Subject: Request for Quotations number 19RW6025Q0003 for Garbage Collection Services
Enclosed is a Request for Quotations (RFQ) for Garbage Collection Services for the American Embassy Kigali. If you would like to submit a quotation, follow the instructions in Section 3 of the solicitation, complete the required portions of the attached document, and submit it to the address shown on the Standard Form 1449 that follows this letter in a sealed envelope marked ” 19RW6025Q0003,-Quotation Enclosed”.
All contractors shall be registered in SAM (System for Award Management) Database https://www.sam.gov prior to contract award pursuant to FAR provision 5.207. Therefore prospective offerors are encouraged to register prior to the submittal of quotations/proposals. The guidelines for registration in SAM is also available at: https://www.statebuy.state.gov/pd/Pages/AdditionalVendorReg.aspx.
The U.S. Government intends to award a contract/purchase order to the responsible company submitting an acceptable quotation at the lowest price. We intend to award a contract/purchase order based on initial quotations, without holding discussions, although we may hold discussions with companies in the competitive range if there is a need to do so.

I. PERFORMANCE WORK STATEMENT
A. The purpose of this firm fixed price purchase order is to for Garbage Collection Services in accordance with Attachment A.
B. The contract will be for a one-year period from the date of the contract award, with four one-year options at the discretion of the USG.
MINIMUM AND MAXIMUM AMOUNTS
During this contract period, the Government shall place orders totaling a minimum of 7500 Trips. This reflects the contract minimum for this period of performance. The amount of all orders shall not exceed 8000 Trips.This reflects the contract maximum for this period of performance.”
Value Added Tax (VAT) is not included in the CLIN rates. Instead, it will be priced as a separate Line Item in the contract and on Invoices. Local law dictates the portion of the contract price that is subject to VAT; this percentage is multiplied only against that portion. It is reflected for each performance period.

QUALITY ASSURANCE AND SURVEILLANCE PLAN (QASP)
This plan provides an effective method to promote satisfactory contractor performance. The QASP provides a method for the Contracting Officer's Representative (COR) to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract. The role of the Government is to monitor quality to ensure that contract standards are achieved.

Services.
Performs all trash disposal services set forth in the scope of work.

All required services are performed and no more than 2 customer complaints are received per month.
[1. SURVEILLANCE. The COR will receive and document all complaints from Government personnel regarding the services provided. If appropriate, the COR will send the complaints to the Contractor for corrective action.
2. STANDARD. The performance standard is that the Government receives no more than one (1) [Note to Contracting Officer: Insert other number if desired] customer complaint per month. The COR shall notify the Contracting Officer of the complaints so that the Contracting Officer may take appropriate action to enforce the inspection clause (FAR 52.212.4, Contract Terms and Conditions-Commercial Items (May 2001), if any of the services exceed the standard.
| 3. | PROCEDURES. |
| (a) | If any Government personnel observe unacceptable services, either incomplete work or required services not being performed they should immediately contact the COR. |
| (b) | The COR will complete appropriate documentation to record the complaint. |
| (c) | If the COR determines the complaint is invalid, the COR will advise the complainant. The COR will retain the annotated copy of the written complaint for his/her files. |
| (d) | If the COR determines the complaint is valid, the COR will inform the Contractor and give the Contractor additional time to correct the defect, if additional time is available. The COR shall determine how much time is reasonable. |
| (e) | The COR shall, as a minimum, orally notify the Contractor of any valid complaints. |
| (f) | If the Contractor disagrees with the complaint after investigation of the site and challenges the validity of the complaint, the Contractor will notify the COR. The COR will review the matter to determine the validity of the complaint. |
| (g) | The COR will consider complaints as resolved unless notified otherwise by the complainant. |
| (h) | Repeat customer complaints are not permitted for any services. If a repeat customer complaint is received for the same deficiency during the service period, the COR will contact the Contracting Officer for appropriate action under the Inspection clause.] |

