Stan Gober Memorial Bridge Rehabilitation Project – Department of the Army Permit
This document is a Department of the Army permit (SAJ-2009-01021, NWP-MLT) issued by the U.S. Army Corps of Engineers Jacksonville District to Collier County Government for the Stan Gober Memorial Bridge Rehabilitation Project located over Marco Channel in Goodland, Collier County, Florida. The project involves repair of existing scour holes and failed scour protection at piers 12 through 16 of Bridge No. 030184 by placing clean rubble riprap and bedding stone around five existing piers. The proposed work encompasses a total impact area of 0.52 acre (0.104 acre per pier) based on approximately 84-foot by 60-foot fill dimensions at each pier. Work will occur within tidal waters of Goodland Bay in the Rookery Bay National Estuarine Research Reserve, designated as an outstanding Florida water. The permit was issued on October 28, 2022, and authorization is valid until March 14, 2026. The applicant must commence work within the specified timeframe or obtain re-verification; if work begins before permit modification or revocation, the permittee has 12 months from modification/revocation to complete activities under existing terms.
The permit authorizes work pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act. Special conditions require the permittee to maintain floating turbidity curtains with weighted skirts extending to within one foot of bottom, implement a detailed Turbidity Monitoring Plan with a 100-foot mixing zone limiting turbidity to zero nephelometric turbidity units above background conditions, provide commencement notification within 10 days of start, submit self-certification compliance within 60 days of completion, and comply with standard manatee conditions for in-water work and sea turtle/smalltooth sawfish construction conditions. A subaquatic vegetation and hardbottom benthic survey conducted September 8, 2021, documented no SAV or hardbottom resources within the survey area, and no impacts to adjacent mangrove wetlands are proposed. Cultural resources protection protocols require immediate cessation and notification to the Florida Department of State and Corps if historic or archaeological materials are discovered. All work must be completed during daylight hours, with erosion control measures and stabilization required upon completion. The permittee must maintain a copy of the permit and approved plans at the construction site and allow Corps representatives to inspect authorized activities at any time.

SAJ-2009-01021 (NWP-MLT)
Collier County Government c/o Jay Ahmad 2885 Horseshoe Drive S Naples, Florida 34104
Dear Mr. Ahmad:
Your application for a Department of the Army permit, received on May 28, 2022, has been assigned number SAJ-2009-01021 (NWP-MLT). A review of the information and drawings provided shows the proposed work includes the repair of the existing scour holes and failed scour protection in the vicinity of piers 12 through 16 where significant scour has occurred. No repairs or improvements are required at the remaining piers or the bridge abutments. The project proposes to place clean rubble riprap and bedding stone around the five (5) existing piers. The bedding stone will fill the existing scour hole and the riprap will provide a protective layer to avoid bedding stone and native substrate scouring. The total proposed impact area for the five (5) piers is 0.52 acre (0.104 acre each) based on approximately 84-foot by 60-foot fill dimensions at each pier. The proposed work will occur within the tidal waters of Goodland Bay within the Rookery Bay National Estuarine Research Reserve which is an outstanding Florida water (OFW) and the applicant is requesting a 100-foot mixing zone surrounding the proposed scour protection work and has submitted detailed plans to avoid discharges greater than zero
(0) nephelometric turbidity unit (NTUs) above the background conditions. The applicant will utilize floating turbidity curtains to control erosion and sedimentation within the vicinity and a detailed Turbidity Monitoring Plan is included in the project plans attached to this permit. A submerged aquatic vegetation (SAV) and hardbottom benthic survey was conducted by ESA on September 8, 2021, to document the existing conditions and the presence of SAV and hardbottom habitats. Neither of these resources were documented within the survey area that encompassed piers 12 through 16 and the vicinity of the proposed activities. No impacts to the adjacent mangrove wetlands are proposed or authorized. The applicant will utilize floating turbidity curtains to control erosion and sedimentation within the bay. The activities subject to this permit are authorized pursuant to authorities under Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. § 403) and Section 404 of the Clean Water Act (33 U.S.C. § 1344).
The project would affect waters of the United States, associated with the Marco Channel (a navigable vessel channel but is not a federal channel) of Goodland Bay, in

4) (AP.10.) Turbidity Control Measures during Construction: Turbidity must be monitored and controlled. Prior to initiating any of the work covered under this Opinion, the Permittee shall install turbidity curtains as described below. In some instances, the use of turbidity curtains may be waived by the USACE project manager if the project is deemed too minimal to generate turbidity (e.g., certain ATON installation, scientific survey device placement, marine debris removal) or if the current is too strong for the curtains to stay in place. Turbidity curtains specifications:
a) Install floating turbidity barriers with weighted skirts that extend to within 1 ft of the bottom around all work areas that are in, or adjacent to, surface waters.
b) Use these turbidity barriers throughout construction to control erosion and siltation and ensure that turbidity levels within the project area do not exceed background conditions.
c) Position turbidity barriers in a way that does not block species’ entry to or exit from designated critical habitat.
d) Monitor and maintain turbidity barriers in place until the authorized work has been completed and the water quality in the project area has returned to background conditions.
e) In the range of ESA-listed corals (St. Lucie Inlet, Martin County south to the Dry Tortugas and the U.S. Caribbean) and Johnson’s seagrass (Turkey Creek/Palm http://www.fisheries.noaa.gov/pr/shipstrike/
Bay south to central Biscayne Bay in the lagoon systems on the east coast of Florida):
i) Projects that include upland earth moving (e.g., grading to install a building or parking lot associated with a dock and seawall project), must install sediment control barriers to prevent any upland sediments from reaching estuarine or marine waters.
ii) The turbidity curtain requirement cannot be waived for any project that moves or removes sediment (e.g., dredging, auger to create a pile, trenching to install a cableline). If turbidity curtains are not feasible in an area based on site conditions such as water current, high wave action, or stormy conditions, the project must undergo individual Section 7 consultation and is not covered under this Programmatic Opinion.
5) (AP.11.) Entanglement: All turbidity curtains and other in-water equipment must be properly secured with materials that reduce the risk of entanglement of marine species (described below). Turbidity curtains likewise must be made of materials that reduce the risk of entanglement of marine species.
a) In-water lines (rope, chain, and cable, including the lines to secure turbidity curtains) must be stiff, taut, and non-looping. Examples of such lines are heavy metal chains or heavy cables that do not readily loop and tangle. Flexible in-water lines, such as nylon rope or any lines that could loop or tangle, must be enclosed in a plastic or rubber sleeve/tube to add rigidity and prevent the line from looping and tangling. In all instances, no excess line is allowed in the water.
b) Turbidity curtains and other in-water equipment must be placed in a manner that does not entrap species within the construction area or block access for them to navigate around the construction area.
