1. Provide and incorporate the Government's response to questions submitted by Offerors in response to RFP 2151136564;

3. The Contractor shall:

a) Section C: As attached, replace pages 8 thru 81 with pages “8 thru81 Rev 6/7/13”. In order to keep the formatting and avoid renumbering the entire solicitation, the remaining pages after page 81 of Section C have been renumbered to 81-1, 81-2, 81-3, etc to complete Section C. Section D commences with page 82.

b) Replace page 168 with page “168 Rev. 6/7/13” as attached.

c) Replace page 172 with page “172 Rev. 6/7/13” as attached.

d) Replace pages 174-175 with pages “174-175 Rev. 6/7/13” as attached.

e) Replace RFP 2151136564 Appendices (pages 179 – 204) in its entirety with revised “Appendices Rev. 6/7/13 (pages 179 -208)” as attached. In addition, the following has been added for clarification:

The revised Appendices contain the following updates:

i. Part 1 refers to the “General Contractor’s Statement of Qualifications”

ii. Part 2 refers to the “Design Team’s Statement of Qualifications”

iii. The attached appendices should be used to answer the Evaluation Factors required as per the RFP

iv. Appendix C is required for submission of resumes for key personnel. At a minimum, resumes for key personnel identified in Appendix C should be included with your proposal.

f) Insert page 161a, entitled, SECTION K -Representations and Certifications. Prospective contractors shall complete electronic annual Online Representations and Certifications Application (ORCA) at https://www.sam.gov/, in conjunction with required registration in the Central Contractor Registration (CCR) database. A printed copy of the ORCA and CCR are required with the Offeror’s proposal. These pages not are applicable to the 100 page limit.

1. Question: Regarding the number to submit: On page 168 it is states to submit 1 original and 3 copies, and pg 170 it states 1 original and 4 copy—please clarify.

Government’s Response: Offerors are required to submit one (1) original and four (4) copies of the proposal, for a total of five (5) proposals.

See Amendment 1.

2. We are often allowed to use Past Performance Questionnaires that are signed and dated by the Owner that are on USACE forms, as repeated requests to CORs receive complaints…may we include a PPQ (on USACE or DS forms that respond the same/similar questions as included in the RFP) that is signed and dated in 2013 and include it in our bid?

Government’s Response :No, all offerors are required to submit the required forms as specified in RFP-2151136564.

3. Please verify this is not a Multiple Award Contract that only a single award will be made on this RFP.

Government’s Response :Please see Section L, Clause 52.215-1, (f)(6). The Government intends to award up to five (5) contracts resulting from this solicitation.

4. The RFP states the estimated range of Task Orders awarded will be from $25,000 to

$5,000,000. What is the maximum value of this contract over the Base plus 4 option years?

Government’s Response : $85 million is the total estimated value of this acquisition, inclusive of all contract awards and option periods.

5. In the RFP documents we did not find the past performance evaluation forms to be filled out by the clients.

Government’s Response : The Past Performance Questionnaire can be found as Attachment F; please see pages 137-139 of the solicitation document – page numbers located at the center bottom of each page.

6. Up to ten contractors will be invited to submit technical and price proposals in Phase Two for a Design Build or Design-Bid-build project. Please provide the number of contracts you will award at the conclusion of Phase II.

Government’s Response : Please see the Government’s response to Question 3.

7. Since the prior past performance references/evaluations were for the FBI within the past year

- for those that does not want to be “bothered” is it acceptable to use these same evaluations, with their authorization, on the new RFP PPRQ form?

Government’s Response : Please see the Government’s response to Question 2.

8. Page 168 Instructions for Preparing Proposals:

Item (a) states Offeror is to submit original and 3 copies. However, the SF1442 form and page 170 of the RFP state 4 copies. Which is the correct number of copies?

Government’s Response : See the Government’s response to Question 1.

Item (d) states Offeror is to complete Section K. Is this referencing Section K - Representations and Certifications? And if so, if Offeror has filed ORCA is completion of paragraph (d) sufficient for this submission?

Government’s Response : Yes, please submit a copy of your ORCA filing.

