About this file

This is a contractor certification document required by South Dakota Executive Order 2023-02 for the Math SPDG Project Evaluation Services contract opportunity with the South Dakota Department of Education's Division of Learning and Instruction. The certification applies to all contractors bidding on or selected for state contracts and requires vendors to confirm they are not prohibited entities—defined as organizations ultimately owned or controlled by foreign nationals, foreign parent entities, or governments from China, Iran, North Korea, Russia, Cuba, or Venezuela. The RFP submission deadline is January 30, 2026, with written inquiries accepted until January 9, 2026, and state responses provided by January 16, 2026. The contract term runs from April 1, 2026, through September 30, 2030, with potential one-year extensions at the state's discretion. Award notification is anticipated for February 2026. The evaluation will employ a 100-point scoring system weighted across seven criteria: Cost and Reliability (10 points), Experience and Approach (30 points), Resources Available (15 points), Past Performance (10 points), Project Locale Familiarity (5 points), Project Management (20 points), and Ability to Handle Special Constraints (10 points).

Contractors must provide detailed, itemized budgets with costs broken down by deliverable, audited financial statements, three examples of similar past work with client references, and a completed South Dakota Substitute W-9 form. Insurance requirements include $1,000,000 in Commercial General Liability, $1,000,000 in Business Automobile Liability, Workers' Compensation as required by state law, and $1,000,000 in Professional Liability Insurance. The certification carries significant consequences: contractors who submit false certifications face contract termination, and contractors who become prohibited entities after certification must provide immediate written notice and understand that agencies may terminate existing contracts. All contractor inquiries must be directed to Rochelle Kenzy at Rochelle.Kenzy@state.sd.us with the subject line "RFP #25RFP17745," and contact with other state employees regarding the solicitation is prohibited.