SCHEDULE OF SUPPLIES/SERVICES, BLOCK 20
DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
The contractor shall perform garbage collection services, including furnishing all labor, material, equipment and services, for the U.S. Embassy Kigali. The price listed below shall include all labor, materials, insurance (see FAR 52.228-4 and 52.228-5), overhead, and profit. The Government will pay the Contractor the fixed price per month for standard services that have been satisfactorily performed and accepted by the Government.
After contract award and submission of acceptable insurance certificates, the Contracting Officer shall issue a Notice to Proceed. The Notice to Proceed will establish a date (a minimum of ten (10) days from date of contract award unless the Contractor agrees to an earlier date) on which performance shall start.
The performance period of this contract is from the start date in the Notice to Proceed and continuing for 12 months, with four one-year options to renew. The initial period of performance includes any transition period authorized under the contract.
Temporary Additional Services are services that are defined as Standard Services but are required at times other than the normal workday. These services shall support special events at the Post. The Contractor shall provide these services in addition to the scheduled services specified in this contract. The COR shall order these services as needed basis. This work shall be performed by Contractor trained employees and shall not be subcontracted. The COR may require the Contractor to provide temporary additional services with 24-hour advance notice.
Because Temporary/Additional Services are based on indefinite delivery/indefinite quantity the minimum and maximum amounts are defined below:
Minimum: The Government shall place orders totaling a minimum of USD 200. This reflects the contract minimum for the base year and option period.
Maximum: The amount of all orders shall not exceed USD 100,000. This reflects the contract maximum for the base year and each option period for temporary/additional services.
The Contractor shall include in its next regular invoice details of the temporary additional services, and if applicable, materials, provided and requested under temporary additional services. The Contractor shall also include a copy of the COR’s written confirmation for the temporary additional services.
This is a fixed price contract
3. TYPES OF SERVICE
Standard Services. The Contractor shall provide standard garbage collection services as specified in Section C for properties listed in Exhibit A.
Temporary Additional Services. The Contractor shall provide Temporary Additional Services when requested by the Contracting Officer's Representative (COR) through a written order. Temporary Additional Services delivered shall be in addition to the Standard Services, and shall be priced at the unit price shown below. The tasks to be accomplished shall be additional quantities of the same tasks described in Section C.
4. PRICING
The Government will pay the Contractor a fixed price per month for Standard Services that have been satisfactorily performed.
The Government will also pay the Contractor for Temporary Additional Services ordered each month by the Government for satisfactorily completed work.
The Contractor shall include any premium pay for services required on holidays only in the fixed prices for Standard Services. The Contractor shall include any premium pay for overtime only in the fixed rates for Temporary Additional Services.
The cost of Workers’ Compensation War-Hazard Insurance Overseas (See Section I, FAR 52.228-4) is not reimbursable and shall be included in the Contractor’s rates.
The Government will make payment in local currency.
PRICING CRITERIA
In consideration of satisfactory performance of all the scheduled services required under this contract, the contractor shall be paid on a ’per trash pickup’ basis.
A residential trash pickup will consist of approximately 2 containers per residence plus incidental items, e.g. brush, trimmings on an ad hoc basis. This is not limited, and all rubbish found at the residence must be removed.
An Embassy facility trash pickup will consist of all un-compacted garbage in the trash room, three times per week.
We require 1 trash pickup per week at each residence and 3 trash pickups per week at US Embassy.
Pricing must be in RWF.
C.2. GENERAL INSTRUCTIONS
The contractor shall prepare a residential trash pick-up schedule. The Contractor shall provide drafts to the Contracting Officer's Representative (COR) for review within fourteen days after contract award. The Contracting Officer’s Representative must approve these general instructions before issuance.
C.3. DUTIES AND RESPONSIBILITIES
· Contractor shall collect refuse from residences on a pre-determined day on a weekly basis. Residences are in the following areas of Kigali:
· Kiyovu
· Kacyiru
· Nyarutarama
· Kagugu
· Kimihurura
· Ambassador Residence (One day extra)
· Contractor shall collect refuse from the Embassy on the following days:
· Monday at 4.00pm
· Wednesday at 9.00am
· Friday at 9.00am
C.4. Definitions.
"Chancery" means the building of the Post used for official activities.
