1.4 SPECIAL CONTRACTOR REQUIREMENTS

1.4.1 Coordination in Work Areas

1.4.1.1 Sharing of Roadways and Work Areas

During the period of this contract, in addition to Government personnel and equipment working at the site, other contractors may be on the island for the construction of other features of work that is on or adjacent to the site being accomplished under this contract. This work includes the pumping of new dredge material into the containment cells, dike raising, development of borrow areas and road work. It shall be the responsibility of the Contractor on this contract to be fully informed of the extent of the limits of work to be performed by other Contractors. Should there be any conflict between these limits, it shall be brought to the attention of the Contracting Officer (KO) and the KO's decision shall be final.

1.4.1.2 Work Hours Restrictions

The Contractor shall limit work hours and activities to normal construction

SECTION 01 11 00 Page 2 work hours and shall adhere and comply with local ordinances. Work occurring on Sunday or outside these prescribed hours is not allowed without prior written approval from the Contracting Officer. At least 2 days prior notice to the desired day is required. There is very limited existing lighting of the dike roadways and work areas and any work after sunset will require Contractor supplied light plants.

1.4.1.3 Existing Utility Location

Existing utilities must be located before doing any digging work on Facility. The Contractor shall be responsible to hire a private utility locator, obtain all necessary existing utility locations, which may be necessary to accomplish his work, and mark any utility lines in the immediate vicinity of his work.

1.5 TIME EXTENSION FOR UNUSUALLY SEVERE WEATHER

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Contract Clause entitled "Default: (Fixed Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

c. All awards or extensions for time shall be at the sole discretion of the Contraction Officer.

1.5.1 Schedule

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. 1.5.3 Impacted Days

The number of actual adverse weather days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month); shall be calculated chronologically from the first to the last day in each month; and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in the schedule of monthly anticipated adverse weather delays, as listed above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Contract Clauses entitled "Default (Fixed Price Construction)" of Section 00 72 00 Contract Clauses.

1.6 COORDINATION WITH THE USING AGENCY AND OTHER CONTRACTORS

During the period of this contract, in addition to Government personnel working at the site, other contractors may be in force for the construction of other features of work on or adjacent to the site being accomplished under this contract. This work includes the pumping of new dredge material into the storage cells using pipelines from the bay; and dike, borrow area and road work. It shall be the responsibility of the Contractor on this contract to be fully informed of the extent of the limits of work to be performed by other Contractors. Should there be any conflict between these limits, it shall be brought to the attention of the Contracting Officer (KO) and the KO's decision shall be final. Also, prior to the completion of work under this contract, members of the Using Agency may be performing work or occupying facilities on or adjacent to the area, including working at the Government Office and Equipment Yard. The Contractor shall arrange his plant and shall schedule and perform this work so as to effectively cooperate with all other contractors and Government agencies.

1.7 HISTORICAL AND ARCHAEOLOGICAL FINDS

Federal legislation provides for the protection, preservation, and collection of scientific, prehistoric, historical, and archaeological data, including relics and specimens which might otherwise be lost due to alteration of the terrain or building features as a result of any Federal construction project. Should the Contractor, or any of the Contractor's employees, or parties operating or associated with the Contractor, in the performance of this contract discover evidence of possible scientific, prehistoric, historical, or archaeological data, the Contractor shall immediately cease work at that location, avoid further disturbance, and notify the Contracting Officer, giving the location and nature of the findings. The Contractor shall forward written confirmation to the Contracting Officer as directed. The Contractor shall exercise care so as

SECTION 01 11 00 Page 4 not to disturb or damage artifacts or fossils uncovered during excavation operations, and shall provide such cooperation and assistance as may be necessary to preserve the findings for removal or other disposition. Any person who, without permission, injures, destroys, excavates, appropriates, or removes any historical or prehistoric artifact, object of antiquity, or archaeological resource on the public lands of the United States is subject to arrest and penalty of law. Where appropriate by reason of discovery, the Contracting Officer may order delays in the time of performance or changes in the work, or both. If such delays or changes are ordered, an equitable adjustment will be made in the contract in accordance with the applicable clauses of the contract.

1.8 SUBCONTRACTS AND WORK COORDINATION

Contract Clauses "SUBCONTRACTS", "PERMITS AND RESPONSIBILITIES", and "MATERIAL AND WORKMANSHIP" are supplemented as follows:

a. Divisions or sections of specifications are not intended to control the Contractor in dividing the work among subcontractor, or to limit work performed by any trade.

b. Contractor shall be responsible for coordination of the work of the trades, subcontractors, and materials.

c. The Government or its representative will not undertake to settle any difference between the Contractor and Contractor's subcontractors, or between subcontractors.

d. The Government reserves the right to refuse to permit employment on the work or require dismissal from the work of any subcontractor who, by reason of previous unsatisfactory work on Corps of Engineers projects, or for any other reason is considered by the Contracting Officer to be incompetent or otherwise objectionable.

1.9 CONSTRUCTION MANPOWER AND EQUIPMENT REPORT

The Contractor shall submit Construction Manpower and Equipment Report daily using Resident Management System (RMS 3.0). The report shall include manpower and equipment for the general and subcontractors.

1.10 PROFIT

For modifications to this Craney Construction contract, profit must be calculated using the Weighted Guidelines method.

