Summary
This is a Specifications Package for a construction project involving Sarasota County, Florida, and prepared by Cummins Cederberg, Inc., a professional engineering firm. The project consists of maintenance dredging of approximately 77,160 cubic yards over approximately 33,000 linear feet of Phillippi Creek between U.S. 41 and South Beneva Road to restore a permitted design elevation of -4 feet Mean Low Water (MLW) and improve stormwater conveyance and mitigate flooding potential. The work includes mobilization and demobilization, mechanical and/or hydraulic sediment removal, temporary staging area acquisition and construction, retention pond construction, dewatering operations, sealed truck transport of sediment, disposal at County-designated sites (Lorraine Road disposal site or Sarasota County Landfill), dredge material management area (DMMA) preparation on seven County-owned properties, erosion and turbidity control, environmental and wildlife monitoring and reporting, and site restoration. The Contract Documents specify that the bidder's offer shall remain irrevocable for 180 days from bid opening or until the County issues Notice to Proceed, whichever occurs first, and that the County anticipates executing a construction contract for the duration of the project.
The specifications establish comprehensive requirements for dredging operations, environmental protection, surveying and as-built documentation, project signs, maintenance of traffic, and clearing and grubbing activities. Contractor responsibilities include obtaining all necessary permits (NPDES, maintenance of traffic, tree permits) at no cost to the County, coordinating with the United States Coast Guard for navigational requirements, and complying with all federal, state, and local permit conditions issued by the Florida Department of Environmental Protection and U.S. Army Corps of Engineers. Mobilization and demobilization costs are included in a lump sum bid item, with 60 percent payable after commencement of dredging and disposal of a minimum of 200 cubic yards at an approved site, and the remaining 40 percent included in final payment. The specifications include detailed measurement and payment provisions for various dredging components, surveying work (including as-built plans, monumentation, and corner certification), environmental monitoring and compliance, and site restoration, with all work to be performed in accordance with the January 2026 Edition of Florida Department of Transportation Standard Specifications as revised by the specifications package.

(REV 06-06-18) (7-22)
SUBARTICLE 120-1.2 is deleted and the following substituted:
120-1.2 Unidentified Areas of Contamination: When encountering or exposing any abnormal condition indicating the presence of contaminated materials, cease operations immediately in the vicinity and notify the Engineer. The presence of tanks or barrels; discolored earth, metal, wood, ground water, etc.; visible fumes;
abnormal odors; excessively hot earth; smoke; or other conditions that appear abnormal may indicate the presence of contaminated materials and must be treated with extreme caution.
Make every effort to minimize the spread of contamination into uncontaminated areas. Immediately provide for the health and safety of all workers at the job site and make provisions necessary for the health and safety of the public that may be exposed to any potentially hazardous conditions. Ensure provisions adhere to all applicable laws, rules or regulations covering potentially hazardous conditions and will be in a manner commensurate with the gravity of the conditions.
The Engineer will notify the County’s Contamination Assessment Firm for assessment of the site. Provide access to the potentially contaminated area.
Preliminary investigation by the Contamination Assessment Firm will determine the course of action necessary for site security and the steps necessary under applicable laws, rules, and regulations for additional assessment and/or remediation work to resolve the contamination issue.
The Contamination Assessment Firm will delineate the contamination area(s). The Engineer will then notify the Prime Contractor of the findings. If remediation work is necessary, one of the following courses of actions will occur:
(1) The Engineer will offer the Prime Contractor the remediation work as extra work on the contract, provided the Prime Contractor can provide documentation of authorization/certification to perform such work, or
(2) The Engineer will solicit a separate contract with an independent
Contractor to perform such remediation work.
If an outside Contractor is selected to perform any necessary remediation work, that Contractor will delineate any staging or holding area required, and, in cooperation with the Prime Contractor and Engineer, develop a work plan that will provide the outside Contractor’s operations schedule with projected completion dates for the final resolution of the contamination issue. The outside Contractor will maintain jurisdiction over activities inside any outlined contaminated areas and any associated staging holding areas. The outside Contractor will be responsible for the health and safety of workers within the delineated areas. Provide continuous access to these areas for the outside Contractor and representatives of regulatory or enforcement agencies having jurisdiction. Both Contractors will use the schedule as a basis for planning the completion of both work efforts. The Engineer may grant the Contract Time extensions according to the provisions of 8-7.3.2. Cooperate with the outside Contractor to expedite integration of the outside Contractor’s operations into the construction project.
The Prime Contractor is not expected to engage in routine construction activities, such as excavating, grading, or any type of soil manipulation, or any construction processes required if handling of contaminated soil, surface water or ground water is involved. All routine construction activities requiring the handling of contaminated soil, surface water or groundwater will be by the outside Contractor. Adjustments to quantities or to Contract unit prices will be made according to work additions or reductions on the part of the Prime Contractor in accordance with 4-3.
If the Prime Contractor performs any necessary remediation work, the Engineer may grant the Contract Time extensions according to the provisions of 8-
7.3.2 and may make adjustments to quantities or to Contract unit prices according to work additions or reductions on the part of the Prime Contractor in accordance with 4- 3.
The Engineer will direct the Prime Contractor when operations may resume in the affected area.
SUBARTICLE 120-5.4 is deleted and the following substituted:
120-5.4 Disposal Areas: Where the Contract Documents require disposal of excavated materials outside the right-of-way, and the disposal area is not indicated in the Contract Documents, furnish the disposal area without additional compensation.
Provide areas for disposal of dredged materials out of sight of the project and at least 300 feet from the nearest roadway right-of-way line of any State-, County- , or City-maintained Road. If the materials are buried, disregard the 300-foot limitation.
