About this file

This Justification and Approval (J&A) document from the Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD) details a sole-source procurement for NetApp branded storage devices. The Navy plans to award a single firm-fixed-price contract for two NetApp storage devices, including installation and maintenance services, to support an enterprise located at NSWC PHD. The procurement is critical for replacing end-of-life storage devices and maintaining network security, with an estimated dollar value funded by FY25 Naval Innovative Science and Engineering funds and FY25 Capital Improvement Projects funds.

The justification emphasizes that NetApp is the only approved brand on the Authority to Operate (ATO) list for their networks, and using alternative brands would require costly and time-consuming ATO recertification, potentially causing a 9-12 month implementation delay. A Sources Sought Notice was posted on SEWP.NASA.gov from 19-29 May 2025, which received responses from two vendors capable of delivering the required NetApp supplies. The contracting officer has determined the anticipated cost to be fair and reasonable, and NSWC PHD will continue to conduct market research to potentially broaden vendor competition in future procurements.

Text version

Navy Marine Corps Acquisition Regulation Supplement APRIL 2018 (Change 18-24) networks at NSWC PHD. No other storage devices are approved on the current ATO list other than NetApp. This pre-existing ATO is essential for maintaining network security and compliance with Department of Defense (DoD) regulations.

Utilizing any other brand would necessitate ATO recertification, causing a nine- to 12-month delay in the implementation of critical infrastructure. Procuring NetApp storage devices is the only viable option to meet the agency's critical requirements for network compatibility, maintain compliance, avoid significant delays and expenses associated with ATO recertification, and enable the necessary infrastructure enhancements.

The hardware procured for the will be integrated directly into existing networks. The Bill of Materials consists exclusively of equipment that is on the ATO lists for these networks. Integrating non-ATO hardware would require costly and time-consuming recertification, significantly delaying the expansion and impacting critical research and development activities. The cost can range from to work an ATO package.

NetApp is the only brand approved for use on systems and within the ATO. Non-ATO hardware cannot be used on the network due to security vulnerabilities. All systems must use hardware and software that have been approved by the ATO, as per DoD regulations. Using non-ATO hardware or software could jeopardize the ATO status of the systems, leading to delayed usage and extensive ATO recertification. Utilizing a different brand other than NetApp would require a new ATO package, which would result in a substantial duplication of cost of approximately that is not expected to be recovered through competition and an unreasonable delay of approximately nine to 12 months.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Based on research through GSA Advantage, internet searches and previous suppliers, several companies are capable of providing the required NetApp brand supplies. In addition, a Sources Sought Notice was posted to SEWP.NASA.gov from 19 May 2025 through 29 May 2025.

Responses were received from two vendors capable of delivering the required NetApp brand supplies.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

NSWC PHD will continue to conduct market research as warranted to provide a broader vendor base for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