9. Page 171, Factor 1 - Corporate Experience, Subfactor 1.A: Construction Team

Item a - Instructions state to use the attached "General Contractor's Statement of Qualifications" form to submit up to five (5) relevant projects. Is this the form on page 180 labeled Part 1?

Government’s Response : Yes, please see Amendment 1.

10. Item b - Instructions state to use the attached "General Contractor's Statement of

Qualifications" form to submit up three (3) projects performed by both the construction and design team.

Government’s Response : See Question 11.

11. Are we to use the re-submit the same form (presumably page 180 labeled Part 1) in its entirety as above under item a and list the three projects performed by both the construction and design team under section 2 - Experience? or, use the form on page 200, labeled Part 1?

Government’s Response : Yes, use the first page of Part 1 of the General Contractor’s Statement of Qualifications to submit the three (3) projects both the construction and design teams have performed together. Please use the forms in resubmitted in Amendment 1.

12. Page 172, Subfactor 1.B - Design Team

Item a - Instructions state to submit no more than three (3) A/E firms and identify the projected role of the firms in the "Design Team's Statement of Qualifications" form. Is this the form on page 200, labeled Part 1? Is there another form?

Government’s Response : See the answer to question 11

13. Does each A/E separately complete the form?

Government’s Response : Yes

14. Item b - Instructions state to "submit up to three (3) and no more than five (5) projects" by each A/E firm. However, if the "Design Team's Statement of Qualifications" is indeed the form on page 200, labeled Part 1, it is stated on page 201 to submit a maximum of three 3 projects. How many projects are required from each A/E? Maximum of 3 or 5?

Government’s Response : Maximum of three (3)

15. Both sections state factors for consideration include: 1- Corporate Experience (1a -construction team; and 1 b - Design Team); 2 - Safety; 3 - Management Plan; and 4 - Past Performance (1a - construction team; and 1 b - Design Team). However, Appendix C, page 188, requires resumes of the Offeror's construction team's key personnel. Is Key Personnel considered a separate evaluation factor?

Government’s Response : No, Key Personnel is not a separate evaluation factor but is considered relevant to Factor 1 “Corporate Experience”.

16. Page 204, Appendix B - Reference: 4.a.b.c - Resumes

Where is 4.a.b.c - Resumes stated in the RFP?

Government’s Response : Appendix B has been revised to delete “4.a.b.c”. Please see Amendment 1

17. Item 6.0 - Related Experience - States "Must cover, at a minimum, the time period identified in Statement 4a(1) and b(1)". Where this statement is referenced in the RFP documents?

Government’s Response : This has been addressed in Amendment 1. Please see Amendment 1.

18. Item 7.0 Project Experience - states "Identify project experience requested in the Statement at

4a(2)(3) and 4 b(2)(3)". Where this statement is referenced in the RFP documents?

Government’s Response : See Amendment 1

19. Is the Government requesting resumes on page 204, Appendix B for the Design Team's Key

Personnel?

20. Appendix D - Wire Diagram

Instructions state "wire diagram should include the entire project team, subcontractor key personnel and supervision". In that the specific work is not known at this time and the contractor is required to obtain competitive pricing on all materials/equipment not furnished by itself, identification of specific subcontractor key personnel cannot be determined at this time. Can trades to be subcontracted be identified in general terms and included on the wire diagram instead?

21. Appendix 6 - Firm's Written Safety Plan

Instructions state to "submit only one copy with the submittal package". Does this mean submit only one copy of the Safety Plan with the Original copy of the technical proposal?

The other copies of the technical proposal do not require inclusion of the safety plan?

Government’s Response : See Amendment 1.

22. Appendix I - Written Assurance Program

Instructions state to "submit only one copy with the submittal package". Does this mean submit only one copy of the Assurance Plan with the Original copy of the technical proposal?

The other copies of the technical proposal do not require inclusion of the Assurance plan?

23. Factor D - Past Performance

The RFP states both Construction Team and Design Team completed Past Performance Questionnaires are to be “mailed or faxed from the client directly to the Government”. Can completed questionnaires be emailed directly to the contracting officer and contracting specialist? If not, is there a fax number?

Government’s Response : Yes, PPQ’s can be emailed or faxed to the Contracting Officer’s attention.

