EMERGENCY RESPONSE SOLICITATION REQUIREMENTS
I. Introduction
The mission of DTSC’s Emergency Response Unit (ERU) is to provide statewide response to actual and potential releases of hazardous substances that pose an acute threat to public health and/or the environment. “Emergency” is defined as a release or threatened release of a hazardous substance where there is a threat to public health and/or the environment. The ERU interacts with a number of other state, federal, and local agencies in carrying out these emergency response activities. DTSC’s ERU responds statewide to requests for DTSC assistance for:
• Off-highway emergencies associated with the release or threatened release of hazardous substances;
• Emergency removals from illegal/clandestine drug labs; and
• Emergency response associated with natural and/or man-made disasters including, but not limited to, wildfires, floods, earthquakes, train derailments, etc.
“Off-highway” refers to hazardous substances incidents which occur off state highways or state right-of-way. Incidents occurring on state highways or state right-of-way are handled by the California Department of Transportation (CalTrans) and/or the California Highway Patrol (CHP). Pursuant to Health and Safety Code section 78875, ERU administers the expenditure of state funds for the purpose of taking immediate corrective action necessary to remedy or prevent an emergency resulting from a fire, explosion, or human exposure to a release or threatened release of hazardous substances. This includes responding to illegal dumping, abandonments, spill/release situations involving an unknown responsible party or other action needed for incident stabilization or to prevent potential emergencies.
DTSC also removes and disposes of hazardous substances discovered by law enforcement officials while investigating illegal/clandestine drug laboratories. The illegal manufacture of psychoactive drugs is a major health and safety issue while the disposal of illegal drug lab waste poses a significant environmental threat to both urban and rural communities. Contaminants at illegal drug labs and lab waste abandonments range from highly volatile organic solvents and semi-volatile organic compounds to highly corrosive inorganic acids and bases, the illicit drug itself, precursors, and other by-products. DTSC has funded and coordinated the removal and disposal actions at more than 19,900 illegal drug labs and drug lab waste abandonments since July 1, 1995.
DTSC assists local, state, and federal agencies after major disasters occur, including wildfires and flooding, to remove Household Hazardous Waste (HHW) and other harmful substances, such as E-Waste and asbestos-containing materials found on parcels and properties. The contaminated debris is removed and contained as quickly as possible to minimize exposure to emergency personnel, the public, the environment, and workers involved in restoration efforts. HHW includes lithium, lead-acid and household batteries;
compressed gas cylinders; bulk pesticides, fertilizers, pool chemicals; paints, thinners, and aerosol cans; asbestos siding, pipe insulation, and tiles. E-waste can include cathode ray tubes (CRTs) from televisions, computers, and other electronic devices.
Staff from DTSC’s ERU oversees contractors who remove household hazardous waste (HHW), asbestos, and e-waste from properties, impacted areas, or designated drop-off locations.

E. All documents requiring a signature (in blue ink) or digital signature must bear an original signature of a person authorized to bind the bidding firm.
F. Bids must be submitted for the performance of all the services described herein. Any deviation from the work specifications will not be considered and will cause a bid to be rejected.
G. A bid may be rejected if it is conditional or incomplete, or if it contains any alterations of form or other irregularities of any kind. The State may reject any or all bids and may waive an immaterial deviation in a bid. The State's waiver of an immaterial deviation shall in no way modify the solicitation document or excuse the bidder from full compliance with all requirements if awarded the Contract.
H. Costs incurred for developing bids in anticipation of award of the Contract are entirely the responsibility of the bidder and shall not be charged to the State of California.

VIII. Evaluation Process
A. At the time of bid opening, each bid will be checked for the presence or absence of required information in conformance with the submission requirements of this solicitation.
B. The State will evaluate each bid to determine its responsiveness to the published requirements.
C. Bids that contain false or misleading statements, or which provide references, which do not support an attribute or condition claimed by the bidder, may be rejected.
D. Prior to award of a Contract and after completion of the bid package review, DTSC representatives will make an unannounced visit to the apparent lowest responsive, responsible bidder for each geographical area. DTSC will evaluate the facility to determine that the resource requirements, i.e., vehicles, monitoring equipment, personal protective equipment, storage capacity, security provisions are present and in working conditions (see Section XI. C. Contractor Field Office Evaluation Form for reference). In the event it is found that the bidder does not possess the items outlined in the bid package, the bidder will be disqualified from the competition, and the State will award the Contract to the next lowest responsive, responsible bidder.
This process will be repeated until the lowest responsive, responsible bidder meeting the required qualifications is ascertained.
E. Award, if made, will be to the lowest responsive, responsible bidder for each geographical area.
F. Awards may be made on a rolling basis. Once a bidder has been fully evaluated and deemed suitable for work, an award will be made for that geographical area, regardless of award status for other geographical areas.
