About this file
This is a Request for Proposal (RFP) issued by Fulton County, Georgia for the Fulton County Sheriff's Office seeking qualified contractors to provide delinquent tax sales preparation services. The primary services include type-written title examinations and abstracts covering a fifty-year period in compliance with Georgia Title Standards, along with pre-tax and post-tax sale preparation services. The contractor will be responsible for examining property titles, identifying all interested parties, preparing and mailing statutory notices to owners, lien holders, and other parties with recorded interests, managing legal advertisements, preparing tax sale scripts, and generating surplus fund notices. The volume of work is substantial, with approximately 1,222 parcels processed in FY2025, requiring between 40 to 224 title examinations and abstracts monthly. The RFP was issued on May 14, 2026, with a Pre-Proposal Conference scheduled for May 28, 2026, via Zoom. The proposal submission deadline is June 11, 2026, at 11:00 A.M. through BidNet Direct. The contract term begins upon execution in 2026 and continues through December 31, 2026, with the option for three one-year renewal terms (January 1, 2027 through December 31, 2029) subject to County Board of Commissioners approval.
The cost proposal will be evaluated as 20 percent of the total 100-point scoring rubric, with the lowest cost proposal receiving full points and other proposals scored proportionally. Evaluation criteria also include project plan and approach (25 percent), qualifications of key personnel (15 percent), relevant project experience (18 percent), availability of key personnel (15 percent), local preference (5 percent), and service-disabled veterans preference (2 percent). The County anticipates awarding the contract to the most advantageous proposer based on cost and evaluation factors, not necessarily the lowest bidder. Proposers must demonstrate financial responsibility through recent balance sheets, credit ratings, and sworn bankruptcy statements. The work category is classified as Professional Services with availability targets of 16.83 percent Minority Business Enterprise (MBE) and 3.41 percent Female Business Enterprise (FBE) for subcontracting opportunities. All work must comply with Georgia's Security and Immigration Compliance Act, requiring E-Verify registration and participation. The selected contractor must obtain insurance with specified policy limits and maintain coverage throughout the contract term, including renewals, with proof of insurance required prior to work commencement.

3.3 SCOPE OF WORK
The title examination and abstract will include all necessary documentation that will allow the Sheriff to correctly serve parties with interest in the properties scheduled for levy and sale and for noticing parties who may be entitled to the surplus generated for properties sold at tax sale. Upon request by the Sheriff or his designee, The contractor must provide a type-written title examination and abstract. The title examination and abstract document shall show the ownership interest, liens, security deeds, mortgages and title blemishes found to be of record. Such documentation MUST include, but is not limited to, the following:
A. Legal and vesting document (e.g., Warranty deeds, Executor/Administrator's deeds, Limited Warranty deeds, Quit Claim deeds, Tax deeds, and Release deeds);
B. Security deeds and mortgages;
C. Property liens;
D. Tax liens;
E. Contractor liens;
F. Judgements;
G. Lis Pendens; and H. Leases, UCC's and Ground leases
The title examination and public record search shall include any and all parties with recorded interest as shown by the Fulton County Clerk of Superior Court Records, Fulton County General Execution Docket, Fulton County Lis Pendens Docket, and Fulton County Probate Court records, as well as other records explained below. The Sheriff specifies that in performing examination of title, The contractor shall in all cases attempt to provide a "Warranty" deed as the vesting deed of record for the defendant in Fieri Facias ("FiFa") (January 1st, owner) or delinquent property owner.
A. For each delinquent parcel, The contractor shall prepare a fifty-year typed title examination and abstract by examining Fulton County Clerk of Superior Court Records and other pertinent records to determine the current owner(s), lien holder(s), deed(s) to secure debt and mortgage(s) of record.
B. The contractor shall verify the correct defendant in FiFa for each delinquent year;

C. The typed title examination and abstract shall be delivered to the Sheriff no later than thirty (30) days after the Sheriff orders the title examination;
D. The typed title examination and abstract shall include the dimensions of the subject property (property scheduled for sale) and the current tax map (any variation from the vesting legal and the current tax map must be explained in the typed title examination and abstract);
E. The contractor shall also verify that the delinquent tax parcel matches the legal description of the corresponding deeds or record;
F. A fifty-year title examination and abstract must be performed on all parcels submitted to the Fulton County Sheriff's Office;
G. Parcels that contain ownership and legal description errors, or do not correspond to tax maps, shall be returned to the Sheriff with corrective information.
Scope of Title Examination Pursuant to Georgia Title Standards, Standard 2
Pursuant to Georgia Title Standard 2.1, the title search examination must:
A. Cover a period of not less than 50 years and in compliance with the Georgia Title Standard 2.1
B. Must provide:
A warranty deed; or One or more quitclaim deeds supported by reasonable proof that they convey title; or A grant from the state; or A probate proceeding in which the property is reasonably identifiable, or a security deed if subsequently regularly foreclosed; or Any other instrument which shows of record reasonable probability of title and possession there under; and A copy of lien holders, owners of record, and security deed holders along with their address must accompany the title search on a separate and distinct page.
1 Under Georgia Title Standard 2.1, a record title covering a period of 50 years or more is considered sufficient to determine marketability; provided that the basis thereof is a warranty deed, one or more quitclaim deeds supported by a reasonable proof that they convey the full title, or grant from the state, a probate proceeding in which the property is reasonably identifiable, a security deed if subsequently regularly foreclosed or any other instrument which shows of record reasonable probability of title and possession thereunder; provided further that the period actually searched does not refer to or indicate prior instruments or defects in title, in which case such prior instruments may be used in turn as a start, and that the period actually searched discloses instruments which confirm and carry forward the title to be established.
As a result of the recording process, the effective date of the various indices examined may not coincide with the date the record examination is conducted. The period between the record effective date and the examination date or document filing date of a subsequent transaction is commonly referred to as the "gap period." This gap period varies by county and by indices within a county and in some instances this interim period may be substantial. When examining title and computing dates referred to these Standards, the effect of the gap period must be taken into consideration. The oldest effective date of all record indices examined should be reported as the effective date of the title examination and abstract unless a report of the effective date of such record index is requested by the client or is of particular significance to the transaction upon which the record search will be relied.
Pursuant to Georgia Title Standard 2.5, an examiner should report any and all contracts, options or memorandum of thereof whether or not they appear to have expired. At that point the Fulton County Sheriff's Office should decide whether to reply upon the record or seek additional proof.
Pursuant to Georgia Title Standard 2.6, in determining whether to recommend that a corrective document be filed with respect to an instrument in the chain of title, the examiner should take into consideration, in addition to the other matters treated in the Georgia Title Standards:
1. The period of time the instrument has been of record;
2. Applicable statutes of limitation, whether (subsequent to the recordation for the instrument in question) the property has been conveyed without (as far as the record title shows) correction or objection; and
3. The practical feasibility of obtaining required signatures.
