About this file
This is a Justification and Approval (J&A) document for other than full and open competition, seeking approval to modify an existing Multiple Award Construction Contract (MACC) N40084-21-D-0070, Task Order N4008422F4330 at Marine Corps Air Station Futenma, Okinawa, Japan. The modification will be awarded on a sole source basis to the incumbent contractor due to unusual and compelling urgency under 10 U.S.C. 3204(a)(2).
The modification covers emergency mold remediation work at Fire Station Building 509, including replacement of 1,232 square meters of gypsum wall board, 363 square meters of ceiling board/insulation, 250 fixtures/strobes/detectors/outlets, installation of a new 421 square meter roofing system, and reconfiguration of electrical/HVAC components. The period of performance is February 15, 2025 through May 15, 2025, funded by FY25 O&MMC BSM1. The urgent nature is due to active-duty Marine Corps personnel experiencing acute mold exposure symptoms requiring hospital treatment. The J&A was approved on February 3, 2025, with provisions to incorporate lessons learned into future design packages to prevent similar emergency sole source requirements.

Justification and Approval Number 25-JA-FECON-XXXX
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Facilities Engineering Systems Command (NAVFAC), Far East, FEAD Camp Butler, Okinawa, Japan
2. Description of the Action Being Approved.
Approval is sought to modify the existing Multiple Award Construction Contract (MACC) N40084- 21-D-0070, Task Order N4008422F4330, DBB to Repair Fire Station Bldg. 509 (HQMC/FU2213M, eProject# 1707821) and Construct Fire Apparatus Shelter, Marine Corps Air Station (MCAS) Futenma (HQMC/FU2214R, eProject# 1725763), Okinawa, Japan, and award on a sole source to the incumbent contractor without competition. This request is necessary in support of mold remediation and prevention at MCAS Futenma Fire Station.
3. Description of Supplies/Services. This out-of-scope change to the contract requires:
a. Remediation and replacement of all permanently damaged materials and equipment as caused by mold or moisture to include 1,232 square meters of gypsum wall board, 363 square meters of ceiling board and insulation, and 250 fixtures / strobes / detectors / outlets.
b. Implementation of a new roofing system to ensure mold does not grow again to include 421 square meters of corrugated iron sheet, 421 square meters of c-channeling and reinforcement, and 421 square meters of solar reflective coating.
c. Remediation and reconfiguration of major electrical and HVAC components to facilitate proper airflow in the buildings to include 1 fire-alarm building transceiver, 20 intake vents and registers, and 83 wiring devices / bundles.
The appropriation planned for use of this acquisition is FY25 O&MMC BSM1, with a total funded amount of . Period of performance will be 15-FEB-2025 through 15-MAY-2025.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(2), Unusual and compelling urgency.
5. Rationale Justifying Use of Cited Statutory Authority.
Immediate action is needed to implement the description of supplies/services due to severe short- and long-term health impacts of users within located at Futenma temporary building 509 (FUT-509T).
Several active-duty Marine Corps service-members have already reported to Naval Hospital Okinawa with acute symptoms of mold exposure due to the unacceptable work environment. On 29 January, 2025, Commanding Officer of Marine Corps Air Station (MCAS) Futenma, Colonel William Pacatte, directed Public Works Branch (PWB) to immediately identify and implement solutions to restore the safe working environment for users of FUT-509T.
If the contracting activity does not limit competition for these requirements, MCAS Futenma’s ability to preserve workforce life and high-value Government property through their team of fire-fighting personnel will be immediately and severely impacted. Degradation of response time to crisis events, continued impact to fire-fighter force health, permanent health disability, and loss of life or property will likely follow if not addressed promptly. Therefore, due to the unusual and compelling urgency of the agency requirements, using the statutory authority of other than full and open competition is necessary.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A synopsis for this planned action was not published because this J&A meets an exception to the synopsis requirements per FAR Part 6.302-2 Unusual and compelling urgency.
The approved J&A will be published in accordance with FAR 6.305(b).
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A are fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
After justifying noncompetitive procurement of emergency services on the basis of unusual and compelling urgency, the contracting agency intends to preemptively identify projects and temporary buildings at risk of mold exposure and include exercisable options for remediation or incorporate means and methods from this instance into future design packages.
The future contract action will be awarded using full and open competition.
