About this file
This is a Notice of Intent to Purchase a Proprietary Product or Service issued by the Executive Office of Education on behalf of the Massachusetts Department of Elementary and Secondary Education. The document announces the Commonwealth's intent to extend its contract with LiteracyPro Systems, Inc., a proprietary platform that has supported the state's adult education system since 2018. The LiteracyPro system provides data collection and reporting capabilities, security and accessibility compliance, oversight and risk assessment functions, and enhanced digital experiences for nearly 100 adult education sites across Massachusetts. The system addresses Workforce Innovation and Opportunity Act requirements at both the local sub-grantee and state grantee levels. Interested vendors must submit responses by 1:00 PM Eastern Standard Time on September 30, 2026, demonstrating their qualification and ability to provide the same proprietary product or service. All responses must be submitted online through the COMMBUYS platform and must include cost projections for the entire five-year extension period.
The Commonwealth has invested over $2,500,000 in the LiteracyPro system since 2018 for implementation, customization, and annual maintenance and support. The original RFR 18ESEEK1 contract established a maximum nine-year term; this Due Diligence Posting seeks to extend the contracting relationship for an additional five years focused on maintenance, support, necessary upgrades, and enhancements. Bidders must submit cost responses identifying all expenses for the next five years, with annual price increases not to exceed 3 percent. The Department is utilizing this posting process to ensure an open, fair, and competitive procurement while leveraging the significant Commonwealth investment, LiteracyPro's proven performance and market leadership position, and the mission-critical nature of the system. Standard forms, terms, conditions, and certifications required for doing business with the Commonwealth must be completed and submitted upon award.

Due Diligence Posting of Notice of Intent to Purchase a Proprietary Product or Service
The Executive Office of Education, (“EOE” or “Department”) of the Commonwealth of Massachusetts, on behalf of the Department Elementary and Secondary Education (“DESE”), announces its intent to Purchase a Proprietary Product or Service pursuant to the Commonwealth’s Due Diligence Posting policy, to contract for the following with LiteracyPro Systems, Inc., (“LiteracyPro” or “Offeror”), pending the results of this Notice of Intent (“Notice”):
Description
Pursuant RFR 18ESEEK1 (https://www.commbuys.com/bso/external/bidDetail.sda?docId=BD- 18-1036-EDU02-EDU02-23167&external=true&parentUrl=bid ), EOE has been contracting with LiteracyPro Systems, Inc. since 2018, with an investment of over $2,500,000 in costs for implementation, customization, and annual maintenance and support.
LiteracyPro has supported the Massachusetts adult education system and its network of nearly 100 sites ensuring that the state can meet its oversight and monitoring of federally funded grantees, improving data quality and collection with a state-of the-art user interface. The system:
• Meets data collection and reporting requirements;
• Meets security and accessibility requirements;
• Improves oversight and risk assessment and mitigation;
• Provides data to providers and the Commonwealth for evidence-based decision-making;
• Improves constituent-facing digital experience (e.g. intuitive interface, streamlined data entry, full accessibility); and
• Increases local provider management capacity (e.g. supporting staff professional development, improved class scheduling, more precise enrollment records).
Through addressing the requirements of the Workforce Innovation and Opportunity Act (current and future modifications of NRS requirements). This includes data collection at the local (sub-grantee) level and state (grantee) oversight and desk review monitoring for performance and compliance.
The maximum term of the contract resulting from the RFR was identified as nine years. Due to the robust competition under RFR 18ESEEK1, LiteracyPro’s position as a market leader, its highly satisfactory contract performance, significant Commonwealth investment, mission critical need, and extensive procurement and project planning cost, timeline, and effort to potentially replace this system, EOE is posting this Due Diligence posting to extend the contracting relationship for maintenance and support, as well as necessary upgrades and enhancements, for an additional five years.

The Department is posting this Notice rather than conducting a full procurement because the Department believes this opportunity represents best value to the Commonwealth and is utilizing this Due Diligence Posting to ensure that the process is open, fair and competitive.
Determination of Other Interested Vendors The intent of this posting is to determine if there are any other interested and qualified vendors.
Any such vendors must submit documentation that they can also provide the same proprietary product or service.
Response Requirement and Deadline All Interested Vendors and Offerors interested in responding to this Notice, regardless of prior communications with the Department, must submit a Response to this posting containing evidence of their qualification and interest. Further, Bidders must submit a cost response which identifies all costs for the next five years. Annual price increases must not exceed 3%. All required information must be submitted by 1:00 PM Eastern Standard Time on September 30, 2026.
If, after the posting deadline has passed, interest is generated by this Notice, the Department will review all Responses and will determine whether they will accept the offer from the Offeror.
