About this file

This is a Questions and Answers Addendum issued by SUNY Schenectady on September 11, 2026, for Electricity Supply Services RFQ 2026-08. SUNY Schenectady is soliciting proposals from qualified electricity suppliers and brokers to provide fixed-price electricity supply services. The scope covers electricity supply on a firm, fixed, all-inclusive $/kWh basis for either a 3-year or 5-year contract term, with pricing remaining firm for the full contract duration and no renewal options included. Proposals were due September 18, 2026, with questions required to be submitted by September 7, 2026, at 2:00 pm. The addendum clarifies that two electric account numbers (2764968016 and 4264172012) associated with leased facilities no longer occupied by the College have been removed from the current portfolio compared to the previous RFB 2026-06 bid, and bidders should base pricing on the accounts and usage information provided in Attachment 2 of the current RFQ.

The addendum addresses six substantive questions from interested bidders regarding contract requirements and submission procedures. Key decisions by the College include: maintaining the existing language regarding the College's right to add or remove meters and associated load during the contract term without repricing or additional fees, subject to discussion of implementation details only under extraordinary circumstances; continuing to require sealed paper bid submissions rather than transitioning to electronic submissions through BidNet; maintaining stated requirements regarding early termination provisions and fixed-price terms, though bidders may submit alternate terms and sample supply agreements for evaluation; and not modifying requirements to allow repricing thresholds for portfolio changes. The College reserves the right to evaluate all responses received and pursue alternative procurement options should an insufficient number of bids be submitted. Constellation NewEnergy, Inc. is identified as a business enterprise that was awarded an identical or substantially similar procurement contract within the past five years.

RFQ 2026-08 Addendum 01 September 11, 2026

This addendum is issued for informational purposes and is hereby made a part of the bid documents. Please attach this addendum to the documents in your possession and acknowledge receipt of this addendum in the space provided on Exhibit G: Receipt of Addenda.

The following questions were received by the College from Interested Bidders. The answers are provided as follows:

QUESTION:

1. We noticed electric account numbers 2764968016 and 4264172012 are removed compared to the original RFB 2026-06 bid. Is this accurate?

RESPONSE:

Yes. The accounts referenced in the question were associated with leased facilities that are no longer occupied by the College and, therefore, are no longer included in the electric supply portfolio covered by RFQ 2026-08. Bidders should base their pricing on the accounts and usage information provided in Attachment 2 of the current RFQ.

2. The updated RFQ maintains the current language, from the previous bid, under the Load and Usage disclaimer paragraph:

The College reserves the right to add or remove meters and associated load during the term of the contract due to acquisition, disposition, or changes in facilities. Any such additions or removals shall be incorporated into the agreement at the contracted $/kWh rate, without penalty, repricing, or additional fees. The College reserves the right to discuss implementation details if extraordinary circumstances materially alter the size or nature of the portfolio.

Given the dynamic nature of the New York electricity market, this provision may be difficult for suppliers to accommodate as currently written.

Would the College consider a slight modification to this language, such as adding "based on market conditions" to the provision governing any additions or changes?

For example, if an existing account is finalized and replaced with a new account of similar usage, it is often possible to transfer the contract terms. However, adding entirely new accounts under the original pricing cannot always be guaranteed and would be subject to prevailing market conditions at the time.

RESPONSE: The College does not intend to modify the requirements of the RFQ at this time. The

College's requirements regarding additions and removals of meters and associated load remain as stated in the RFQ. The College intends for normal changes associated with facility operations, acquisitions, dispositions, relocations, or utility account changes to be accommodated in accordance with the requirements set forth in the RFQ. As stated therein, the College reserves the right to

SUNY Schenectady Electricity Supply Services, RFQ 2026-09 Addendum 1 discuss implementation details should extraordinary circumstances occur that materially alter the size or nature of the portfolio. Bidders may submit their standard supply agreements and identify any exceptions to the RFQ requirements. Such agreements and exceptions will be reviewed by the

College as part of its evaluation process. However, unless modified by addendum, the requirements of the RFQ remain unchanged.

3. Is it possible for SUNY Schenectady to streamline the bid submission process by transitioning from paper submissions to electronic submissions through BidNet for the September 18th bid due date?

Because electricity prices fluctuate throughout the trading day, electronic submissions allow suppliers and brokers to price closer to the market at the time of the bid opening. This can result in more competitive pricing by reducing or eliminating the premiums suppliers may otherwise need to build into their bids to account for overnight market volatility.

RESPONSE: No. The College will continue to require submission of sealed paper bids in accordance with the requirements of RFQ 2026-08. Electronic, facsimile, or email submissions are not permitted. The College recognizes that electricity market prices may fluctuate between bid preparation and bid opening. Accordingly, the RFQ contains provisions that allow for limited market-price adjustments between quote submission and contract execution to account for market movement during the period required for evaluation, Board approval, and contract award. Bidders should submit their most competitive pricing based on market conditions at the time of bid submission and in accordance with the pricing provisions contained in the RFQ.

4. Convenience: 60-Day Termination Without Penalty

Is SCCC open to reviewing alternate terms and conditions from suppliers? As written, this clause makes it very difficult to secure a competitive 3 or 5-year fixed price from any reputable electric supplier. For a fixed, all-inclusive program, suppliers typically require some form of early termination protection — whether that's a liquidated damages clause, an early termination fee, or a market-based unwind charge. If alternate terms are considered, what would SCCC expect those to look like?

RESPONSE: SUNY Schenectady recognizes that supplier agreements may contain terms and conditions that differ from the RFQ. As stated in the RFQ, bidders are required to submit a sample supply agreement and identify any exceptions to the RFQ requirements as part of their submission.

The College will review supplier contract provisions and any proposed exceptions as part of its evaluation process. However, bidders are advised that the term periods identified in the RFQ are intended to be firm, and the College's stated requirements remain unchanged unless modified by addendum.

5. New Meter Portfolio Flexibility

The RFP states that additions or removals of meters should be accommodated without repricing, penalties, or additional fees. This is not standard practice for fixed-price programs. Suppliers price based on a committed load profile, and mid-term changes to the meter portfolio can materially affect that commitment. Would SCCC consider modifying this language to allow for reasonable

SUNY Schenectady Electricity Supply Services, RFQ 2026-09 Addendum 1 adjustments — such as a defined threshold for portfolio changes before repricing applies — in order to attract more competitive fixed-rate offers?

RESPONSE: The College has addressed meter additions and removals within the RFQ and intends for normal changes associated with facility operations, acquisitions, dispositions, relocations, or utility account changes to be accommodated in accordance with the requirements set forth therein. The College does not intend to modify the stated requirements at this time. As noted in the RFQ, the College reserves the right to discuss implementation details should extraordinary circumstances occur that materially alter the size or nature of the portfolio.

6. If SCCC continues to not receive a sufficient number of bids, how does the College plan to move forward? Understanding the contingency plan would be helpful as we evaluate the opportunity.

RESPONSE: As this is an RFQ, the College will evaluate all responses received and determine the most appropriate course of action based on pricing, qualifications, market conditions, and the

College's operational needs. If an insufficient number of responses are received, the College reserves the right to pursue alternative procurement options in accordance with applicable procurement policies and procedures.
