Offeror’s response must clearly indicate the capability to meet all specifications and requirements in the Performance Work Statement. Offeror shall not simply rephrase or restate the Government's requirements, but shall provide its rationale explaining how the Offeror’s approach will meet the BEP’s requirement. Responses that do not meet the specifications and requirements specified in this solicitation will be determined non-responsive and will not be evaluated further. Simply stating “contractor will comply” or “equipment complies” is not a clear response. Failure to provide all specifications and equipment capabilities may deem the offer unacceptable. Unnecessary elaboration or presentation beyond that which is sufficient to present a complete and effective offer is not desired and may be construed as an indication of the Offeror’s lack of understanding or cost consciousness.

Offerors shall submit the following:

■ FACTOR I – TECHNICAL CAPABILITIES (15 PAGE LIMIT)

Offeror shall submit a written response for the equipment listed in Section 3.0 of the Statement of Work. Offeror shall provide technical description of the equipment. At a minimum, technical description shall include full specifications and capabilities of the product. Equipment specification and capabilities must address all required specifications in the Statement of Work.

Offeror shall also provide warranty information, training information, and delivery date for equipment. Brochures may be provided. However, brochures are not substitutes for not fully addressing the technical requirements. Failure to provide all specifications and equipment capabilities may deem the offer unacceptable.

■ FACTOR II – PAST PERFORMANCE

Recent is defined within the last five (5) years. Relevant is defined as work similar in size, scope, and complexity to the work identified in the SOW. Offerors must identify at least two

The contractor shall provide all personnel, equipment, tools, materials, supervision, and other non- personnel services necessary for the delivery, rigging, installation and associated services of the Plate Shutter Carousel. Offeror shall also submit Attachment E, Place of Manufacture (FAR 52.215-18) for proposed equipment and Attachment F, Certificate Regarding Lobbying.

Offeror’s price shall provide a full break down of all costs.

(ix) FAR 52.212-2 Evaluation—Commercial Items (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

■ FACTOR I – TECHNICAL CAPABILITIES

Offers will be evaluated on the Offeror’s ability to fulfill the contract based on:

The Offeror’s demonstrated understanding of, and ability to oversee and carry out, the objectives, scope, tasks and other requirements of the SOW and to perform at a level that meets or exceeds the BEP’s requirements. Therefore, the BEP will evaluate proposed equipment and services for technical acceptance.

5 | P a g e 2 0 3 1 Z A 1 9 Q 0 0 2 2 4

An evaluation rating of ACCEPTABLE or UNACCEPTABLE will be assigned upon completion of the evaluation. If the Offeror receives a report rating of “Unacceptable,” the Offeror will not be considered for award.

■ FACTOR II – PAST PERFORMANCE

The Government will assess the Offeror’s capability to perform under this contract by evaluating the Offeror’s past performance experience on previous same or similar contracts.

The BEP may contact any references provided by the Offeror during the evaluation process to verify recent and relevant experience and the level of performance. The BEP may, at its discretion, obtain and evaluate information from sources other than those provided by the Offeror, such as those found in the Past Performance Information Retrieval System (PPIRS).

In conducting a past performance evaluation assessment, the offeror will be assigned one of the ratings below:

An evaluation rating of ACCEPTABLE, UNACCEPTABLE, or NEUTRAL will be assigned upon completion the evaluation. If the Offeror receives a report rating of “Unacceptable,” the Offeror will not be considered for award.

■ FACTOR III – PRICE

The Government will evaluate price to determine fair and reasonableness using FAR 13.106- 3, techniques. Price evaluation will be based on the completeness, the accuracy, and reasonableness of the proposed prices to ensure that the Contractor understands the scope of work included in the solicitation. Price shall also be evaluated by assessing the responsiveness of the proposed price; by assessing the level of detail the Offeror provided pricing data for all requirements in the SOW, and assessing the traceability of the price. For the price data to be complete, the Contractor must provide all the data necessary to support proposed pricing. The objective of the price analysis is to ensure that the final agreed-to price is fair and reasonable.

As such, the Government will use any combination of the proposal analysis techniques stipulated under FAR Subpart 13.106-3 to aid in the price evaluation process.

BASIS FOR AWARD: Award will be made on the basis of the lowest evaluated price of offers meeting or exceeding the acceptability standards for non-cost (i.e., Technical and Past Performance) factors. An offer is technically acceptable if it is fully compliant with all of the requirements of terms and conditions herein. The Government will not award a contract on the basis of an unacceptable offer. Offeror’s proposed prices shall be evaluated to determine fair and reasonable pricing. The Government may issue multiple awards from this solicitation.

(b) Options for Preventive Maintenance Services have been included in this solicitation for the purpose of ensuring the upkeep of the equipment that is to the greatest benefit of the BEP. All option years shall be priced, and evaluated, individually. The Government is in no way obligated to exercise options unless it is in the best interest of the Government, to do so. A written notice of the intent to exercise an option will be presented when maintenance calls are

6 | P a g e 2 0 3 1 Z A 1 9 Q 0 0 2 2 4 deemed necessary.

(c) A written notice of award or acceptance of an offer mailed, or otherwise, furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(2) □ Have, □ have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property;

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).

(i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126). (iv) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract is the same as that used for these employees and equivalent employees servicing commercial customers.

(ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting Officer as required in paragraph (k)(3)(i) of this clause.