24. In that some clients may require additional time to complete the PPQ forms in addition to performing their daily work, can the requirement to submit the completed questionnaires no later than five business days (6/10/13) be extended to 6/17/13?

Government’s Response : Yes, the past performance questionnaire submission requirement has been extended. See Amendment 1.

25. On PART 1 form, page 185, section 12 - General Contractor's Comments, the document states "Respondents are reminded to include a copy of each requested Team Member's Statement of Qualifications with this Qualification Document". This is also stated on page 202 of the second document labeled PART I.

26. Is the Government asking that the Offeror and its three (3) A/Es to also submit a Statement of

Capability document in addition to the technical proposal? If so, can this be excluded from the 100-page count?

Government’s Response : Yes, all must complete the Statement of Qualifications Forms. No, this cannot be excluded from the 100 page count.

27. Appendix N - Reference: Additional Information

Is this section available to the Offeror to provide additional relevant information regarding capabilities of the Construction and Design teams? Is this 10 page section considered part of the 100-page proposal count?

Government’s Response : Yes, this section is available for additional information. Yes, the 10 pages section would be considered part of the 100-page proposal count.

28. Is the completed copy of the Central Contractor Registration part of the Phase One 100-page count? Can this be excluded?

Government’s Response : No, the Central Contractor Registration requirements is not part of the Phase One 100-page count.

29. Is Section K part of the 100-page count? Can this be excluded?

Government’s Response : No, Section K is not a part of the 100-page count.

30. Factor D - Past Performance (for the construction and design team), item 2 - states "include with your proposal submission a copy of the Past Performance Questionnaire (PPQ) Cover Sheet (page one of the form) which contains the point of contact information for each client questionnaire".

The PPQ in the RFP Attachments does not contain a Cover Sheet with point of contact information for each client. The form starts on page 137 and begins with specific questions to the client. Will the Government provide a revised form or should the Offeror provide its own cover sheet?

Government’s Response : There is no cover sheet. Offerors may provide its own cover sheet. All proposal information must be submitted to the Contracting Officer of the solicitation.

31. Under Subfactor 1.B - Design Team, item b, the Offeror is to submit up to 3 projects but no more than 5 projects for each A/E:

Government’s Response : Please see the Government’s response for question 14.

• Is there a specific Appendix Form for the A/Es to use? The information contained in Appendix A on pages 186 and 203 appears to be aligned to construction questions?

Government’s Response : Yes, please see Amendment 1

• Is there an Appendix B - Detailed Description form for the A/E projects?

• Is there an Appendix C - Resumes form for the A/Es Key Personnel?

32. The RFP Section M Evaluation Factors for Award M.4 Phase One states proposals are limited to 100 single sided pages. Please clarify if the required Attachments (i.e. Safety Appendix G – 1 copy of firm’s written safety program and Quality Assurance Appendix I – 1 copy of written Assurance Program) are included in the 100 page count?

33. In section M, page 171, A. Factor 1-Corporate Experience it states to use the Contractor’s

Statement of Qualifications forms to submit our projects. We don’t see any forms named that.

Government’s Response : The titles have been added. Please see Amendment 1

34. On page 137-139 of the RFP there is a past performance reference questionnaire. Is this the form we’re to send to our references and they then in turn send it back to directly to you?

Government’s Response : Please see the Government’s response to question 23.

35. In section M, page 172, Subfactor 1.B- It states to use the Design Team’s Statement of

Qualifications forms to submit A/E relevant projects. We don’t see any forms names that.

Government’s Response : Please see Amendment 1

36. On page 191, Appendix F, Reference: Notarized declaration of surety, is there any particular information that needs to be included in the declaration from our surety?

37. On page 168, Instructions for Preparing Proposals, it states offeror’s must complete and return section k by marking boxes or filling in the blanks as required. There is no section k included in the RFP. Can you please provide?

Government’s Response : Yes, please see Amendment 1 – page 161A for Section K.

38. On page 172, item 2. Include with your proposal submission a copy of the Past Performance Questionnaire Cover Sheet (page one of the form) which contains the point of contact information for each client questionnaire. There is no place for client contact information.

Will there be an amended form?

