About this file
This file is a permit application and supporting documentation for the Phillippi Creek Maintenance Dredging Phase II Project submitted by Sarasota County, Florida, with consultation from the Florida Department of Environmental Protection (FDEP) and the U.S. Army Corps of Engineers (USACE). The project consists of maintenance dredging approximately 77,160 cubic yards of material over an estimated 33,500 linear feet within Phillippi Creek between US-41 and South Beneva Road to restore the permitted design elevation of -4 feet mean low water (MLW). The scope of work includes: expanding the dredge footprint along the creek's entirety with a 10-foot offset from existing shoreline, connecting gaps in previously authorized dredging areas, maintenance dredging of three oxbow areas (Mineola Drive, Seclusion Drive, and River Ridge Drive), and removal of an emergent shoal near 2337 River Ridge Drive. The project is intended to restore navigable depths, improve hydraulic capacity for stormwater conveyance, reduce flood risk to adjacent residential communities and public infrastructure, and enhance drainage effectiveness. Dredging will occur east of the US-41 bridge and is proposed to be phased, with dredge material management areas (DMMAs) identified at eight Sarasota County-owned properties for material staging and disposal.
The permit application requests verification of exemption under Chapter 62-330.051, Florida Administrative Code, for maintenance dredging activities in previously dredged portions of a natural water body within drainage rights-of-way. Construction methodology will employ either mechanical or hydraulic dredging performed from shallow-draft barges, with floating turbidity curtains and weighted skirts installed to maintain turbidity levels no more than 29 Nephelometric Turbidity Units (NTUs) above background levels. Dredged material will be dewatered in lined containers or at upland DMMAs with erosion control devices, then disposed of at an approved upland landfill facility. Best management practices will include adherence to standard manatee conditions for in-water work and sea turtle and smalltooth sawfish construction guidelines. The project's phased dredging approach with turbidity monitoring and material management demonstrates compliance with environmental protection standards. A concurrent permit modification request to the USACE includes proposals to add Sarasota County as a co-applicant to existing permits and to expand authorized dredging widths from 30 feet to 50 feet in certain sections to provide consistent channel dimensions throughout the creek system for improved stormwater conveyance and flood mitigation.

RE: Request for a Verification of an Exemption
For the proposed Phillippi Creek Maintenance Dredging Phase II Project in Sarasota
County, Florida
Dear Mr. Schwetje:
On behalf of the applicant, Sarasota County (County), this is to submit an Exemption Verification request to the Florida Department of Environmental Protection (FDEP), requesting verification that the proposed activities are exempt pursuant to Chapter 62-330.051, Florida Administrative
Code (F.A.C.) for the proposed Phillippi Creek Maintenance Dredging Phase II Project within portions of the creek in Sarasota County, Florida, herein referred to as “Project”. A signed
Verification of Exemption form can be found in Attachment A.
The Project site is located within the limits of Phillippi Creek and does not have dedicated parcel numbers associated with it. The following provides a summary of the proposed Project.
Background
Phillippi Creek is a significant waterbody within Sarasota County, bordered by hundreds of residential properties and serving as an important recreational and drainage resource for the surrounding community. The creek supports a variety of recreational uses including fishing, kayaking, canoeing, and boating, while also functioning as a critical conveyance system for stormwater runoff throughout the watershed. Historically, Phillippi Creek was channelized in the
1920’s and has since underwent dredging efforts in the late 1990s and early 2000s to restore navigable depths and improve hydraulic capacity.
Over time, natural processes including sedimentation, shoreline erosion, and stormwater transport have resulted in the gradual accumulation of material within the creek bottom. These processes have reduced channel depths in several areas and limit the overall hydraulic efficiency of the system. As sediment continues to accumulate, portions of the creek have become http://www.cumminscederberg.com/ mailto:SD_ERP_Permit@dep.state.fl.us

