About this file
This is a performance work statement for a multi-year indefinite delivery/indefinite quantity contract to provide multi-tiered system of support services for social, emotional, and behavioral needs in secondary schools serving military-connected students within the Department of Defense Education Activity. The contractor will expand an existing elementary school pilot program to six secondary schools, develop online training materials, and build program sustainability through the end of 2027. Services include implementing the pilot program, participatory research and development, maintaining a website of school resources, providing professional learning and coaching, conducting program evaluation, and developing tools to support long-term implementation. The contractor must propose key personnel and meet security requirements for work on military installations. The performance standards, quality assurance plan, and technical exhibits specify compliance and reporting requirements.

CLAUSES INCORPORATED BY FULL TEXT
52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days;
provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.
52.229-11 TAX ON CERTAIN FOREIGN PROCUREMENTS--NOTICE AND REPRESENTATION (JUN
2020)
(a) Definitions. As used in this provision--
Foreign person means any person other than a United States person.
Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. For purposes of the prior sentence, a foreign country does not include an outlying area.
United States person as defined in 26 U.S.C. 7701(a)(30) means--
(1) A citizen or resident of the United States;
(2) A domestic partnership;
(3) A domestic corporation;
(4) Any estate (other than a foreign estate, within the meaning of 26 U.S.C. 701(a)(31)); and
(5) Any trust if--
(i) A court within the United States is able to exercise primary supervision over the administration of the trust; and
(ii) One or more United States persons have the authority to control all substantial decisions of the trust.
(b) Unless exempted, there is a 2 percent tax of the amount of a specified Federal procurement payment on any foreign person receiving such payment. See 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C- 1 through 1.5000C-7.
(c) Exemptions from withholding under this provision are described at 26 CFR 1.5000C-1(d)(5) through (7). The Offeror would claim an exemption from the withholding by using the Department of the Treasury Internal Revenue Service Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available via the internet at www.irs.gov/w14. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.
(d) For purposes of withholding under 26 U.S.C. 5000C, the Offeror represents that--
(1) It [_]is [_]is not a foreign person; and
(2) If the Offeror indicates ``is'' in paragraph (d)(1) of this provision, then the Offeror represents that--I am claiming on the IRS Form W-14 [__] a full exemption, or [__] partial or no exemption [Offeror shall select one] from the excise tax.
(e) If the Offeror represents it is a foreign person in paragraph (d)(1) of this provision, then--
(1) The clause at FAR 52.229-12, Tax on Certain Foreign Procurements, will be included in any resulting contract;
and
(2) The Offeror shall submit with its offer the IRS Form W-14. If the IRS Form W-14 is not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent of each payment.
(f) If the Offeror selects ``is'' in paragraph (d)(1) and ``partial or no exemption'' in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.
(g) A taxpayer may, for a fee, seek advice from the Internal Revenue Service (IRS) as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https://www.irs.gov/help/tax-law-questions.
(End of provision)

