All quotations must include a cover page addressing the following information:
1. RFQ Number
2. Quoter’s Name
3. Subcontractor Name(s), If Applicable
4. Quoter System for Award Management (SAM) Unique Entity Identifier (UEI)
5. Contact Name
6. Contact Email address
7. Contact telephone number
8. Complete business mailing address
9. The following statement “The Quoter takes no exception and completely accepts all the terms and conditions in the RFQ and subsequent amendments.”
Volume I: Technical Quotation The Quoter’s technical submission should demonstrate the firm’s capability to perform the work requirements outlined in the Attachment A. Volume I shall include separate sections within the volume outlining the following items:
Technical Capability The Technical Capability shall describe, in narrative form, the Quoter’s capability to fulfill the overall requirements of Attachment A, including experience providing similar services.
Personnel The Quoter shall propose a minimum of three investigators, that demonstrate the level and depth of professional expertise, certifications and experience necessary to successfully meet or exceed the requirements found in Attachment A’s requirements. At a minimum, the Quoter shall provide a brief narrative that discusses the most relevant experience of the proposed personnel.
For each designated personnel, the quotation shall include a resume not to exceed two pages.
At a minimum, the Quoter shall submit a matrix that identifies the investigator’s name, degree(s), certification(s), and years of relevant experience. Below is an example matrix template, but a Quoter may include additional information or format in whatever way the Quoter believes best communicates the information.
Name Years of Relevant Experience Education Certifications
Please ensure resumes clearly demonstrate the minimum requirements as stated in Attachment A.
Past Performance The Government will evaluate recent and relevant past performance of each Vendor as submitted in the Past Performance Information Retrieval System via Contractor Performance Assessment Reporting System.
Page Limitation. Excluding cover pages, the personnel matrix, and resumes, the technical quote (including all non-price factors and other attachments) is limited to 6 pages. The font and format should be of readable quality. Excessively small font may be rejected or not evaluated at the Contracting Officer’s discretion.
Quoters shall not include any price information in the technical quotation. For the overall technical quotation, a recitation or paraphrasing of the requirements already identified in the work requirements will not improve the quotation.
Volume II- Price Quotation Each Quoter shall submit a price quotation separate from the technical quotation (Volume I).
The price quotation shall include the following:
Completion of Attachment B, including any stated options. The labor categories and number of hours are solely for evaluation purposes and should neither be considered a minimum nor an expectation of actual requirements. The labor rate must include all costs associated with performance including all overhead, overtime, local travel, and any other costs not expressly identified as an Other Direct Cost (ODC). Costs for court reporter/transcription services shall be considered an ODC that will be billed on a cost-reimbursement basis. FHFA will evaluate the quoted prices for reasonableness. FHFA reserves the right to conduct a price realism analysis to assess whether the quoted rates are unrealistically low. Unrealistically low labor rates may be considered a negative attribute to the extent that they reflect a lack of technical understanding or a risk inherent in the proposed approach.
Page Limitation. There is no page limitation on the price quote submission.
Evaluation and Selection Process Since this award is made under the policies of FAR part 12 in conjunction with FAR part 13 procedures, the evaluation process is streamlined, and FHFA has considerable flexibility in its award decision. FHFA will evaluate the quotation considering positive attributes, negative attributes, and potential risk of the overall quotation.
During the evaluation process, FHFA may or may not conduct exchanges. If FHFA conducts exchanges, such exchanges may be with one, several, or all Quoters. Exchanges may vary based on FHFA’s need to understand or give Quoters an opportunity to improve their quotations, but all exchanges will be fair and equitable.
Only Quoters whose quotes receive an overall technical rating of acceptable or higher will be considered for award. Following an evaluation and, if necessary, tradeoff analysis, FHFA may make one or more than one award based on the quote(s) that is (are) evaluated to be the best value and determined responsible.
FHFA reserves the right to make an award based on other than the lowest quoted price.
Technical (Volume I) is more important than price (Volume II); however, the importance of price as a factor could become greater if competing quotations are evaluated as technically equal.

FOR WORKPLACE INVESTIGATIONS Attachment A
1.0 BACKGROUND
The Federal Housing Finance Agency (FHFA or Agency) was created by the Housing and Economic Recovery Act of 2008 to regulate and supervise Fannie Mae, Freddie Mac, and the 11 Federal Home Loan Banks (FHLBs) (jointly, the "regulated entities"). These institutions play critical roles in supporting our nation's housing finance system. Fannie Mae and Freddie Mac (the "Enterprises") guarantee mortgage-backed securities (MBS) and hold mortgages and MBS for investment. The FHLBs working with the Office of Finance to lend money to banks and other financial institution members, generally using mortgages as collateral, and also invest in mortgage-related assets. Additional information about the FHFA and its mission can be found at http://www.fhfa.gov.