Government’s Response : Please see the Government’s response to Question 30.

39. Forms mentioned in the RFP are missing or not labeled (i.e., design team’s statement of qualifications”) is not in the RFP or labeled.

Government’s Response : Please see Amendment 1

40. There are two (2) appendices A’s (page 190 & 207). Please clarify the correct form or if one is for the construction team and the other for the design team?

Government’s Response : Please see Amendment 1.

41. There also two (2) forms stated for resumes, (pg. 192 & 208). Please clarify the correct form or if one is for the construction team and the other for the design team?

42. The RFP (section d-factor 4.a.1.2) referenced a “past performance questionnaire cover sheet”. Please advise what form/appendix is the PPQ cover sheet.

Government’s Response : Please see the Government’s response to question 30.

43. The FBI intends to shortlist ten (10) firms for phase 2. It is not clear how many contracts are to be awarded based on the phase two submission.

Government’s Response : Please see the government’s response to question 3.

44. In lieu of the past performance questionnaire in the RFP, will ccass/cpars suffice in lieu of this form. As the navy & other government agencies typically do not complete the contractor past performance questionnaire. These ratings are publicly posted for review by any government agency and provide more in depth information (see sample attached).

Government’s Response : Please see the Government’s response to question 23.

In addition to my previous question, I also was wondering if the past performance questionnaires could be emailed from the client to the government? Can you clarify the acceptable email/fax number/mailing address to send these to?

Government’s Response : Please see the government’s response to question 23.

45. Due to the complexity of the required proposal information, we request that a pre-proposal conference be held so that we could better understand the requirements.

Government’s Response : There will not be a pre-proposal conference for Phase I.

46. This project is listed as being a “Small Business” set-aside. Please confirm that joint ventures between large businesses and small businesses are not permitted to submit on this

RFP.

Government’s Response: Joint ventures between large businesses and small businesses are not permitted to respond to this RFP.

47. Please confirm that Small Business Administration Mentor-Protégé arrangements are also not permitted to submit on this RFP.

Government’s Response : The Mentor-Protégé arrangements that are approved by the Small Business Administration are permitted to respond this RFP. However, the Mentor-Protégé arrangement must be approved prior to proposal submission.

48. Section H.29 of the RFP (page 109) states that the maximum quantity that may be ordered under this IDIQ contract is $5 Million, and furthermore states that this maximum applied to the Contract’s base year and all four option years. Clause 52.216-19 (b) (1) states that the maximum for any single order is $5 Million. Clause 52.216-22 (c) states that there is no limit on the number of orders that may be issued. Please clarify if there is a maximum for the total dollar amount of all orders awarded to one company per year or for the total duration of the contract.

Government’s Response : These clauses are referring to the each task/delivery order awarded.

49. Section H.2, Clause 52.222-17 “Non Displacement of Qualified Workers” discusses “Service

Employees”. Since this is a MACC construction contract and not a “service” contract, please confirm that this clause does not apply to this contract.

Government’s Response : This clause does not apply. Please see Amendment 1.

50. Page 147, Item (l), 1 – states that security clearances shall only be issued to US Citizens.

Please clarify if this is only for the Interim Clearances or if it is for ALL clearances for all workers on this contract.

Government’s Response : The US Citizens requirement applies to all clearances.

51. Page 168, Item (a) states that we are to submit an original and three copies. The SF-1442 and Page 170 state we are to submit an original and four copies. Which is correct?

Government’s Response : Please See the Government’s response to Question. 1 See Amendment 1

52. Page 172 requests EMR information from years 2009, 2010 and 2011. What about 2012?

Government’s Response : Submit EMR for 2011, 2010, and 2009

53. Pages 137 to 139 contain a Past Performance Reference Questionnaire. Can you please provide this in editable Microsoft Word format so that our references could complete the forms electronically?

54. Pages 179 to 204 provide many forms to be completed. Can you please provide these in editable Microsoft Word format?

Government’s Response : See the Government’s response to question 53.

55. Page 171, Subfactor 1.A states to provide three projects that the construction and design team have performed together. Subfactor 1.B states to provide a list of no more than three A/E firms. Is this intent of 1.A to submit one project from each of the A/E firms?

