. The Service may elect to stop Work activities at the Site in the event that submittals have not been submitted or are not of acceptable quality (as determined by the Service) and per the schedules specified herein. Any delays related to submittal approvals must not allow the Project Construction Schedule to be extended and must not be reason to increase the Contract price.

F. For Work that does not have a submittal specified in the Contract Drawings and Technical Specifications, the Contractor must document any proposed variation from the Contract Drawings and Technical Specifications in the form of a submittal consistent with this Technical Specification. Such submittal must be submitted to the Service for review at least 14 calendar days prior to the planned start date of the activity affected by the proposed variation.

G. The Contractor must adhere to approved submittals; deviation from the approved submittals must be pre-approved by the Service in writing.

H. Transmittal: Where possible, transmit all submittals via electronic mail.

1.05 SUBMITTAL REVIEWS

A. Reviews performed by the Service will only be for compliance with the design concept of the project and for compliance with the information given in the Contract Drawings and Technical Specifications, not extending to means, methods, techniques, sequences, or procedures of construction (except where a specific means, method, technique, sequence, or procedure of construction is indicated in or required by the Contract Drawings and Technical Specifications), and not extending to standards, codes, or regulations or to safety precautions or programs incident thereto. Approval of submittal by the Service does not relieve the Contractor of responsibility for correcting errors that may exist in a submittal or from meeting the requirements of the Contract Drawings and Technical Specifications.

B. The Service reserves the right to approve individual sections, attachments, appendices of comprehensive Work Plans as detailed in this Technical Specification if the Contractor elects to combine submittals into referenced Work Plans.

C. Review time: The Service will have at least twenty-one (21) calendar days for initial review of each submittal, not including delivery time to and from the Contractor.

D. The Service reserves the right to withhold action on a submittal that requires review of related submittals before the submittal can be approved until related

Cox Creek DMCF Capacity Recovery November 2025 Page 5 of 9 MES Project ID No. 1-26-5-18-8 submittals are received. Additional time will be required if processing must be delayed allowing for review of related subsequent submittals.

E. Review actions: After review, the Service will return submittals marked as follows to indicate action taken:

1. No Exceptions Taken: Work covered by submittal may proceed provided it complies with requirements of the Contract Drawings and Technical Specifications. Final acceptance will depend upon that compliance.

2. Exceptions as Noted: Part of Work covered by submittal may proceed provided it complies with notations and corrections on submittal and requirements of Contract Drawings and Technical Specifications. Final acceptance will depend upon that compliance.

3. Revise and Resubmit: Do not proceed with part of Work covered by submittal including purchasing, fabricating, and delivering. Revise or prepare new submittal in accordance with notations and resubmit.

4. Incomplete, submit missing information: Do not proceed with the part of Work covered by the submittal, including purchasing, fabricating, and delivering. Submit the required missing information.

F. Resubmission

1. When revised for resubmission, changes made since previous submission must be submitted in redline/strikeout and/or other means to track changes made to the previous submittal, unless otherwise approved by the Service in writing.

2. Resubmissions must be required within seven (7) calendar days of return from the Service review unless otherwise approved by the Service in writing.

3. Revised submittals must be submitted following the procedures specified for initial submittals.

4. Resubmittals must include the original tracking number with a letter designation such as “A” for the first resubmittal or “B” for the second resubmittal, and so on.

5. Resubmittals are required until all comments by the Service are addressed.

All changes made in the resubmittal must be documented and must also indicate any changes made other than those requested by the Service.

6. Review time: The Service will have at least twenty-one (21) calendar days for resubmission review of each submittal, not including delivery time to and from the Contractor.

Cox Creek DMCF Capacity Recovery November 2025 Page 6 of 9 MES Project ID No. 1-26-5-18-8

7. Final approved submittals must be provided without redline/strikeout.

G. The Contractor must distribute copies of reviewed submittals, as appropriate, and must instruct parties to promptly report their inability to comply with the requirements. Deviations from approved submittals must be pre-approved by the Service in writing. After submittals have been approved by the Service, no resubmittal for the purpose of substituting materials or equipment will be given consideration unless accompanied by a written explanation from the Contractor regarding why a substitution is necessary.

H. The Contractor must store hard copies of submittals that have been accepted by the Service in the onsite file and make accessible to the Service.

I. Submittals processed by the Service do not become Contract Drawings and Technical Specifications and are not to be considered Change Orders; the purpose of a submittal review is to establish a reporting procedure and is intended for the Contractor’s convenience in organizing the Work and to permit the Service to monitor the Contractor’s progress and understanding of the design. Review, acceptance, or approval of submittals must not add to the Contract amount, and additional costs that may result must be solely the obligation of the Contractor.