CUMMINS CEDERBERG, INC. | Miami | Fort Lauderdale | Jupiter | Sarasota | St. Petersburg | Gainesville | Jacksonville | Tallahassee increasingly shallow, creating restrictions to water movement and reducing the effectiveness of the creek as a drainage conveyance during significant storm events.
Recent bathymetric surveying of Phillippi Creek identified numerous shallow areas and bottlenecks throughout the system. These findings suggest that existing sediment accumulation is restricting drainage capacity and impeding water flow, potentially contributing to upstream flooding. Permitted dredging activities have previously targeted priority shoaling areas within the creek; however, those efforts did not comprehensively address the issue. The proposed maintenance dredging activities herein are intended to restore capacity, enhance drainage effectiveness, and reduce flood risk to adjacent residential communities and public infrastructure.
Recently, permits were secured from the USACE and FDEP by WCIND for authorization to maintenance dredge the existing navigational channel within Phillippi Creek to a depth of -4.0 mean low water (MLW). Additional permits were secured by the County further upstream that authorized maintenance dredging of the creek from bank to bank. An additional shoal area was approved under a USACE modification and FDEP exemption verification. Table 1, in conjunction with Figure 1, outlines the recent permit efforts for Phase I of the project.

Due to ongoing stormwater conveyance and flooding concerns, the County would like to: (1) expand the dredge footprint along the entirety of the Project length, (2) connect gaps of previously authorized areas, (3) include maintenance dredging of three oxbows, and (4) remove an area of accumulated sediment (i.e., emergent shoal). Cummins Cederberg, Inc. (Cummins Cederberg) and Sarasota County held a pre-application meeting on January 12, 2026 with the FDEP to discuss Phase II of the Phillippi Creek dredging efforts (limited to Items #1 - #3 above). CUMMINS CEDERBERG, INC. | Miami | Fort Lauderdale | Jupiter | Sarasota | St. Petersburg | Gainesville | Jacksonville | Tallahassee summary is included as Attachment B. Since the pre-app meeting, the County has revised the dredging width and added Item #4 above; the final proposed scope of work is detailed below.
Proposed Scope of Work
The County proposes to expand the previously approved dredging activities to include the submerged bottom of the creek within a 10-foot offset from the existing shoreline and adjacent structures to improve drainage and reduce flooding within this portion of Sarasota County. The originally approved scope (i.e., Phase I) targeted isolated high spot areas throughout the creek;
this additional scope would include the gaps and previously untouched segments to provide a more continuous and efficient creek channel for stormwater conveyance and adequate drainage capacity. All proposed dredging will occur east of the US-41 bridge.
The County also seeks authorization to maintenance dredge three oxbow areas located along the creek at Mineola Drive, Seclusion Drive, and River Ridge Drive. Each oxbow was dredged from the uplands prior to 1970 (as shown in the pre-app PPT) and is proposed to be returned to historically authorized design width and elevations to match the rest of the creek and restore conveyance capacity and improve hydraulic connectivity within the system. Dredging at each oxbow is proposed as follows:
• Mineola Drive oxbow - approximately 6,031 CY of material to -4.0’ MLW
• Seclusion Drive oxbow - approximately 7,933 CY of material to -4.0’ MLW
• River Ridge Drive oxbow - approximately 16,918 CY of material to -4.0’ MLW
Lastly, numerous emergent shoals have established themselves along the creek shorelines waterward of existing seawalls since the original channelization. This County would like to remove the accumulated sediment from an emergent shoal located near 2337 River Ridge Drive to restore adequate creek width for vessel traffic and adequate drainage. Attachment C provided the plat book page of the shoal to be removed. The plat book depicts a creek width of 150 LF from seawall to shoreline of the platted properties. Removing this emergent shoal would involve maintenance dredging approximately 5,477 CY of material.
In total approximately 77,160 CY of material will be dredged from Phillippi Creek. The Project drawings (Attachment D) depict the proposed plan and provide more detail. The proposed project will occur within all areas of the approved authorizations plus additional portions of the Creek
(Figure 2).

