About this file
This document is a Darfur Contracting Act Certification form from the State of California's Department of General Services (DGS) for Solicitation 25FS0027. The form applies to companies that have conducted business activities outside the United States within the previous three years and are seeking to bid on or submit a proposal for a California state contract. The document provides two options for companies: Option #1 requires certification that the company is not a "scrutinized company" under Public Contract Code Section 10476, while Option #2 allows scrutinized companies to submit a bid if they have obtained written permission from the Department of General Services.
The certification requirements stem from Public Contract Code Sections 10475-10481, which aim to regulate state contracts for companies with international business operations. Companies must either certify they are not a scrutinized company or provide written permission from DGS to submit a proposal. The form must be completed by companies that have had business activities outside the United States in the past three years, with the authorized representative certifying compliance under penalty of perjury. Companies without international business activities in the previous three years are not required to complete the form.
