About this file

This is a Darfur Contracting Act Certification form required by the State of California for companies bidding on state contracts. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years. Companies meeting this criterion must certify their eligibility to bid by demonstrating either that they are not a scrutinized company under Public Contract Code Section 10476, or that they have received written permission from the Department of General Services to submit a proposal despite being classified as a scrutinized company. The certification must be completed and signed by an authorized representative of the prospective bidder or proposer under penalty of perjury, and companies without international business activities within the three-year period are exempt from this requirement.

The form provides two compliance pathways for eligible bidders. Under Option 1, non-scrutinized companies must submit a certification signed by an authorized official with their company name and Federal ID Number. Under Option 2, companies determined to be scrutinized entities may still participate if they have obtained written permission from the Department of General Services on a case-by-case basis, provided such permission serves the best interests of the state, and must include a copy of the DGS authorization with their bid or proposal. Both options require completion of standard identifying information including company name, Federal ID Number, authorized signature, and date of submission.