"Contracting Officer" means a person appointed with the authority to enter in and administer contracts on the behalf of the Government.
“Trip” means collection of garbage by the contractor from one location listed under the exhibit A
"Contracting Officers' Representative (COR)" means an individual designated in writing by the Contracting Officer to perform specific contract administration functions.
"DCR" means the official residence of the Deputy Chief of Mission
"General Instructions" mean those instructions, directives and guidelines that apply to all gardening personnel.
"Government" means the Government of the United States of America.
C.5. DESCRIPTION OF SERVICES
The contract shall undertake the following services in connection with the garbage collection services:
1. Carefully remove trash from containers and load them in the trash pick-up vehicle;
2. Clean-up around the garbage containers after every removal of the trash;
3. Dispose of collected garbage in accordance with the Rwanda Government environment requirements;
4. This service shall include pick-up of branches, shrubbery and similar foliage from residential properties.
5. The Contractor shall include all planning, administration, and management necessary to assure that all services comply with the contract, the COR's schedules and instructions, and all applicable laws and regulations. The Contractor shall meet all of the standards of performance identified in the contract. The Contractor shall perform all related support functions such as supply, subcontracting, quality control, financial oversight, and maintenance of complete records and files.
C.6. MANAGEMENT AND SUPERVISION
· The contractor shall designate a representative who shall be responsible for on-site supervision of the Contractor's workforce at all times. This supervisor shall be the focal point for the Contractor and shall be the point of contact with U.S. Government personnel. The supervisor shall have sufficient English language skill to be able to communicate with members of the U.S. Government staff. The supervisor shall have supervision as his or her sole function during the times that services are being delivered under this contract.
· The Contractor shall maintain schedules. The schedules shall take into consideration the hours that the staff can effectively perform their services without placing a burden on the security personnel of the Post. For those items other than routine daily services, the contractor shall provide the COR with a detailed plan as to the personnel to be used and the time frame to perform the service. Therefore, the pick schedule at the Embassy shall be three times per week on Monday, Wednesdays and Friday. Pick-ups on days other than these must be approved in advance by the Embassy. If the pickup falls on a holiday the collection shall be made the following day.
· The Contractor shall be responsible for quality control. The Contractor shall perform inspection visits to the work site on a regular basis. The Contractor shall coordinate these visits with the COR. These visits shall be surprise inspections to those working on the contract.
C.7. Hazardous and Toxic Substances.
It is the contractor's responsibility to ensure the safe handling, application; removal and environmentally sound disposal of all hazardous or potentially hazardous disinfect products utilized in this requirement.
C.8. Temporary Additional Services
Temporarily and additional services are services that are defined as Standard Services but are required at times other than the normal workday. These services shall support special events at the Post. The Contractor shall provide these services in addition to the scheduled services required by paragraph C.3 of this contract. The COR shall order these services as needed. This work shall be performed by trained employees of the Contractor, and shall not be subcontracted. The COR may require the Contractor to provide temporary additional services with 24 hour advance notice.
C.7.1 The Contractor shall include in its next regular invoice details of the temporary additional services. The Contractor shall also include a copy of the COR's written confirmation for the temporary additional services.
C.9. LOCATIONS FOR GARBAGE COLLECTION
1. US Embassy Kigali
2. 69 US personnel residences. Refuse will be collected from individual residences.
3. PERSONNEL
a. The contractor shall provide a qualified work force meeting the requirements set forth in the paragraphs below. The workforce shall be able to provide the services in accordance with the schedule indicated in Section J. Exhibit A, Locations and Time Frames for Refuse Collection.
b. Notice to Government Labor Disputes
The Contractor shall inform the COR of any actual or potential labor dispute that is delaying or threatening to delay the timely performance of this contract.
4. Personnel Security
After award of the contract, the Contractor shall provide the following list of data on each employee who will be working under the contract. The Contractor shall include a list of workers and supervisors assigned to this project. The Government will run background checks on these individuals. For each individual the list shall include:

5. MATERIALS AND EQUIPMENT
The contractor shall provide all necessary supplies and equipment to perform the work identified in this contract.
The contractor is advised to use any kind of equipment that is approved by the city administration and is safety used for job performance.
6. WORKING HOURS
All work shall be performed during working hours, Mondays thru Fridays except for the holidays identified in the Addendum in Section 2. Other hours may be approved by the Contracting Officer's Representative. The Contractor must provide at least 24 hour advance notice to the COR who will consider any deviation from the hours identified above.

NOTICE TO PROCEED
After contract award and submission of acceptable insurance certificates, the Contracting Officer shall issue a Notice to Proceed. The Notice to Proceed will establish a date (a minimum of ten (10) days from start date listed in Notice to Proceed unless the Contractor agrees to an earlier date) on which performance shall start.
SECTION G – CONTRACT ADMINISTRATION
MONITORING OF THE CONTRACTOR
652.242-70 CONTRACTING OFFICER'S REPRESENTATIVE (COR) AUG 1999)
a. The Contracting Officer may designate in writing one or more Government employees, by name or position title, to take action for the Contracting Officer under this contract. Each designee shall be identified as a Contracting Officer’s Representative (COR). Such designation(s) shall specify the scope and limitations of the authority so delegated; provided, that the designee shall not change the terms or conditions of the contract, unless the COR is a warranted Contracting Officer and this authority is delegated in the designation.
b. The COR for this contract is the Facilities Maintenance Manager.
DUTIES
The COR is responsible for inspection and acceptance of services. These duties include review of Contractor invoices, including the supporting documentation required by the contract. The COR may provide technical advice, substantive guidance, inspections, invoice approval and other purposes as deemed necessary under the contract.
SUBMISSION OF INVOICES
The Contractor shall submit an original invoice to Financial Management Office at the following address:

Kigali-Rwanda
The Contractor shall show Value Added Tax (VAT) as a separate item on invoices submitted for payment.
The Contractor at the same time will submit a ‘trash pick-up’ record with a signature for every residential and Embassy trash pick-up. Payment is based on actual ‘trash pick-ups.
SECTION H – SPECIAL CONTRACT REQUIREMENTS
1. SECURITY
General – The Government reserves the right to deny access to U.S. owned and U.S. operated facilities to any individual. The Government will run background checks on all proposed Contractor employees. The Contractor shall provide the names, biographic data and police clearance on all Contractor personnel who shall work on this contract.
2. STANDARD OF CONDUCT
The Contractor shall maintain discipline at the site and shall take all reasonable precautions to prevent any unlawful, riotous or disorderly conduct by Contractor employees at the site. The Contractor shall preserve peace and protect persons and property on site. The Embassy reserves the right to direct the Contractor to remove an employee from the worksite for failure to comply with the standards of conduct. The Contractor shall immediately replace such an employee to maintain continuity of services at no additional costs to the Government.
• The Contractor shall provide employees with and ensure the use of safety equipment, personal protective equipment and devices necessary to protect the employee.
• The contractor shall provide adequate protection to prevent damage to or soiling of the areas, which are not included for work.
• The Contractor shall telephonically report each accident immediately to the Contracting Officer’s Representative.
• Uniforms and Personal Equipment. The Contractor's employees shall wear clean, Neat and complete uniforms when on duty. All employees shall wear uniforms approved by the Contracting Officer's Representative (COR).
• Neglect of duties shall not be condoned. The Contractor shall enforce no unreasonable delays or failures to carry out assigned tasks, conducting personal affairs during duty hours and refusing to render assistance or cooperate in upholding the integrity of the worksite security.
• Disorderly conduct, use of abusive or offensive language, quarreling, intimidation by words, actions, or fighting shall not be condoned. Also included is participation in disruptive activities, which interfere with normal and efficient Government operations.
• Intoxicants and Narcotics. The Contractor shall not allow its employees while on duty to possess, sell, consume, or be under the influence of intoxicants, drugs or substances that produce similar effects.
| • | Criminal Actions. Contractor employees may be subject to criminal actions as allowed by law in certain circumstances. These include but are not limited to the following actions: |
| • | falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records or concealment of material facts by willful omission from official documents or records; |
| • | unauthorized use of Government property, theft, vandalism, or immoral conduct; |
| • | unethical or improper use of official authority or credentials; |
| • | security violations; or, |
| • | organizing or participating in gambling in any form. |
3. PERSONNEL HEALTH REQUIREMENTS
All employees shall be in good general health without physical disabilities that would interfere with acceptable performance of their duties. All employees shall be free from communicable diseases.
4. LAWFUL OPERATION, PERMITS AND INDEMNIFICATION
• Without additional expense to the Government, the Contractor shall comply with all laws, codes, ordinances, and regulations required to perform this work. In the event of a conflict among the contract and requirements of local law, the Contractor shall promptly advise the Contracting Officer of the conflict and of the Contractor's proposed course of action for resolution by the Contracting Officer.
• The Contractor shall comply with all local labor laws, regulations, customs and practices pertaining to labor, safety, and similar matters, to the extent that such compliance is not inconsistent with the requirements of this contract.
• Employee salary benefits. The Contractor shall be responsible for payment of all employee wages and benefits required by host country law or agreements with its employees. The Government, its agencies, agents, and employees shall not be part of any legal action of obligation regarding these benefits which may subsequently arise. Where local law requires bonuses specific minimum wage levels, premium pay for holidays, payments for social security, pensions, sick or health benefits, severance payments, child care or any other benefit the Contractor is responsible for payments of these costs and must included them in the fixed prices in this contract.
• Bonds. The Government imposes no bonding requirement on this contract. The contractor shall provide any official bonds required, pay any fees or costs involved or related to the authorization for the equipping of any employees engaged in providing services specified under this contract if such bonds of payments are legally required y the local government or local practice.
• Personal Injury, Property Loss of Damage (Liability). The contractor hereby assumes absolute responsibility and liability for any and all personal injuries or death and/or property damage or losses suffered due to negligence of the contractor’s personnel in the performance of the services required under this contract. The contractor’s assumption of absolute liability is independent of any insurance policies.
5. INSURANCE
• Amount of Insurance. The Contractor is required to provide whatever insurance is legally necessary. The Contractor shall, at its own expense, provide and maintain during the entire performance period the following insurance amounts:
• General Liability (includes premises/operations, collapse hazard, products, completed operations, contractual, independent contractors, broad form property damage, personal injury)