Avoidance and Minimization
The creek is generally devoid of significant resources to the east of US-41 bridge where dredging will take place. As the proposed Project is anticipated to meet exemption criteria, any impacts resulting from the activities are considered to be de minimis.
Construction Methodology
Construction methodology and best management practices (BMPs) will be conducted pursuant to permit requirements. A Dredge Methodology and Material Management Plan, inclusive of identified Dredge Material Management Areas (DMMAs), is included as Attachment E)

Best management practices will be implemented throughout construction, including installation of floating turbidity curtains and adherence to the current “Standard Manatee Conditions for In-Water
Work” and the “Sea Turtle and Smalltooth Sawfish Construction Guidelines.”
All construction activities will be completed from a shallow draft barge, with specific methodology determined by the selected contractor. Dredging will be phased. Turbidity curtains will be installed prior to commencement of dredging activities in each dredging zone/phase and will remain in place until all dredging is completed and turbidity levels have returned to background levels.
Turbidity will be monitored as directed by the approved environmental permits. Material management will occur in lined containers on the barge or at an upland material management site with erosion control devices. Once dry, dredge material will be hauled away and disposed of at an approved upland landfill facility.
Thank you for your review of this request for the proposed Phillippi Creek Maintenance Phase II
Dredging Project. The processing fee will be paid under separate cover. An application is being submitted concurrently to the U.S. Army Corps of Engineers (USACE) for federal authorization of the Project. Form 62-330.050(1) – Request for Verification of Exemption Incorporated by reference in subsection 62-330.050(2), F.A.C. (effective date: December 22, 2020) Page 1 of 6
Request for Verification of an Exemption
Instructions: This form is used to request verification whether an activity qualifies for an exemption from the Environmental Resource Permit (ERP) requirements of Sections 373.406 or 403.813(1) of the Florida Statutes (F.S.) and Rule 62-330.051 of the Florida Administrative Code (F.A.C.); and from the State 404 Program requirements of Rule 62-331, F.A.C. Alternatively, you can use the on-line self-certification site of the applicable Agency for activities that qualify for a self-certification (see below).
Notice is not required to conduct most exempt activities However, verification of such qualification is helpful for the following reasons:
• Certain projects in retained waters may qualify for the State Programmatic General Permit (SPGP).
If the project qualifies for and receives SPGP authorization, you do not need to apply separately to the Corps; and
• To provide assurance to persons who are unsure whether the requested work qualifies for an exemption. If it does not, the information provided will expedite the process of applying for the applicable ERP and/or State 404 Program permit.
Prior notice to the Agency is required before conducting one or more of the following:
• Activities having minimal impact under Section 373.406(6), F.S., often referred to as a “de minimis” exemption.
• Maintenance dredging under Section 403.813(1)(f), F.S., and paragraph 62-330.050(7)(a), F.A.C., when the dredging is within previously dredged portions of natural water bodies within drainage rights-of-way or drainage easements which have been recorded in the public records of the county.
• The repair, stabilization, or paving of existing county-maintained roads and the repair or replacement of bridges that are part of the roadway under Section 403.813(1)(t), F.S., and paragraph 62-330.050(4)(e), F.A.C.
• Removal by an individual, residential property owner of organic detrital material from freshwater rivers or lakes that have a natural sand or rocky substrate and that are not located in an Aquatic Preserve under Section 403.813(1)(u), F.S., and paragraph 62-330.050(3)(b), F.A.C.
• Maintenance dredging at seaports under Section 403.813(3), F.S., and paragraph 62- 330.050(7)(g), F.A.C.
• Minor silvicultural surface water management systems under Rule 62-330.0511, F.A.C. (Note—do not use THIS form for that notice; instead use the procedures in Rule 62-330.0511, F.A.C.)
• Dry borrow pits of less than five acres located entirely in uplands in accordance with subsection 62-330.051(16), F.A.C.
Exempt activities on state-owned submerged lands (SSL), other than those excepted in paragraph 18- 21.0051(1)(a), F.A.C., must also be authorized by the Board of Trustees of the Internal Improvement Trust Fund (BOT). Authorization to use SSL is not linked with regulatory exemptions; therefore, it is possible to qualify for a regulatory exemption, yet not be authorized to conduct the activity until the separate SSL authorization is granted. If an activity may be located in, on, or over SSL, we recommend completing Section F of the Environmental Resource Permit Application form.
Requests to “self-certify” a private, single-family dock or a boat lift associated with such a dock must be submitted to the Department’s Internet site at: http://www.fldepportal.com/go/ and CANNOT be made using this form. However, requests to verify construction of a dock or boat lift that does not qualify for self-certification may be made using this form.
Any submittal requesting verification of an exemption must also include:
• Location map(s) of sufficient detail to allow someone who is unfamiliar with the site to travel to and locate the specific site of the activity.
• One set of plans and drawings, calculations, environmental information, and other supporting documents that clearly and legibly depict and describe the proposed activities in sufficient detail to demonstrate that the work qualifies for the exemption.
• The required fee.

