About this file
This Special Provisions document outlines the contractual requirements and conditions for the Cox Creek Dredged Material Containment Facility (DMCF) Capacity Recovery Project in Maryland, establishing protocols for a contractor to recover approximately 50,000 cubic yards of dredged material. The project is administered by Maryland Environmental Service (MES) with permits obtained by the agency, including State Discharge Permit Number 13-DP-3424A, MDE Dam Safety Permit Number 20-OB-0132, and associated water appropriation permits. The contractor must comply with all federal, state, and local laws, including OSHA standards, and assume responsibility for all additional permits, licenses, and approvals beyond those obtained by MES. Critical operational requirements include designating a single point of contact responsible for all job-related communications who must remain on-site or readily available throughout the project; submitting weekly color photographs or video footage at minimum 2240 x 1500 pixel resolution with at least ten images per week; maintaining dust control through approved methods; notifying Miss Utility prior to commencement and every two weeks during construction; and adhering to comprehensive health, safety, and environmental protocols outlined in mandatory written plans.
The contractor bears full responsibility for site preparation, facility management, and operational costs, including providing temporary sanitary facilities compliant with Maryland Department of Health and OSHA standards, establishing independent water supply arrangements, securing private parking areas, and maintaining all work areas in clean condition. Health and Safety documentation, Fuel Spill Prevention and Containment Plans, and environmental awareness training must be submitted within fourteen calendar days of Notice of Intent to Award. The contract specifies liquidated damages of $3,000 per calendar day for failure to complete work by the contract completion date, and the contractor must immediately report any Maryland Department of the Environment violations, accidents, spills, or discovery of historical artifacts to MES. The contract includes provisions for differing site conditions, requiring contractors to notify MES within twenty-four hours with photographic evidence and geotechnical studies demonstrating variance from contract specifications, and establishes protocols for monitoring and decontaminating equipment in the event of Harmful Algal Blooms.