• The types and amounts of insurance are the minimums required. The Contractor shall obtain any other types of insurance required by local law or that are ordinarily or customarily obtained in the location of the work. The limit of such insurance shall be as provided by law or sufficient to meet normal and customary claims.
• For those Contractor employees assigned to this contract who are either United States citizens or direct hire in the United States or its possessions, the Contractor shall provide workers’ compensation insurance in accordance with FAR 52.228-3.
• The Contractor agrees that the Government shall not be responsible for personal injuries or for damages to:
| a) | any property of the Contractor, |
| b) | its officers, |
| c) | agents, |
| d) | servants, |
| e) | employees, or |
| f) | any other person, |
Arising from and incident to the Contractor's performance of this contract. The Contractor shall hold harmless and indemnify the Government from any and all claims arising, except in the instance of gross negligence on the part of the Government.
• The Contractor shall obtain adequate insurance for damage to, or theft of, materials and equipment in insurance coverage for loose transit to the site or in storage on or off the site. Government as Additional Insured. The general liability policy required of the Contractor shall name "the United States of America, acting by and through the Department of State", as an additional insured with respect to operations performed under this contract.
• Time for Submission of Evidence of Insurance. The Contractor shall provide evidence of the insurance required under this contract within ten (10) calendar days after contract award. The Government may rescind or terminate the contract if the Contractor fails to timely submit insurance certificates identified above.
• Workers’ Compensation and Employer’s Liability

• Permits. Without additional cost to the Government, the contactor shall obtain all permits, licenses, and appointments required for the prosecution of work under this contract. The contractor shall obtain these permits, licenses, and appointments in compliance with Rwandan laws. The contractor shall provide evidence of possession or status of application for such permits, licenses, and appointment to the Contracting Officer with its proposal. Application, justification, fees, and certifications for any licensure required by the host government are entirely the responsibility of the offeror.
6. CERTIFICATE OF INSURANCE
The Contractor shall furnish to the Contracting Officer a current certificate of insurance as evidence of the insurance required. In addition, the Contractor shall furnish evidence of a commitment by the insurance carrier to notify the Contracting Officer in writing of any material change, expiration or cancellation of any of the insurance policies required not less than thirty (30) days before such change, expiration or cancellation is effective. If Contractor is self-insured then the Contractor shall not change or decrease the coverage without the Contracting Officer's approval.
7. TRANSITION PLAN
Within ten days after contract award, the Contracting Officer may request that the Contractor develop a plan for preparing the Contractor to assume all responsibilities for services defined in Section C of this contract. The plan shall establish the projected period for completion of all clearances of Contractor personnel, and the projected start date for performance of all services required under this contract. The plan shall assign priority to the selection of all supervisors to be used under the contract.