Government’s Response : Please see the Government’s response to Question 14. No that is not the intent. Submit a maximum of 3 projects for the A/E requirement.

56. Can we submit three projects from one A/E firm if we think they are the most relevant and none from the other two A/E firms? Would this be evaluated unfavorably compared to one project for each A/E firm?

Government’s Response :Yes, you can submit maximum of three projects for the A/E requirement.

57. Are we to submit three projects in Subfactor 1.A from each A/E firm, for a total of 9 projects?

Government’s Response : See the answer to question 56

58. Subfactor 1.B (b) states to provide 3-5 projects for each A/E firm. If some of these projects were submitted in Subfactor 1.A should they be resubmitted here? Can they be cross-referenced to 1.A? Are these 3-5 projects to be separate from the ones submitted in 1.A?

Government’s Response : Please see the Government’s response to question 14.

Offerors are responsible for determining the presentation of the information.

59. Factor 4 requires the Past Performance Questionnaires to be returned 5 days prior to the due date for Phase One. Until we get our questions listed above answered, we are not certain which projects to submit and who to obtain references from. Therefore we request at least 2 weeks to obtain these Questionnaires from the date the above questions are answered.

Government’s Response : See Amendment #1.

60. Pages 180 to 185 contain a form with a lot of requested information. We cannot find reference in Section M if this form and these pages are required to be submitted in Phase

One. Please clarify. If they are required, the page limitation listed on Page 170, M.4 of 100 pages is not sufficient.

Government’s Response : Part 1 and Part 2 in Amendment 1 are required to be submitted as per section M.4.A.1.A and M.4.A.1.B.

61. If these forms are required, Item 5 “Safety” requires a copy of the firm’s written safety program to be submitted. Our safety plan is almost 200 pages long. This will exceed the 100 page maximum. Is a safety plan required to be submitted? Factor 2-d only requires a two page narrative. Please clarify.

Government’s Response : See Amendment 1, only a safety narrative is required

62. Item 5 “Safety”, (c) requires a letter from our insurance carrier. This isn’t mentioned in

Section M. Is this required?

Government’s Response : Yes, see Amendment 1. Also, see the Government’s response to question 36

63. Item 5 “Safety”, (c ) requests EMR information for 7 years, but Section M only requires three.

Government’s Response : No question.

64. Item 6 requires a letter from the insurance carrier for insurance limits. This isn’t mentioned in Section M. Is this required?

Government’s Response : Yes, please see Amendment 1. Also, please see answer to question 36

65. Item 12 requests further explanations and written qualifications. These are mentioned in

Section M. Are they required?

Government’s Response : No

Government’s Response : No, this is to be used at the Offeror’s discretion.

70. Pages 200 to 202 appear to be forms for the A/E firms to complete. These are not mentioned in Section M as being required. Are Pages 200-202 required to be submitted?

71. If so, Item 4 requires Key Staff Resumes. These are not mentioned in Section M. Are they required?

72. Appendix B (page 204) requires resumes. They are not mentioned in Section M. Are they required?

73. RFP Page 108, Section H.27 Subcontracting Restrictions. This paragraph states that subcontracting of work can be procured as long as the subcontracting work is approved in advance by the Contracting Officer. How will this approval process be handled? Will approval have to be arranged during the bid process of each task order or after the task order is awarded?

Government’s Response : For initial award, subcontracting will be considered as a part of the initial award. Any subsequent subcontracting will require approval prior to performance.

74. Throughout the RFP, it is mentioned that the Phase 1 technical proposals will be evaluated on relevant projects. Can we receive information on what a relevant project for this contract will be?

Government’s Response : Question is too vague to address.

75. RFP Page 104, paragraph H.16 Document Control talks about the contractor having a Security Officer. Can we receive information on the criteria of what the Security Officers duties are to be for this contract?

Government’s Response : The Contractor’s Security Officer is responsible for ensuring that security policies and procedures are met. No access to classified information is anticipated during the course of this contract; however, all documentation relevant to FBI procurements – including drawings, specs, project details, etc. – are considered sensitive and must be safeguard by the Contractor. The Contractor’s Security Officer will be responsible for the safekeeping of FBI information throughout the project and for a specified time thereafter, ensuring no sensitive information is made public.