2 PROJECT DESCRIPTION
Residents along Phillippi Creek have experienced excessive flooding during recent storm events that can likely be attributed to the accumulation of sediment within the creek, reducing the capacity for stormwater conveyance associated with upstream portions of the creek. As such, the proposed
Project includes maintenance dredging Phillippi Creek to a depth of -4.0’ Mean Low Water (MLW) with a 10-foot offset from the existing shoreline. Additional maintenance dredging is proposed to restore three creek-adjacent oxbows and to remove one emergent shoal area along the shoreline.
A total of 77,160 cubic yards of material will be removed, in accordance with the Project drawings.
Bathymetric surveys and geotechnical borings were conducted throughout the proposed Project area to determine the grain size data and sediment chemical composition for disposal.

3 CONSTRUCTION AND DREDGE METHODOLOGY
Dredging activities will be performed using either mechanical or hydraulic dredging methods, as selected by the contractor and depending on site-specific conditions and accessibility. Mechanical dredging may involve the use of a shallow draft barge-mounted clamshell or bucket or upland-based excavator, maintaining a minimum 1-foot clearance from the creek bottom. If hydraulic dredging is employed, cutterhead dredges with associated pipeline, and similar equipment may be utilized. The selected dredging method and equipment will be subject to regulatory compliance and approved prior to mobilization.
If contamination is present, extra caution will be taken when removing contaminated sediments.
If mechanical dredging is used for contaminated sediment removal, a clamshell bucket, mounted on a shallow draft barge or land-based excavator will be employed to carefully remove sediments with minimal resuspension. Contaminated dredged material will be carefully placed into sealed, lined containers or watertight barges for temporary storage and transport. These containers will be staged in the designated upland area for dewatering if necessary, and disposal at an approved facility in accordance with all applicable environmental regulations. If hydraulic dredging is used for contaminated sediments, the material will be pumped to an upland containment area, where it will be placed in either geotextile dewatering tubes or within a lined dewatering basin (e.g., HDPE-lined cell). The containment system will be designed to facilitate drying and prevent discharge of any untreated return water. All handling, storage, and transport of contaminated material will follow best management practices (BMPs) to avoid spills and cross-contamination.
If hydraulic dredging methodology is selected for non-contaminated sediments, flocculants may be introduced to promote the aggregation of fine particles. The slurry will then be pumped to dewatering areas where solids will settle or be filtered out. The resulting effluent will be sampled and analyzed to confirm the absence of contaminants before any discharge into tidal waters.
All return water (decant water) from dewatering operations will be collected, treated onsite as necessary, and tested for compliance with applicable discharge standards (e.g., Florida Surface
Water Quality Criteria) before being discharged into tidal waters or municipal stormwater systems, if permitted.
All handling, dewatering, and disposal of contaminated material will follow BMPs and be conducted in accordance with applicable FDEP and local regulations. Final disposal of dewatered sediments will occur at a permitted upland disposal facility approved for contaminated or special waste, depending on analytical results.
The selected contractor will determine the dredged material management methodology based on site-specific conditions, regulatory requirements, and operational logistics. The selected method will be pre-approved by the project engineer and comply with permit conditions. All material will be transported for final disposal at an approved upland landfill.

4 TURBIDITY CONTROL AND MONITORING
Standard floating turbidity curtains with weighted skirts extending to within one foot of the bottom will be installed around the dredge area (Figure 1). These curtains will be continuously maintained and will remain in place for the duration of in-water work to ensure turbidity remains contained within the project footprint. Best management practices for turbidity and erosion control will be utilized during all dredging and material management activities to prevent turbidity more than 29
Nephelometric Turbidity Units (NTUs) above background levels beyond the turbidity curtain.
Turbidity monitoring will be established as directed by approved environmental permits.

