About this file

This is Addendum No. 1 to a solicitation issued by the Maryland Environmental Service for the supply and hauling of fill material to the Masonville Dredged Material Containment Facility (MES Project ID No: 1-26-5-03-5). The project involves providing fill material and transportation services to the containment facility, with bids due on September 11, 2025 at 1:00 PM. The addendum addresses questions from potential bidders and becomes part of the contract documents that will form the basis of the final contract.

The project includes a 25% Minority Business Enterprise (MBE) participation requirement. The addendum clarifies that failure to submit a signed MBE Attachment A form will render bids non-responsive, and bidders who cannot meet the MBE goal must follow specific waiver guidance procedures including submitting Good Faith Effort Documentation. Importantly, the addendum specifies that a bidder's ability to self-perform all contract aspects is not considered a valid reason for requesting an MBE participation waiver, addressing concerns from contractors with large fleets wanting to handle the work with their own forces and equipment.

ITEM 1: QUESTIONS FROM POTENTIAL BIDDERS

Q1: We are not an MBE business. We have a large fleet and would want to self perform and self supply with, and through, our own forces. Will this cause our bid to be reject or be in non-compliance?

A1: Failure to submit a signed MBE Attachment A form will render the bid non-responsive.

Bidders should follow the Waiver Guidance (MBE Attachment E) to meet the MBE goal. If, after following the guidance and the bidder is still unable to meet the goal, they must request an MBE participation waiver and submit the Good Faith Effort Documentation (MBE Attachment F).