76. Concerning the submission of relevant projects under Factor 1 (Corporate Experience), sub-factor 1.A (Construction Team), if our team submits, for example, three (3) task orders under one (1) single IDIQ contract, will this count as one (1) relevant project towards the maximum of five (5) relevant projects, or will this count as three (3) projects submitted?

Government’s Response : This would be considered three (3) projects.

77. On page 168, under Instructions for Preparing Proposal (d) references Section K, I could not find Section K in the RFP.

78. On page 174, under Past Performance, states that Completed Past Performances can be mailed or faxed, I could not find a fax number listed.

79. Can Past Performance Questionnaires be e-mailed?

80. Past/Current Projects with the FBI: We would like to use this project, but we have been instructed not to use it for to show past experience or to publicize it. Of course we have complied with that in the past, but I am thinking that it might be acceptable to use it for this proposal ONLY since we are sending it to you, not an outside agency. Would it be acceptable to use a past or current project in this proposal? If so, who should we send the PPQ to?

Government’s Response : Offerors may submit past performance information pertaining to relevant FBI projects. This information may be sent to the appropriate Contracting Officer or Contracting Offer’s Representative.

81. Basically the same issues are involved on this project. Can you provide clarification / guidance for the following issues: Can we use the project as evidence of experience for this proposal ONLY since we would be submitting it to the FBI, not an outside agency? If so, who should we send the PPQ to since the Contracting Officer has retired? My inclination it so send it to you since you attended one of the project meeting, but wanted to verify that with you before just sending it over.

86. The RFP states work is to be performed in various locations including three named locations;

the Headquarters building in Washington D.C., the Academy in Quantico, VA and the CJIS complex in Clarksburg, WV. Is this Contract limited to these three named locations or can we expect to perform projects in other areas of the country?

87. In the RFP there is some confusion as to how many copies of the proposal are to be submitted. On page 168 there is a request for 1 original and 3 copies, pg 170 and the 1442 state 1 original and 4 copies of the proposal. How many copies do we need to send in?

101. Please confirm the Professional Liability Insurance requirements for the Design Firm listed in the last line of the second page of the Design Team’s Qualification Statement (Page 201 of the RFP PDF). We suspect that “$20M in the aggregate” is a typographic error as this is well in excess of what any small business design firm might carry.

102. Paragraph H.2 52.222-17 on page 92 talks about utilization of employees under the predecessor contract. Is there a previous contract? If so, what was the total amount award over the life of the contract and how was the work broken down?

Government’s Response : No, there is no predecessor. This is a new requirement.

103. On page 156, Paragraph 1.21 52.243-4 (3) defines overhead as basically the field office staff and the field office expenses. How does the government define home office costs such as accounting, IT, and company officers? How is the contractor reimbursed for these costs?

Government’s Response :Costs should be allocated as either Direct Costs or Other Direct Costs which are allowable in accordance with the Cost Accounting Standards.

104. On page 156, Paragraph 1.21 52.243-4 (4) only allows a 5% commission on work performed by other than the Contractors own forces, with no overhead or profit. How is the labor for the preparation of the change proposal, coordination and the review of subcontractor’s proposals, schedule updates and impacts, preparation of the necessary change order paperwork, etc. to be compensated, as a direct cost?

Government’s Response : The development of the Offeror’s proposal will be at the discretion of the Offeror.

105. On page 157, Paragraph 1.21 52.243-4 (5) states that the prime contractor is to perform work at no additional fee, overhead, cost or commission for themselves if the first tier subcontractor receives a commission for a 2nd tier subcontractor. Does the government expect the Prime contractor to work for free?

Government’s Response : It will be a business decision of the Offeror.

106. Pages 168 & 169 describe the Evaluation Process and Criteria. Both sections state that the contract will be awarded to the highest ranked offeror. Does this mean that the contract will only be awarded to one Prime contractor? If not, how many contractors in total will be selected? What is the basis for evaluation and award for additional other contractors?

