About this file

This document is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise (IEE) Representation Form, designed to certify that an offeror meets the definition of an "Indian Economic Enterprise" for federal contract opportunities. The form requires the offeror to self-certify their eligibility under the Buy Indian Act across three key time periods: at the time of offer submission, at contract award, and throughout the entire contract performance period. If an enterprise no longer meets the eligibility requirements at any point, they must immediately notify the Contracting Officer.

The form emphasizes strict compliance requirements, including mandatory registration in the System of Award Management (SAM) and warnings about potential legal consequences for false representations. Offerors must specify whether they meet the "Indian Economic Enterprise" definition, provide details about the 51% owner, the federally recognized tribal entity, business name, and DUNS number. Any false or misleading information submitted can result in violations punishable under 18 U.S.C. 1001 and 31 U.S.C. 3729-3731, with potential penalties for contract performance-related false claims.
