Sole Source Justification under $250K

Company Name/Brand: Lansmont Corporation

Description of Product, Supplies or Services required to meet the agency’s needs:

Navy Surface Warfare Center Port Hueneme Division (NSWC PHD’s) Weapons, Sensors, and Launchers Department, Code E57 is seeking LANSMONT CORP calibration and repair services for the existing Shock & Vibration Environment Recorder / Portable shock and vibration recorders CAL 3X90, otherwise referred to as data loggers. These data loggers monitor the environmental conditions for the within the enclosure during transportation and storage. The data logger is a self-powered data recorder with “internal accelerometer for vibration in three directions and temperature and humidity sensors.

The instrument captures data to flash memory and has Universal Serial Bus connectivity for software download. The instrument is also user programmable utilizing “SaverXware” Software.

Specifically, Code E57 is seeking Calibration: QTY: 25 – LANSMONT Field Instrument / Instrument calibration will verify the proper function, quality, and measurement accuracy.

Calibration services are accredited to ISO/IEC 17025:2005 standards. All calibration standards and test equipment are traceable to the National Institute of Standards and Technology. The calibrations will be performed on the existing Shock and Vibration Environment Recorder/Portable shock and vibration recorders CAL 3X90.

Code E57 is also seeking Repair: QTY: 10- LANSMONT Field Instrument to repair and evaluate our instruments to ensure that it is operating as designed. Calibration services are accredited to ISO/IEC 17025:2005 standards. The calibrations will be performed on the existing Shock and Vibration Environment Recorder/Portable shock and vibration.

This system supports the during transportation and storage to monitor the environmental conditions. This is a requirement by Program Executive Office (PEO) and Missile Defense Agency (MDA) to ensure the safety and integrity of the mission and to provide Ballistic Missile Defense.

Identification of Justification Rationale:

The Material or service must be compatible with aspects (Form, Fit, and Function) with existing systems presently installed.

A patent, copyright, proprietary data, or licensing agreement limits competition.

These are “direct replacement(s)” parts/components for existing equipment.

Urgency.

Statutory Authority Permitting Other Than Full and Open Competition 10 U.S.C. 2304(c)(1). The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency; IAW FAR 6.303-2(b)(4).

Identification of the Justification Rationale Explained:

The Shock & Vibration Environment Recorder / Portable shock and vibration recorders CAL 3X90 monitor the environmental conditions for the during transportation and storage.

These recorders are required by the PEO and MDA to ensure the safety and integrity of the mission. The data loggers that Code E57 currently owns require recalibration and repair because the instruments are certified for accurate measurement on a two-year periodic basis and, as such, require recalibration to ensure peak performance for a subsequent two- year period. Since this recorder, equipment is proprietary to LANSMONT, no other vendor has the software licensing and/or rights to provide us with the required recalibration and repair services.

Specific Characteristics of the Item or Service required that Limit the Availability to a Sole Source or Brand Name:

Part# CAL-INST-P1 (data loggers) and all the technical data, repair parts, and calibration equipment associated with this part number are proprietary to LANSMONT CORP. Therefore, since no other vendor has rights to use or own the technical data or parts, no other vendor can recalibrate or repair the current recorder equipment. To use another vendor, Code E57 would need to purchase entirely new data loggers, but no other vendors’ data loggers can meet the Program Office’s requirements. For instance, although other vendors’ data loggers can record similar data to LANSMONT CORP data loggers, the other vendors’ units are heavier and cannot fit within our missile configuration or, the other vendors’ units’ power capability is limited to six months and would need to be able to last longer to meet requirements. Furthermore, if another vendor were to be used for the calibration and repair, Code E57 would need to expend, at a minimum, an estimated amount of $175k to purchase new units rather than simply calibrate and repair the existing units. This estimate is based off the 35 new units we would need that cost, at a minimum, $5k each. This substantial duplication of cost is not expected to be recovered through competition.

Market Research Conducted:

The requirements generator conducted a google search on 11 DEC 2024 and could not find any other company that could perform calibration services or repair services for the data loggers that we currently have. Furthermore, the requirements generator reached out to LANSMONT CORP.

who confirmed that they hold proprietary rights to their equipment and data and, therefore, no third- party vendor can provide calibration or repair services for their data loggers. Finally, E57 has performed numerous market research studies to determine if an alternative product could meet requirements but have not found any results.

Contract specialist/buyer posted a Sources Sought to SAM.gov from 12/12/2024 through 01/02/2025 and received one response from a vendor who was found to be incapable due to the proprietary nature of the calibration and repair services being procured.

Statement of Actions, if any to Remove Barriers to Competition in the Future:

NSWC PHD Contracts Office will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
