SECTION M - EVALUATION FACTORS FOR AWARD
M.1 Basis for Award - Best Value Tradeoff
The Government intends to award a Firm-Fixed-Price contract to the responsible quoter whose quotation represents the best value to the Government, considering Technical Capability and Price.
Award may be made to a quoter other than the lowest-priced quoter if the Government determines that the additional technical value or benefit offered warrants the additional price.
The Government intends to evaluate quotations and make award without discussions; however, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.
M.2 Evaluation Factors
The following factors will be evaluated:
Factor 1 - Technical Capability
The Government will evaluate the extent to which the proposed commercially available patent database subscription meets the requirements of the Statement of Work.
The evaluation will consider the capabilities and functionality of the proposed subscription, including:
2031ZA2600049 Online Global Patent Database Subscription 18
Patent search capabilities and functionality;
U.S. and international patent coverage;
Historical depth of patent information;
Saved searches and research folders;
Analytics, charting, and visualization capabilities;
Patent images and translation capabilities;
Export and alert capabilities;
Data retention and backup practices, including the length and/or definition of long-term retention offered;
User access and licensing;
Training; and Technical support.
The Government may consider differences in the capabilities offered by quoters in determining the relative technical merit and benefits of each quotation.
Factor 2 - Price
The Government will evaluate the quoter's proposed Firm-Fixed Prices for the Base Period and all Option Periods.
For evaluation purposes, the Total Evaluated Price will be the sum of the Base Period and all four Option Periods.
Evaluation of option prices does not obligate the Government to exercise any option.
M.3 Relative Importance
Technical Capability is more important than Price. The Government will consider the additional technical value or benefit offered in relation to any associated price premium. As quotations become more technically equivalent, Price may become a more significant factor in the best-value determination.
M.4 Evaluation Approach
The Government will assess the quality, relevance, and credibility of the information submitted. The Government may consider information reasonably available to it when validating experience, qualifications, responsibility, and price. The source selection decision will document the rationale for the tradeoff and why the selected quotation represents the best value to the Government.
