About this file
This document is a Justification for Other Than Full and Open Competition for a lease renewal by the U.S. General Services Administration (GSA) for the Bureau of Indian Affairs. The GSA is seeking to negotiate a succeeding lease for 1,990 rentable square feet (RSF) of office space located at Shawano WI Sterling Plaza, 1415 E Green Bay St, Shawano, WI, under lease number LW119282, with a current lease expiration of 11/30/2025. The proposed 10-year, 5-year firm term lease is set to commence on 12/01/2025. Market research conducted by PBS in Shawano, WI showed rental rates within the delineated area, and the lease is being renewed with the incumbent lessor without full and open competition due to cost-effectiveness and minimal relocation disruption. The GSA conducted market research using CoStar and posted an advertisement on SAM.gov, with no other interested parties expressing interest beyond the incumbent lessor.
The lease is specifically for the Bureau of Indian Affairs to provide services effectively in a rural area, with the delineated area bounded by Shawano Lake Outlet (River), Airport Rd., Wisconsin 29 Trunk Business Highway, WWI Veterans Memorial Highway, and Wolf River Pond. The GSA Lease Contracting Officer certified that the award is in the Government's best interest, noting good past performance from the current lessor, recent carpet replacement, repainting in 2024, and no open fire risk conditions. The proposed rental rates are deemed fair and reasonable based on market research, and the justification follows GSA guidelines for negotiating with the incumbent lessor without full competitive bidding.

8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
Both the GSA LAM and tenant agency report good past performance of current Lessor, noting that the most recent property inspection showed the space to be well maintained and in good condition.
The carpet was recently replaced and the space repainted in 2024 as part of the Lessor’s cyclical carpet/repainting obligations under the Lease. According to the GSA Fire Protection Engineer, who checked the FMA database, there are no open fire risk conditions at this location.
9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUISITION.
The Lease Contracting Officer was contacted by , asking general questions about the procurement, however, she did not represent any buildings and did not express an interest in offering space.
Incumbent Lessor.
10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME
ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.
There are no systemic barriers to competition. If the agency has a continuing need for space upon lease expiration, GSA will follow all authorities, regulations and policies applicable to lease acquisition. Should there be remaining useful life in the Government’s tenant improvements, the Government will consider the cost of moving from the existing location, and the cost to build out new space when deciding whether to undergo a competitive action.
Additionally, objective scrutiny will be given to the customer agency’s mission and security requirements (if applicable) to eliminate unnecessary agency space requirements that may be deemed unduly restrictive.
11. CONTRACTING OFFICER CERTIFICATION.
By signature on this Justification for Other than Full and Open Competition, the GSA Lease Contracting Officer certifies that the award of a succeeding lease of 1,990 RSF is in the Government’s best interest and that this Justification is accurate and complete to the best of the GSA Lease Contracting Officer’s knowledge and belief.
