3. 4.3. PROJECT ASSIGNMENTS, PROPOSAL REQUESTS, AND NEGOTIATIONS

Consultants will be selected for specific work, from a list that the County will maintain. The list will comprise all consultants selected as part of the RFP process, who have executed a personal services contract. As specific projects arise and funding is available, the County will develop a scope of work, select the appropriate category, and review the awarded firms in that category to determine the most qualified to meet the defined scope of work.

In selecting a consultant for a specific project, the criteria below will be used. Due to the variable nature of projects, the applicability of specific criteria and their relative weight will vary from project to project. The basis for the selection will be documented.

The selection criteria are:

A. EXPERIENCE: Has the consultant or project team successfully performed work, done studies, or received awards for work:

o within the same technological fields o of an equivalent level of technical complexity o of a similar magnitude

B. RESOURCES: Does the consultant and project team have (or have access to) the specific skills and equipment required for the performance of this specific work?

C. PROJECT KNOWLEDGE: Does the consultant or project team have specific knowledge relating to the project that makes it advantageous for the County to hire the consultant, for example:

o Work on the same or an adjacent section of road or land area within the last five years o Special or unique standards that are also required on this project

D. AVAILABILITY: Can the consultant deliver the services within expected time frames?

The County may request additional information, client work history (specific to the project) or conduct interviews with firms awarded in the category to assist in this determination. The County will then request a written proposal and price proposal from the most qualified firm and enter into negotiations with the Firm. In the event that the County cannot successfully complete the negotiations, the Firm will be formally set aside and negotiations will resume with the next most qualified Firm.

Upon successful negotiations, a Work Assignment (WA) will be issued. The WA will contain the scope of work, timeline and fees to be applied from the schedule response to this RFP, as well as any other required documents. Contingent upon the appropriate approval by the County the WA will be executed by both parties.

4. 4.4. WORK ASSIGNMENT

A. Response time to testing requests shall not exceed four (4) hours.

B. Work continuously on the assignment as directed by the Principal Engineer.

2026 Geotechnical and Materials Testing Services for Capital Project Services

C. Return to a project as soon as feasible, but no later than the beginning of the next workday, after receiving verbal notice from the County to resolve apparent issues.

5. 4.5. CONSULTANT RATES AND PAYMENT TERMS

A. Rates for services will be established in the multi-year contract executed with each successful consultant. The selected consultants will submit a Functional Consultant Rate Schedule based on their maximum billing rates. This rate schedule should include position titles and maximum billing rates – no employee names. This rate schedule will constitute the current Functional Consultant Rate Schedule and be in effect from July 1, 2026, through June 30, 2031. Rates (for labor only) will be adjusted annually based on the update to the CPI-U West Region All Items Index (CPI-U). The updated schedule will become the new current Functional Consultant Rate Schedule, superseding the previous schedule.

B. Any project contracts or amendments for work will use the current Functional Consultant Rate Schedule. The contract rates will be adjusted based on the actual CPI-U rate. The total payments may not exceed the authorized amount of the agreement, regardless of increases in the CPI-U.

C. Rates on Consultant Invoices should be the individual employee’s actual rate plus the profit and overhead cost, up to but not exceeding the maximum Functional Consultant Rate as provided in the Functional Consultant Rate Schedule. All rates should be rounded to the nearest penny and not extend beyond two decimal points.

D. When a consultant begins scoping a project, they will provide the list of sub-consultants for the project which will be used from preliminary design through construction. A Functional Consultant Rate schedule for each sub-consultant will be supplied when the fee schedule is submitted by the prime, including the sub-consultant’s estimated work.

This rate schedule should include position titles and maximum billing rates – no employee names. These rates for the sub-consultant will be in effect throughout the project in its entirety, however, it may be adjusted annually based on the update to the CPI-U West Region All Items Index. Any amendments for work on that project will use the current subcontractor’s Functional Consultant Rate Schedule. The subconsultant’s fee schedule shall adhere to the Consultant’s Rates and Payment Terms outlined herein. No markup may be added by the consultant to work performed by subconsultants and suppliers, or their subconsultant’s subconsultants and suppliers, for which all purchase invoice receipts are provided.

E. There will be no changes in the Functional Consultant Rate schedule except for the Annual CPI-U increase or additions for new positions (which will be subject to County approval).

F. The County will reimburse mileage at federal rate up to a 60-mile radius from Washington County, Walnut Street Center, 1400 SW Walnut Street, Hillsboro, OR 97123.

G. No separate reimbursement will be allowed for computer time, safety add-on, equipment, vehicles, CAD stations, faxes, vehicle rentals, photocopies up to 11x17”, office supplies, standard postage, hotel accommodations, air fare, etc. These costs are to

2026 Geotechnical and Materials Testing Services for Capital Project Services be included in the maximum billing rates. Specialized equipment such as a drill rig will be reimbursed.

H. Payment for Services: The County will pay consultants for services performed based on approved rates and scopes of work. The County will make monthly progress payments within 30 days of the receipt of a proper invoice. Invoices must be submitted in a format approved by the County (see Format for Invoice Submittal for Professional Services). The County may need added detail in the supporting documentation based on project specifics and will work with the Consultant to determine any requirements.

I. Payment for work accomplished under the Personal / Professional Services Contract shall not exceed the Consultant’s cost estimate or cost proposal for a specific project without written approval of the modification by the County.

J. The County recognizes it is inherent in the public works process that changes in the character, schedule, or complexity of work can occur after a scope of work has been approved for a specific project. The Consultant must receive written approval or direction from the County to amend the approved scope of work. The Director of Land Use and Transportation or designee may approve such changes provided there is not a fundamental change to the scope of work to be performed, or the change results in the maximum approved cost amount being exceeded.
