All contractors, subcontractors, their employees, associates, and consultants who have access to critical information must comply with the DOD and U.S. Navy (OPSEC) program. The OPSEC Program is directed by NSPM 28, DOD Publications, and applicable Navy guidance.
The contractor will practice sound OPSEC practices and implement OPSEC countermeasures to protect DoD Critical Information (CI). Items deemed CI are facts, which individually, or in compilation, reveal sensitive details about NIWC Atlantic or the contractor’s security operations related to the support or performance of this contract, and thus require a level of protection from adversarial collection or exploitation not normally afforded to unclassified information. The Contractor must protect CI and other sensitive, unclassified information and activities, especially those activities or information which could compromise operations, or degrade the planning and execution of military operations performed by or supported by the contractor in support of the mission.
RESPONSIBILITIES:
The NIWC Atlantic OPSEC Program Manager will provide/approve OPSEC training curriculum for use by the contractor. The Critical Information List (CIL) will be provided to all contract personnel. Approved organizational OPSEC countermeasures will be used by all contract personnel to protect CI in their possession and protect against current foreign intelligence and industrial espionage threats. All contract personnel working on the contract or having access to CI must attend initial and annually recurring refresher OPSEC training.
Training will be provided before contract personnel are allowed access to or handling of CI. All contract personnel will comply with the organizations OPSEC standards and practices as trained. Additional training may be required based on updates to CI, OPSEC countermeasures, intelligence threat/vulnerability, or other fundamental changes to the OPSEC program.
The Contracting Officers Representative (COR) will track OPSEC training statistics for all personnel working on the contract. Detailed OPSEC training statistics must be made available to the OPSEC PM at the end of each calendar quarter and/or upon request.
Contractors with OPSEC requirements within a contract must ensure employees receive OPSEC training as specified within the contract. Accomplishment of training must not exceed 90 days from initial assignment to a contract with OPSEC requirements. Annual training will be accomplished NLT 30 September of each year.
All personnel must promptly report OPSEC related incidents, issues, and concerns to the COR and the NIWC LANT OPSEC office: niwc_lant_opsec.fct@us.navy.mil.

| text: 1. Contractors may have access to information or material which is classified up to the SECRET level per the Office of The Director of National intelligence Classification Guide (ODNI CG v3.0), dated 31 May 2016. |
2. Those contractors will require a SECRET security clearance per SECNAVINST 5510.36B, SECNAVINST 5510.30C and 2 CFR Part 117 "NISPOM Rule". Additional security guidance will be provided by the NIWC Atlantic Security Manager.
3. Only persons actually performing classified tasks on this contract shall be required to obtain and maintain security clearances per 32 CFR Part 117 NISPOM Rule.
4. Documentation obtained for use with this contract shall not be used for any other purpose unless prior authorization has been obtained from NIWC Atlantic.
5. Contractors will understand and practice sound OPSEC principles per OPNAVINST 3432.1 and SPAWARSYSCENINST 3432.1 and ensure that employees receive OPSEC training by the government upon initial assignment and annually thereafter.
6. Contractors Receiving, Transmitting or Accessing Controlled Unclassified Information (CUI) on or through its contractor information systems(s) must safeguard the information to avoid compromise, including but not limited to disclosure of information to unauthorized persons, unauthorized modification, destruction, or loss of an object, or the copying of information to unauthorized media, as required per DFARS Subpart 204.73 and Clauses 204-7304 and 252.204.7012. Contractors shall report to the DOD each cyber incident that affects unclassified controlled technical information resident on or transiting contractor information systems in accordance with DFARS Clauses 204.7304 and 252.204-7012 detailed reporting criteria and requirements are set forth in the Clause at 252.204-7012, safeguarding or unclassified controlled technical information. For information on handling CUI see DODI 5200.48.
7. The contractor shall not downgrade, declassify, or destroy any classified documentation used with this contract. All such material shall be returned to the COR at NIWC Atlantic.
8. (Block 10.j) - The following procedures will be used to protect CONTROLLED UNCLASSIFIED INFORMATION (CUI) material: Reference: DoD Information Security Program 5200.1 Volume 1-3; DOD Instruction 5200.48 Controlled Unclassified Information (CUI).
9. (Block 11.e) - Contract is for engineering services. Cleared personnel are required to perform this service because escorting personnel or sanitization of the work space cannot preclude access to classified information. Any classification guidance needed will be provided by NIWC Atlantic-COR.
10. (Block 11.j) – Contractor will understand and practice sound OPSEC principles in accordance with OPNAVINST 3432.1, SECNAVINST 3070.2 and SPAWARSYSCENINST 3070.1B and will ensure that employees receive OPSEC training provided by the Government upon initial assignment and annually thereafter. SEE OPSEC ATTACHMENT WITHIN BLOCK 13 ATTACHMENT BAR.
11. (Block 11.l) – DoD 5200.48 – All persons responsible for the processing, storage, handling, transmission, or destruction of CUI shall take appropriate measures to prevent unauthorized access or use. Dissemination of CUI only to individuals who require the information for authorized mission purpose. CUI should be decontrolled when it no longer requires safeguarding measures. This does not constitute public release of CUI. Public release shall be in accordance with law, regulation, and agency-specific procedures. Personnel who create or handle CUI shall have knowledge and understanding of CUI categories and associated markings, as well as applicable safeguarding, dissemination and decontrol policies and procedures.
