Consumer Financial Protection Bureau
About this file
This document is a Justification for an exception to fair opportunity under FAR 16.505(a)(4) for the renewal of the Consumer Financial Protection Bureau's (CFPB) ZixGateway Enterprise License.
The CFPB requires the ZixGateway software to encrypt emails sent through servers outside the agency. The email infrastructure has been designed exclusively for ZixGateway, and developing a new email system would require a 12-15 month, $11 million engineering project. The CFPB currently owns 2,150 ZixGateway Virtual licenses and 30,000 ZixEnable on Virtual licenses, and needs to renew the maintenance on these. The Contracting Officer will determine the proposed pricing represents best value based on a lowest-price, technically acceptable quote in a competitive environment. The contract will have a 12-month base period with three 12-month option periods, for a total estimated value of $191,557.21. The incumbent contractor is FCN INC, who was awarded contract NNG15SC71B.

CFPB needs to encrypt emails that are sent through email servers outside of the agency. CFPB currently utilizes ZixGateway Virtual to safely encrypt and send emails. CFPB currently owns 2150 licenses of the ZixGateway Virtual and 30,000 of the ZixEnable on Virtual and pays maintenance on these every year. The email server infrastructure has been designed to exclusively run ZixGateway; no other virtual software licenses will work with the architecture without re-engineering the infrastructure. Developing a new email server infrastructure would require a full scope engineering and design project. This type of project would include engineering, security vetting and scanning, testing, product selection, FTE hours for customization development, documentation, implementation and finally troubleshooting as required. This would require 12 to 15 months and cost approximately $11 million to accomplish. Additionally, CFPB would not have email encryption until a new solution is found, as CFPB would have no effective solution encrypt outgoing emails.
The Contracng Officer will determine that the proposed pricing represents the best value to the government based upon a lowest-price, technically acceptable quote received in a compeve environment.
The Office of Technology and Innovaon will connue to monitor the marketplace as products become available that are compable with exisng systems and soware, or to determine if a different soluon provides sufficient benefits for the Bureau to change infrastructure.
Since this effort does not exceed $250K, this certification also serves as approval.