1. Purpose
The purpose of the meeting was to discuss, with the Florida Department of Environmental
Protection (FDEP), the proposed maintenance dredging, channel widening, and oxbow restoration activities along Phillippi Creek in Sarasota County, Florida (Project). This meeting was meant to identify potential concerns and permitting restrictions that FDEP may have relative to the proposed Project scope.
2. Background
Ms. Rebecah Delp presented a slide deck (Attachment A) to provide Project background, existing conditions, permit history, and context for the proposed scope of work.
Sarasota County and WCIND have separate, active permits to conduct maintenance dredging activities within certain portions of the creek. The authorized work is to dredge Phillippi Creek to varying widths to a depth of -4.0 mean-low water (MLW) (Table 1). The current authorizations from the FDEP are exemption verifications and cannot be modified; therefore, new applications will be submitted to include the new proposed scope of work.

3. Discussions
The additional proposed work includes:
• Maintenance dredging of three oxbow features and to a width of approximately 30 feet, to restore the original design.
• Maintenance dredging Phillippi Creek from Tuttle Avenue to the US-41 Bridge to a width of approximately 50 feet, consistent with Sarasota’s County current dredge width in the north extent of the creek.
Final quantities and design drawings are still being refined.
Oxbow Maintenance Dredging
The project team discussed the three oxbows proposed for maintenance dredging. Based on available permit history and historical aerials, the oxbows are anticipated to qualify for an exemption. Recent bathymetric data collected within the past year identified areas with depths shallower than -4 feet MLW.
Approximately 37,381 cubic yards (CY) of material is proposed to be dredged from the three oxbows. The proposed design includes a bottom width of approximately 30 feet within the oxbows.
An U.S. Army Corps of Engineers permit previously authorized dredging of the southern oxbow to -4 feet MLW with a 30-foot width (Permit No. 199806140).
Historical aerials indicate that all three oxbows were previously dredged from upland areas. Ms.
Delp requested confirmation from FDEP regarding authorization or any potential concerns related to the proposed maintenance dredging. Mr. Guinn indicated that he did not see any red flags associated with the proposed oxbow work as they were clearly dredged from the uplands and should qualify for an exemption.
Channel Widening
Location maps were reviewed to depict the areas that are currently authorized to be dredged under each active authorization. The maps also identify the proposed areas to be dredged within
June 24, 2026 Page 3 of 3
CUMMINS CEDERBERG, INC. | Miami | Fort Lauderdale | Jupiter | Sarasota | St. Petersburg | Gainesville |Jacksonville | Tallahassee the gaps of the authorized work. The proposed approach is to connect existing permitted segments and gaps to provide a continuous 50-foot-wide channel from Tuttle Avenue to the US-
41 Bridge. The primary objective of widening navigational channel areas that were not previously authorized to 50-ft width is to restore and maintain adequate stormwater conveyance and drainage capacity.
Historic creek footprints were reviewed using historical aerials overlaid with current conditions. It was noted that the proposed widening aligns with previously dredged extents and historic channel conditions. The work is intended solely to remove accumulated sediment and does not propose dredging deeper or wider than historically existing conditions or previously dredged conditions.
Mr. Guinn stated that he did not see anything that would disqualify the proposed channel widening from being able to be authorized. Historic documentation demonstrates that the creek was previously dredged in its entirety for drainage purposes. Sarasota County noted that survey reports from the 2000s are being used to guide restoration efforts.
Ben Quartermaine asked on how the permit overlaps will be addressed. Ms. Delp stated that the
USACE permit will need to be modified to reflect the current scope. Mr. Guinn confirmed that exemptions cannot be modified and a new exemption to include the entirety of the proposed works should be submitted.
Next Steps
• Cummins Cederberg to schedule and hold a pre-application meeting with the USACE to discuss permit modification needs for federal authorization of the Project.
• Cummins Cederberg to prepare verification of exemption packages for the full project scope, including channel widening and oxbow maintenance dredging. FDEP confirmed this can be submitted under one exemption verification application.

