JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. The contracting activity is the Naval Facilities Engineering Systems
Command Southeast (NAVFAC SE).
2. Description of the Action Being Approved. The action being approved under this
Justification and Approval (J&A) is a modification to extend current contract N6945020D0001 for six months, in accordance with Federal Acquisition Regulation (FAR) 52.217-8 Option to
Extend Services. This is an indefinite delivery/indefinite quantity contract for architect-engineer services in the area of operations of NAVFAC SE. The contractor is Toland & Mizell Architects, Inc., 590 Means St NW Ste. 200, Atlanta, GA 30318-5799.
3. Description of Supplies/Services. The services to be performed include architect-engineer design and engineering services for design support for various facilities-related projects and other projects in the area of operations of NAVFAC SE, including but not limited to Military
Construction (MILCON) projects involving new construction, repair, and alteration of facilities.
The period of performance of this action is 6 February 2025 to 5 August 2025.
No additional capacity will be added to the contract.
4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(2) Unusual and
Compelling Urgency, as implemented by FAR 6.302-2.
5. Rationale Justifying Use of Cited Statutory Authority. In the past six months, over
$56,000,000 in architect-engineer work has been awarded. Nine Indefinite Delivery/Indefinite
Quantity contracts (IDIQs), including this one, are in-place with approximately $56,000,000 remaining in capacity. Over $10,000,000 of capacity remains on this contract. Nine new IDIQs are being procured currently, but it is anticipated that it will be six months until one of them is awarded. Losing this contract’s capacity will lead to unacceptable delays in fulfilling the agency’s requirements. Capacity is needed to support the newly-added quick-turnaround Fiscal
Year 2025 Disaster Recovery projects in addition to congressionally-approved Military
Construction projects with precise schedules and other mission-critical projects. This action is not a result of lack of advance planning by the requiring activity. The requiring activity has been in procurement of new IDIQs to obtain additional capacity since April 2023. However, due to program changes to support mission-critical execution resulting in an increased number of other contract actions needed and a decreased workforce, the IDIQ procurements have extended beyond the planned timelines.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. Upon approval of this J&A, the proposed action will be synopsized on the Government wide Point of
Entry (GPE) as a sole source extension of contract N6945020D0001 to Toland & Mizell
Architects, Inc. No additional market research was conducted because it is not practicable. Nine new IDIQs are being procured currently, six of which used full and open competition and three of which are small business set-asides.
7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the cost to the Government for services covered by this J&A will be fair and reasonable. No new capacity will be added as a result of this action. The Government anticipates use of the current rates specified in the contract for the fifth year of the contract for work until the remaining capacity is used up.
8. Actions to Remove Barriers to Future Competition. Nine new IDIQs are being procured currently, six of which used full and open competition and three of which are small business set-asides. There are currently no further actions required to remove barriers to future competition.
The IDIQs are anticipated to be awarded in the fourth quarter of fiscal year 2025 and each quarter of fiscal year 2026. NAVFAC SE will proceed as expeditiously as possible to prevent any additional sole source contract actions.