1.10.1 Weighted Guidelines

Weighted guidelines method of determining profit shall be used on any equitable adjustment change order or modification issued under this contract. The profit factors shall be as follows:

Factor Rate Weight Value

Degree of Risk 20% Relative difficulty of work 15% Size of Job 15% Period of performance 15%

SECTION 01 11 00 Page 5

Contractor's investment 05% Assistance by Government 05% Subcontracting 25% Total 100%

1.10.2 Weighted Values

Based on the circumstances of each procurement action, each of the above factors shall be weighted from .03 to .12 as indicated below. The value shall be obtained by multiplying the rate by the weight. The value column when totaled indicates the fair and reasonable profit percentage under the circumstances of the particular procurement.

1.10.2.1 Degree of Risk

Where the work involves no risk or the degree of risk is very small, the weighting should be .03; as the degree of risk increases, the weighting should be increased up to a maximum of .12. Lump sum items will have, generally, a higher weighted value than the unit price items for which quantities are provided. Other things to consider: the portion of the work to be done by subcontractors, nature of work, where work is to be performed, reasonableness of negotiated costs, the amount of labor included in costs, and whether the negotiation is before or after performance of work.

1.10.2.2 Relative Difficulty of Work

If the work is most difficult and complex, the weighting should be .12 and should be proportionately reduced to .03 on the simplest of jobs. This factor is tied in to some extent with the degree of risk. Some things to consider: the nature of the work, by whom it is to be done, where, and what is the time schedule.

1.10.2.3 Size of Job

All work not in excess of $100,000 shall be weighted at .12. Work estimated between $100,000 and $5,000,000 shall be proportionately weighted from .12 to .05.

1.10.2.4 Periods of Performance

Jobs in excess of 24 months are to be weighted at .12. Jobs of lesser duration are to be proportionately weighted to a minimum of .03 for jobs not to exceed 30 days. No weight where additional time not required.

1.10.2.5 Contractor's Investment

To be weighted from .03 to .12 on the basis of below average, average, and above average. Things to consider: amount of subcontracting, mobilization payment item, Government furnished property, equipment and facilities, and expediting assistance.

1.10.2.6 Assistance by Government

To be weighted from .12 to .03 on the basis of average to above average.

Things to consider: use of Government owned property, equipment and facilities, and expediting assistance.

SECTION 01 11 00 Page 6

1.10.2.7 Subcontracting

To be weighted inversely proportional to the amount of subcontracting.

Where 80 percent or more of the work is to be subcontracted, the weighting is to be .03 and such weighting proportionately increased to .12 where all the work is performed by the Contractor's own forces.

1.11 BLASTING AND FIRES

Blasting and fires will not be permitted for this project.

1.12 CONTRACTOR QUALITY CONTROL RESPONSIBILITY

The Contractor is fully responsible for the management and supervision associated with Quality Control of all construction work included in this contract. The Government is responsible for Quality Assurance by reviewing all Contractor documentation and work has been completed to meet contract requirements.

1.13 LIQUIDATED DAMAGES

Refer to contract clause LIQUIDATED DAMAGES - CONSTRUCTION (FAR 52.211-12) in Section 00 72 00 General Conditions.

1.14 PERFORMANCE BOND

The Contractor's Performance Bond shall remain effective throughout the construction period.

a. In the event the Contractor fails to commence and diligently pursue any construction warranty work required, the Contracting Officer will have the work performed by others, and after completion of the work, will charge the remaining construction warranty funds of expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.

b. In the event sufficient funds are not available to cover the construction warranty work performed by the Government at the Contractor's expense, the Contracting Officer will have the right to recoup expenses from the bonding company.

c. Following oral or written notification of required construction warranty repair work, the Contractor shall respond in a timely manner.

Written verification will follow oral instructions. Failure of the Contractor to respond will be cause for the Contracting Officer to proceed against the Contractor.

d. Refer to contract Clause 52.228-15 PERFORMANCE AND PAYMENT BONDS - CONSTRUCTION (FAR 52.228-15 in Section 00 72 00 General Conditions.

1.15 DAMAGE TO THE WORK

The responsibility for damage to any part of the permanent work shall be as set forth in contract Clause PERMITS AND RESPONSIBILITIES of Section 00 72 00 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in

SECTION 01 11 00 Page 7 the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES in Section 00 72 00 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as noted herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.

Refer to contract Clause 52.236-7 PERMITS AND RESPONSIBILITIES (FAR 52.236-7 in Section 00 72 00 General Conditions.

1.16 PROTECTION OF EXISTING CONDITIONS AND NEW WORK

In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements," the Contractor shall:

a. Perform excavation, transportation, and construction operations in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Perform excavation, transportation, and construction operations in such a manner to prevent injury and damage to new work. Repair or replace portions of new work which have been altered during construction operations, at no additional cost to the government.

c. Repair or replace portions of existing conditions which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing surfaces and vegetation adjacent to the new work shall be in a condition equal to or better than that which existed before new work started.

1.17 PRE-BID SITE VISIT

Prior to the submission of bids, bidders are required to visit the project site location to become familiar with the project requirements. This contract includes a Government led site visit during the solicitation period. Failure to visit the project site will not disqualify a bid;

however, the bidder is required to comply with the terms and conditions of the resultant Contract by reason of such failure. A failure to inspect the site shall not constitute grounds for a claim after Contract award.

1.18 WARRANTY

The Contractor shall provide a minimum of one-year warranty on the materials and workmanship from the date of the Government's acceptance of the work.

1.19 LAYOUT OF WORK

Read this paragraph in conjunction with contract Clause LAYOUT OF WORK (FAR 52.236-17) of Section 00 72 00 CONTRACT CLAUSES.