3. Discussions
The additional proposed work includes:
• Potential permittee addition to SAJ-1999-00532 to allow for Sarasota County to work under this authorization in order to complete a section of the authorized dredging work that WCIND is no longer funding/completing themselves.
• Maintenance dredging of three oxbow features and to a width of approximately 30 feet, to restore the original design.
• Maintenance dredging Phillippi Creek from Tuttle Avenue to the US-41 Bridge to a width of approximately 50 feet, consistent with Sarasota’s County current dredge width in the north extent of the creek, for stormwater conveyance.
Final quantities and design drawings are still being refined.
Co-Applicant and Administrative Transfer
If the County intends to conduct dredging within the area authorized under WCIND’s permit, the
County may be added as a co-applicant/co-permittee under the active WCIND permit. The
USACE indicated that this administrative change could be processed within approximately one to two weeks, provided the work conforms to the currently authorized WCIND drawings and parameters.
Both permits remain active, and work may proceed within the existing authorized limits. Adding
Sarasota County as a co-applicant to the WCIND permit would make both the County and WCIND responsible for compliance with the permit, including adherence to all special conditions.
USACE stated that minor changes to means and methods (staging, material handling, etc.) may be permissible provided they do not trigger additional consultation or conflict with existing special conditions. It was noted that a previously submitted modification related to dewatering has already been approved. WCIND is able to proceed with dredging operations as authorized by the active permit in the interim.

Oxbow Maintenance Dredging
The Project team discussed the three oxbows proposed for maintenance dredging. Based on available permit history and historical aerials, the oxbows are anticipated to qualify as a maintenance event.
USACE indicated that, based on the information presented, the proposed oxbow work appears that it would qualify as maintenance dredging and does not raise immediate concerns.
Channel Widening
Location maps were reviewed to depict the areas that are currently authorized to be dredged under each active authorization. The maps also identify the proposed areas to be dredged within the gaps of the authorized work.
The primary purpose of the widening is to enhance stormwater conveyance and improve the creek’s ability to manage extreme storm events. USACE emphasized that the Project purpose must be clearly defined in the application, specifically indicating that the intent is to restore historic drainage capacity. The USACE noted that the stated purpose influences regulatory review and agency coordination.
Sarasota County noted that additional stormwater modeling is being performed to further quantify conveyance benefits.
Ms. Alexander noted that both active permits will need to be modified: the WCIND permit to remove any overlap area that Sarasota County is now taking over, and the Sarasota County permit to add the proposed widening and oxbow work. The County permit will require a new public noticing period. Administratively, application review would proceed similar to a new permit action, although processed as a modification. Ms. Alexander clarified the reason both permits must be modified is that the USACE cannot have two active permits over the same area; the footprint must be clearly reassigned.
June 24, 2026 Page 4 of 4
CUMMINS CEDERBERG, INC. | Miami | Fort Lauderdale | Jupiter | Sarasota | St. Petersburg | Gainesville |Jacksonville | Tallahassee
Mr. Morgan inquired if dredging began within the 30-foot-wide section under the WCIND per, if would that interfere with the modification process. Mr. Garcia noted that the USACE evaluates each proposal independently. Currently, both permits are active and authorized. The long-term intent is to reduce the WCIND permit and expand the County permit. Until that occurs, work must remain within each permittee’s authorized limits.
Mr. Morgan noted there has been discussion about potentially exceeding 50-foot-width in certain areas of the creek depending on hydraulic needs. In most areas, it would remain 50 feet or less with appropriate offsets. He asked if widening beyond 50 feet would be allowable. Mr. Garcia pointed out that any expansion beyond currently authorized widths would need to be clearly justified in the application and evaluated accordingly. Ms. Alexander added that once final dredge quantities are submitted, the USACE will determine whether additional consultation is required. If impacts to benthic resources are limited or not applicable, review is streamlined and would involve a standard 30-day comment period. All drawings and modification requests must be submitted through the USACE Regulatory Portal.
Next Steps
• Cummins Cederberg to prepare permit modification packages for the administrative modification and the full project scope, including channel widening and oxbow maintenance dredging. USACE confirmed this can be submitted through the Regulatory
Request System (RRS) portal.
