The form allows bidders to assert claims of business confidentiality for specific information submitted as part of their proposal in accordance with Utah Code Annotated Subsections 63G-2-305(1) and (2) and Section 63G-2-309. Bidders may claim confidentiality protection for non-public financial statements, specific employee names and contact information, customer information, client lists, subscription lists, or other specified proprietary information. The form requires bidders to identify the specific pages, paragraphs, and reasons for confidentiality claims and demonstrate that the information qualifies as trade secrets or commercial information that could result in unfair competitive injury if disclosed.
The form explicitly states that pricing and cost proposals may not be classified as confidential or protected and will be considered public information. Additionally, an entire proposal cannot be identified as "Protected," "Confidential," or "Proprietary." Bidders will be notified if any record claimed to be protected is classified as public or if the governmental entity determines the record should be released after weighing competing interests under applicable Utah Code sections. The document is dated with a revision date of June 4, 2015, and requires the bidder's company name, signature, and submission date to validate the confidentiality claim.
