About this file
This document is a Justification for an Exception to Fair Opportunity for a naval facilities engineering contract modification. Naval Facilities Engineering Systems Command (NAVFAC) Far East seeks to modify the existing Multiple Award Construction Contract (MACC) FA5270-17-D-0007, Task Order N4008424F4433, for interior and exterior refurbishments at Marine Corps Air Station (MCAS) Futenma in Okinawa, Japan. The modification is necessitated by structural integrity concerns with Building 219, where extensive concrete deterioration was discovered during ongoing work, requiring an urgent comprehensive structural survey.
The contract modification will be sole-sourced to the incumbent contractor without competition, citing urgent agency needs under FAR 16.505(b)(2). The period of performance is from 01-MAY-2025 through 01-MAY-2026, using FY25 O&MMC BSM1 appropriations. The primary requirement is to conduct a comprehensive structural survey to estimate the building's degree of deterioration, provide a site investigation report, and make recommendations about the facility's continued use or necessary repairs. The document notes that some of Okinawa's older buildings were constructed using unrefined beach sand, leading to poor concrete strength and rapid structural deterioration.

DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND FAR EAST

JUSTIFICATION FOR AN
EXCEPTION TO FAIR OPPORTUNITY
1. Contracting Activity.
Naval Facilities Engineering Systems Command (NAVFAC), Far East, FEAD Camp Butler, Okinawa, Japan
2. Description of the Action Being Approved.
Approval is sought to modify the existing Multiple Award Construction Contract (MACC) FA5270- 17-D-0007, Task Order N4008424F4433, SOW for Interior and Exterior Refurbishments, Marine Corps Air Station (MCAS) Futenma, Okinawa, Japan, and award on a sole source to the incumbent contractor without competition. This request is necessary to ensure site safety and structural stability while the project work is completed.
3. Description of Supplies/Services. This out-of-scope change to the contract requires:
a. Conduct a comprehensive structural survey to estimate the structure’s degree of deterioration. Provide a site investigation report with recommendations, based on the conclusions of the survey, on the continued use of facility and/or repair recommendations.
The appropriation planned for use of this acquisition is FY25 O&MMC BSM1, with a total funded amount of . Period of performance will be 01-MAY-2025 through 01-MAY-2026.
4. Identification of the Exception to Fair Opportunity.
Per FAR 16.505(b)(2), the agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
5. Rationale Justifying Use of Exception to Fair Opportunity.
Immediate action is needed to implement the description due to the questionable structural integrity of Building 219 which was uncovered during the project work. The original project scope included the repair of concrete cracks and spalling, this work uncovered extensively deteriorated concrete and repair in two locations. The exterior stairwell has been blocked from access and temporary support structures have been deployed for both the stairway and the third floor walkway to support areas of compromised concrete and rebar. Due to the limited scope of the original work, the condition of the concrete and rebar throughout the structure remains unknown.
If the contracting activity does not limit competition for these requirements, MCAS Futenma’s ability to utilize Building 219 will be severely delayed, as well as the completion of the concrete restoration work. Additionally, the installation tenants remain at heightened risk of further structural degradation
Justification and Approval No. 25-JA-FECON-0011 until the urgent survey is conducted. Therefore, due to the unusual and compelling urgency of the agency requirements, using the statutory authority of other than full and open competition is necessary.
6. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A are fair and reasonable.
7. Facts Supporting the Justification
Several decades ago, some of Okinawa's buildings were built using unrefined beach sand. This practice led to poor concrete strength and rapid structural deterioration and spalling of such buildings.
While performing work elements under Task Order N4008424F4433, our KTR observed abnormal and excessive spalling at Bldg. 219 on MCAS Futenma and promptly alerted the Government to their findings.
8. Actions to Remove Barriers to Future Competition.
After justifying noncompetitive procurement of emergency services on the basis of unusual and compelling urgency, the contracting agency intends to evaluate the structural integrity of the entire building and include exercisable options for remediation or incorporate means and methods from this instance into future design packages. The future contract action will be awarded using full and open competition.