PERFORMANCE WORK STATEMENT
Multi-Tiered System of Support (MTSS) for Social, Emotional, and Behavioral (SEB) Support and
Services in Secondary Schools Serving Military-Connected Students
1. General Information, Background, and Scope of Work
1.1 General Information: For school year (SY) 2022-23, the Department of Defense Education Activity (DoDEA) will provide PK-12 instruction to over 66,000 dependents of active-duty military and civilian employees. In the Americas, DoDEA operates 50 schools located in seven states, Puerto Rico, and Cuba. In Europe and the Middle East, DoDEA operates 64 schools located in Germany, England, Netherlands, Belgium, Spain, Italy, Turkey, and Bahrain. In the Pacific, DoDEA operates 45 schools located in Korea, Japan (mainland and Okinawa), and Guam. DoDEA also operates a full time K-12 virtual school option with teaching hubs in each DoDEA region: Americas, Europe, and Pacific. DoDEA's curriculum, resources and student achievement scores on standardized assessments compare favorably to those of high-performing US public school systems.
1.2 Background
In 2016 the National Institute of Food and Agriculture (NIFA) US Department of Agriculture (USDA) awarded a grant and DoDEA awarded a follow-on grant in 2019 to support research development on the emerging topic of harmful behaviors for military-connected students (e.g., sucide, problematic-sexual behavior in children and youth, etc.
In August 2019, DoDEA identified the need to develop an evidenced-based PK-5 framework in which the social, emotional, and behavioral (SEB) support and service needs of military-connected students and schools could be identified and intervened upon effectively.
Since the 2020-21 school year, DoDEA HQ’s Student Services Division has piloted a participatory coaching model for the implementation of a multi-tiered system of support (MTSS) for SEB support/services in four elementary schools. The coaching and implementation have demonstrated positive initial results to include building trust, expanding knowledge, and increasing implementation capacity for a sustainable framework of practice. The pilot program has improved equity, access, and academic engagement for the students who received support/services.
The School Resources Website (https://schoolresources.militaryfamilies.psu.edu) has been hosting materials to support educators who work with military-connected students. Currently, the website is the home to hundreds of resources that can assist teachers and other school personnel with helping at-risk students. As a part of this work, the School Resources website will continue to expand and reflect the needs of secondary schools. The MTSS Check Up Model (Hall & Moeller) is an evidence-informed, theory-driven framework that DoDEA created and that DoDEA is piloting under the current award using a community-based participatory research model/methodology.
Community-Based Participatory (CBPR) research is a methodological and epistemological approach to research that involves equal collaboration between researchers and members of a specific community. The aim of CBPR is to bring about social change by giving community members a voice in the research process and empowering them to address issues that are relevant to their lives. CBPR values community knowledge, expertise and experience and recognizes that communities have the right to shape the research that is conducted within their boundaries. This approach recognizes the importance of considering community perspectives, needs, and goals in the design, implementation, and dissemination of research results.
1.3 Scope of Work: DoDEA requires an expansion of the successful pilot elementary school program to the secondary level, continued development of online materials for military-connected schools, and the building of DoDEA’s capacity to sustain the program.
1.4 The contractor shall provide the following:
1) Expansion of the existing K-5 MTSS pilot program to include six secondary schools at the same installations: Camp Humphreys, South Korea; Spangdahlem Air Force Base, Germany; and Fort Bragg, North Carolina.
2) Qualified experts to deliver evidence-based professional learning, consultation, and coaching to build the capacity of school-level professionals and leaders working with DoDEA’s secondary students and schools as defined in PWS 3.2.
3) Ongoing development and dissemination of MTSS-related evidenced-based school resource materials that address the SEB needs of secondary schools serving primarily military-connected students and which will, thereby, expand the portfolio materials on the Clearinghouse for Military Family Readiness website.
4) Evaluation of the coaching and consultation model to determine its effectiveness, acceptability, and impact on secondary school personnel and students and the feasibility of expanding the pilot program systemwide using the MTSS Check-Up Model implemented in the K-5 pilot program.
5) Detailed reports and information in required deliverables that will allow DoDEA to continue this critical work in future contracts with qualified contractors. DoDEA will have the right to use any work funded and provided for under this contract.
6) A transition in and out plan to ensure that any future contractor or DoDEA personnel can continue this work for DoDEA if there is a future contract.
2 Requirements
2.1 MTSS for SEB Support and Services at the Secondary Level: Implement a pilot program to provide a multi-tiered system of support for social, emotional, and behavioral support and services at six DoDEA secondary schools located in North Carolina, South Korea, and Germany.
The tasks below are provided to help the Contractor gain a better understanding of the requirements.
The tasks are not all inclusive. The Contractor is expected to develop the total solution to meet all the requirements in accordance with a performance-based approach.
Supporting Tasks

Support goes beyond recruiting to include:
1) Participating and providing feedback from the initial site visit, goal setting meetings, and monthly coaching meetings.
2) Conducting in-person and virtual training activities.
3) Facilitating the creation and training of each pilot school’s MTSS team.
2.1.1.2 Project Implementation Plan: Provide a draft implementation plan to the COR. The COR will provide feedback within 20 business days of the post-award conference.
1) The plan shall possess at a minimum, the following eight sections
a. Definition of Goals and Objectives
b. Allocation of Resources
c. Planning Milestones & Timeline
d. Designation of Responsibilities
e. MTSS Check-up Model Application to DoDEA Secondary Schools
f. Identification of Contingencies and Backup Plans
g. Evaluation
h. Description of Success
2) The plan shall also include the following five subcategories:
a. Secondary Level Adaptation: Adapt the current pilot coaching model to fit the needs of middle and high schools but retain the same structure to include MTSS team staffing recommendations, MTSS meetings, monthly coaching, and annual trainings.
b. Annual Meetings with the Elementary Pilot Schools: Meet with current elementary pilot schools on an annual basis to continue with troubleshooting and to provide updates regarding ongoing sustainability of MTSS practices. Note: These meetings can be in-person if they coincide with in-person visits to the adjacent secondary school sites. Otherwise, they shall be conducted virtually (e.g., via MS Teams) on dates and times the COR in consultation with the schools will schedule.
c. Website resource transfer and development: Include a plan to transfer the K-12 DoDEA MTSS professional learning resources and training to support the development of a DoDEA MTSS website. DoDEA must have rights to use, add to, and modify websites developed under the contract.
d. Leadership Meetings: Present and facilitate both a bi-annual (semesterly) update to district, regional, leaders and an annual update for HQ leadership. Provide the medium through which each meeting occurs (preferably MS Teams) and record each meeting’s minutes. Finalize the minutes based on written feedback from the COR. Prior to each meeting, perform a dry run of the meeting’s presentation. Finalize each presentation based on feedback from the COR. Note: Each meeting is expected to last 1-2 hours with the first 30-45 meetings consisting of the Contractor’s presentation and the remaining time for Q&A/discussion.