The Office of Human Resources Management (OHRM) is dedicated to collaborating in a client centric, data driven, and solutions focused way to achieve FHFA’s regulatory mission by proactively determining human capital needs to recruit and retain a preeminent workforce that is diverse, motivated, and committed to excellence. As part of its portfolio of services, OHRM provides Employee Relations services throughout FHFA. OHRM has identified the need to procure contractor services to conduct factual harassment, misconduct, or other prohibited activities investigations. The workplace investigative services will include conducting administrative investigations/inquiries and various other associated tasks.
2.0 SCOPE
FHFA requires a contractor to provide non-EEO investigative services for administrative workplace inquiries into allegations of misconduct or other prohibited activities on an as-needed basis. The contractor will conduct internal investigations and management inquiries, including conducting interviews, preparing witness statements, and reports of findings related to routine and complex workplace issues.
3.0 TASKS
i. FHFA will provide the Contractor with the preliminary inquiry details, and if needed, the contact information of the individual(s) alleging misconduct or harassment in order to gather facts pertaining to the issue.
ii. The Contractor shall develop and provide an investigation plan (IP) within 5 business days based on the preliminary information. The IP shall include, at a minimum, individuals to be interviewed, a question outline, and the timeframes for completion of the inquiry and issuance of report of findings and recommendations.
iii. FHFA shall provide feedback or approve the IP within 3 business days of receipt.
iv. The Contractor shall update the IP within 1 business day of feedback until the IP is approved, in writing.
v. Upon IP approval, the Contractor shall initiate the inquiry within 5 business days.
vi. The Contractor shall conduct interviews with identified parties utilizing a Contractor-provided court reporter in all interviews or prepare written statements from interview http://www.fhfa.gov/ notes to be signed by the interviewed parties. In the rare instance where parties are not available for an interview, the Contractor will provide the party with relevant questions and obtain sworn statements in a standard question and answer (Q&A) format as opposed to a summary of the statement(s). The interviews and Q&A should be based on the IP question outline, to include those questions that seek elaboration and clarification, and that clear up inconsistencies between evidence and/or witnesses' testimony in the record. Additionally, the Contractor shall follow up on leads received during interviews. For example, leads can be newly named parties that may develop based on previously acquired testimony and evidence.
vii. The Contractor will not share information about the testimony of parties with other individuals. However, in the Contractors’ judgement, if follow up questions are deemed necessary, the Contractor may reach out to the relevant employee to conduct follow up questioning. This is not to be interpreted as providing relevant employees the opportunity to complete a rebuttal statement.
During the investigation, if the Contractor is having any problems gathering evidence or obtaining witness cooperation, they should notify the Contracting Officer’s Representative (COR) or Technical Monitor (TM) immediately.
viii. Once the investigation is complete, the Contractor shall provide to the COR/TM a report of findings outlining any potential violations of law, regulation, guidance, or policy, along with recommendations for any appropriate corrective action within the timeframes agreed upon in the IP. The report will include a statement of the allegations investigated, the transcripts of the interviewed parties, relevant documents noted by source, and the Contractor’s summary of the findings. If there were any challenges (e.g., noncooperation from witnesses) that occurred during the inquiry, or if documents referred to in testimony are not included in the report, the Contractor should explain and inform the COR and TM of such developments prior to the final report and ensure notation in the investigative report.
ix. A sufficiency review of the investigative report will be conducted by FHFA within 15 business days of receipt.
x. The Contractor shall initiate edits/changes, that may include providing additional witness statements, to the report within 5 business days and will document all changes until the report is approved, in writing.

(u) Unauthorized Obligations.
(1) Except as stated in paragraph (u)(2) of this clause, when any supply or service acquired under this contract is subject to any End Use License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-Deficiency Act violation (31 U.S.C.
1341), the following shall govern:
(i) Any such clause is unenforceable against the Government.
(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an “I agree” click box or other comparable mechanism (e.g., “click-wrap” or “browse-wrap” agreements), execution does not bind the Government or any Government authorized end user to such clause.
(iii) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.
(2) Paragraph (u)(1) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.