107. The SF 1442 and paragraph M.4 PHASE ONE on page 170 indicate that an original and four (4) copies of the proposal are to be submitted, but Instructions for Preparing Proposals paragraph (a) on page 168 says to submit an original and three (3) copies. Please clarify.

114. On page 172, Subfactor 1.B – Design Team, paragraph 1.a refers to a “Design Team’s Statement of Qualifications” form. No form was included with that title within the solicitation.

115. Page 174, Factor 3 1.a, last sentence asks us to identify individuals that hold certifications or certificates relevant to managing this contract. Pleas identify what certifications or certificates are considered relevant to the contract?

116. Is it possible for the Government to provide a more detailed guide to the Appendices that are included with the solicitation package beginning on page 179? Specifically:

• Appendix D - This requests a wire diagram, which is to include subcontractors and their relationship to the GC. Since we do not have a scope of work, and the subcontractors needed cannot be defined, is this wire diagram intended to be generic in nature? Or is this intended to be specific to the seed project in Phase 2?

127. In the RFP Cover Letter, the “Special Notice states that “…proof of mailed proposal submission…must be transmitted to the FBI contracting officer…”. What means of mailing (e.g. US Postal Service, FEDEX, private courier, etc.) are acceptable?

Government’s Response : Mailing and shipping methods are left to the discretion of the offeror; however using any of the four primarily recognized mail couriers (USPS, UPS, FEDEX, or DHL) is preferred. Please note: NO HAND DELIVERIES

ARE ACCEPTED AT ANY FBI LOCATION.

128. In the RFP Cover Letter, the fourth paragraph refers to “the submission letter”. Is this submission letter included within the 100 page limit specified in Section M4 on page 174/208 of the RFP?

Government’s Response : No, the submission letter does not count towards the page limit.

129. In the RFP Cover Letter, offerors are directed to submit four documents, properly executed:

a. Completed SF1442…

b. Technical Proposal

c. Past Performances References Information Form, completed

d. Completed copy of the contractor’s Central Contractor Registration The term “Past Performances References Information Form” does not occur elsewhere in the RFP, though we not that there is a “PAST PERFORMANCE REFERENCE QUESTIONNAIRE” – see question 14 below. To which specific form is the term “Past Performances References Information Form” referring?

Government’s Response : The Past Performance Questionnaire can be found as Attachment F; please see pages 137-139 of the solicitation document – page numbers located at the center bottom of each page.

130. Section B.4 General Description and Requirements (f) states that “The estimated range in values of Tasks Orders awarded under this contract will be from $25,000 to $5,000,000.”

Elsewhere the text makes a similar statement but has it applied to the contract as a whole (e.g.

section H.29). Is the $5,000,000 upper limit applied to both the contract as a whole and any Task Order (meaning that a single Task Order might consume the whole contract), or is the $5,000,000 upper limit applied any single Task Order meaning that the contract as a whole could be larger?

131. In the statement at the end of the second paragraph of section B.1 General, “The FBI reserves right to compete these construction/renovations requirements, on an as-needed basis, with other task order contractors under contract”, does the term “contractors” here refer to other contractors on this particular contract (i.e. this would then be a multiple award contractor) or does the term refer to other FBI construction contractors in general, under other contracts?

Government’s Response : Please see the Government’s response to question 3. However, the Government reserves the right to use any contract vehicle determined to be in its best interest.

132. If the answer to question 5 above is that contractors outside of this contract (whether it is single or multiple award) can compete on Task Orders under this contract, how should we then understand the language in section C.3 which states that “Competition for task orders is limited to those awardees, under this contract”?

Government’s Response : If this multiple award contract vehicle is utilized, then only the contractors awarded a contract from solicitation would be allowed to compete for the task orders.

133. The multilevel logic/style/hierarchy of the section and subsection headings in the document changes at section C.6. Prior to this the style was, for example, C.4 (a). At section C.6 the style changes to C.6.1 (a), i.e. the third level changes from a letter to a number. The subsections then proceed as: (a), (b), (c), (d), c, 1, 2. We find this logic difficult to follow. Please clarify the logic/style/hierarchy of the section and subsection headings in section C.6.

134. In section C.7 the logic/style/hierarchy of the subsection headings proceeds as 1, 2, 3, 4, 5, e.
