About this file

This is a Limited Source Justification document for a federal contract to provide comprehensive support services for the El Paso Soft Sided Facility (SSF), a temporary central processing center and holding facility for non-U.S. citizens. The U.S. Army Mission and Installation Contracting Command awarded a $230.3 million task order to Deployed Resources LLC under a GSA Multiple Awards Schedule, following the transfer of requirements from the Department of Homeland Security. The contract includes a 30-day base period with five 30-day option periods, with services encompassing processing, holding, meal services, janitorial support, caregiving, infrastructure maintenance, and operational support. The urgent and time-sensitive nature of the requirement, driven by Executive Orders and Proclamations, necessitated a sole-source award within 48 hours of the contract transfer, precluding competitive bidding due to the critical need to maintain facility operations without disruption.

Limited Source Justification – FAR Part 8

1. Contracting Activity: U.S. Army Mission and Installation Contracting Command, Field Directorate Office-Fort Sam Houston, 2205 Infantry Post Road, BLDG 603, Fort Sam Houston, TX 78234

2. Description of Action: Army North requests a firm-fixed-price Task Order under the General Services Administration (GSA) Multiple Awards Schedule (MAS) Program with Deployed Resources LLC, 164 McPike RD Rome, NY 13441. The Government executed this action against GSA Special Item Number 541614, Deployment, Distribution and Transportation Logistics Services via Contract No. 47QRAA25D0050.

The date of award was 29 March 2025. The award was executed utilizing fiscal year 2025 Operations and Maintenance, Army funds.

The required acquisition plan in accordance with Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B) is currently pending approval by

Senior Contracting Official and Director of Field Directorate Office-Fort Sam Houston (FDO-FSH).

This action is a follow-on order to General Services Administration (GSA) schedule 70RDAD21A00000012 Task Order 70B01C23F00000067. Task Order 70B01C23F00000067 was competitively awarded on 15 December 2022 by the Department of Homeland Security (DHS). On 28 March 2025, in response to a request from DHS citing the following Executive Orders and Proclamations: (1) Executive Order 14167, Clarifying the Military’s 's Role in Protecting the Territorial Integrity of the United States (January 20, 2025), Section 2; (2) Presidential Proclamation 10886, Declaring a National Emergency at the Southern Border of the United States (January 20, 2025); (3) Presidential Proclamation 10888, Guaranteeing the States Protection Against Invasion (January 20, 2025); and (4) Executive Order 14165, Securing Our Borders (January 20, 2025), the Secretary of Defense approved the transfer of the DHS contract requirements to the Department of the Army. The Army subsequently assumed control and management of this requirement with the exception of transportation, medical, and guard services. The existing DHS contract expired on 29 March 2025. The urgent and compelling need for these services necessitated a rapid sole source award, under the authority of FAR 8.405-6(a)(1)(i)(A), to Deployed Resources, LLC within 48 hours of the transfer of the requirement to the Department of the Army.

3. Description of Supplies/Services: This requirement continues operational support services at the El Paso Soft Side Facility (SSF) which serves as a temporary central processing center and holding facility for non-U.S. citizens. Support includes but is not limited to processing, holding, meal services, janitorial services, caregivers, ancillary facilities, as well as all mechanical, electrical, plumbing (to include restroom and showers), communications, laundry, pest services, and other infrastructure and services required to fully operate the El Paso SSF. As detailed below, the period of performance for this action includes a 30-day base period, with five 30-day option periods.

7. Actions to Increase Competition: To foster competition for future acquisitions of this service, further mission analysis and market research was conducted to identify alternative contract vehicles that maximize competition, including GSA schedules and the open market. Competitive procurements for this particular requirement necessitate sufficient lead time to facilitate contractor transition.

8. Market Research: Market research conducted on 28 March 2025, explored GSA schedules and potential contractors capable of operating the El Paso SSF. However, the requirement for full operational capacity within 48 hours, precluded awarding the contract to any other vendor. The necessary phase-in/phase-out period alone would have significantly disrupted El Paso SSF operations, rendering the facility inoperable, displaced dozens of non-citizens who were being held in the SSF, and severely reduced non-citizen processing and holding capacity. Moreover, failure to maintain operational readiness at the El Paso SSF, given current and projected occupancy levels, would place the Government in direct violation of the Presidential Executive Orders and Proclamations cited above.

9. Other Facts:

a. Procurement History

Contract: 70RDAD21A00000012 / 70B01C23F00000067 Description: El Paso and San Diego central processing center and holding facility Contractor: Deployed Resources, LLC Award Date: 15 December 2022 Competitive Status: Full and Open competition under Multiple Award Schedule

b. Since December 2022, Deployed Resources LLC, has successfully managed this requirement at El Paso SSF, adapting to DHS capacity needs. The fully equipped site supports all processing and holding operations. Changing contractors risked operational disruption and hindered expedited processing of non-citizens, a key presidential priority.

12. Best Value Determination/Fair and Reasonable Cost Determination: I hereby determine that Task Order W9124J-25-F-A026 represents the best value to the Government in accordance with FAR 8.405-6(c)(2)(v). Additionally, I hereby determine that the anticipated cost or price to the Government for this contract action is fair and reasonable. This determination was made using the Independent Government Estimate (IGE). GSA schedule pricing has been pre-negotiated as fair and reasonable. Fair and reasonable pricing at the Task Order level was further ensured through price analysis of existing Task Orders and the IGE. The government sought discounts off of the GSA schedule rates to maximize cost savings.
