1. Introduction

1.1. Summary

NOTICE IS HEREBY given that the City of Hayward invites sealed proposals for 25-052 2025-26 SEWER

COLLECTION SYSTEM MASTER PLAN UPDATE. Each proposal shall be in accordance with the general provisions for purchase of work and services on file in the office of the Utilities, 777 B Street, Hayward, CA 94541-5114. All proposals must be submitted to the City's eProcurement Portal by 5:00 pm on

Friday, June 20, 2025 and clearly identified with RFP title, number, company name and due date. It is the sole responsibility of the proposing firm to ensure that proposals are received prior to the closing time, as late bids will not be accepted and deemed nonresponsive.

The City is seeking a qualified Consultant to develop a 2025-26 flow monitoring program, collect dry and wet weather flow data, update and recalibrate the City’s Infoworks ICM hydraulic model, identify capacity needs and associated projects and priorities, and update the City’s Sewer Collection System Master Plan.

1.2. Background

The City of Hayward, California (the City) is located in Alameda County and is known as the “Heart of the

Bay” because of its central and convenient location to San Francisco, Oakland, and San Jose. It is served by an extensive network of freeways and bus lines and has two BART stations and an Amtrak station. Currently, it is estimated that there are 148,000 residents of the City of Hayward with the City growing by approximately three percent since 2000.

The City of Hayward, California (The City), located in Alameda County, is known as the “Heart of the Bay” because of its central and convenient location to San Francisco, Oakland and San Jose. The City owns and operates its own sanitary sewer collection system and Water Resources Recovery Facility (WRRF) located in the western area of the City. The sewer collection system includes approximately 322 miles of gravity sewers, 4 miles of force mains, and 9 lift stations. The City’s sewer service area includes approximately 29,700 residential, 2,800 commercial/industrial, and 100 agency connections with average dry weather flow of approximately 11 million gallons per day (mgd) and maximum wet weather flow of approximately 45 mgd with wet weather storage.

The City last updated its sewer collection system master plan in 2015. Since this time, nearly all of the capital improvements recommended in the 2015 Master Plan have been completed. The City is planning to complete a new flow monitoring program to collect dry and wet weather flow data, update and recalibrate the City’s InfoWorks ICM hydraulic model to reflect the improvements that have been completed, recalibrate the hydraulic model to new flow data, reassess current and future capacity needs using updated model, recommend short- and long-term capital improvements required to convey current and future wastewater flows, and incorporate a narrative that acknowledges the new capacity-related requirements of the Statewide Waste Discharge requirements that became effective in May

2023 (see Task 4 in Scope of Work). The master plan update does not include an evaluation of rehabilitation and replacement needs to address pipe defects, as the City conducts these assessments apart from the capacity analysis.

2. Project Details

2.1. Important Instructions for Electronic Submittal

The City of Hayward is accepting electronic bid submissions. Bidders shall create a FREE account with

OpenGov Procurement by signing up at https://procurement.opengov.com/signup. Once you have completed account registration, browse back to this page, click on "Submit Response", and follow the instructions to submit the electronic bid.

2.2. Communication Regarding this RFP

All communication from prospective proposers regarding this RFP must be submitted in the Question &

Answer portal within the City's project posting. Please submit each question separately.

Communication by telephone or in person will not be accepted. Attempts by or on behalf of a prospective or existing vendor to contact or to influence any member of the selection committee, any member of the City Council, or any employee of the City of Hayward with regard to the acceptance of a proposal may lead to elimination of that vendor from further consideration

2.3. Optional Pre-Proposal Conference

An optional pre-proposal conference be held in the City of Hayward City Hall, Public Works and Utilities

Conference Room 2B, 777 B Street, Hayward, CA 94541, at 10:00 am on May 7, 2025. The purpose of the conference is to discuss City objectives, to answer proposer questions, and/or to clarify City's requirements. Public Works and Utilities staff will be available to assist in answering questions about the existing master plan and/or sewer collection system facilities. Written addenda may be issued via the

Addenda & Notices section of this RFP to all attendees if deemed appropriate and necessary by City.

2.4. Last Day for Questions

All questions must be submitted to the Question & Answer portal within the City's project posting by

5:00 pm Friday, June 6, 2025. This will allow sufficient time for any addenda to be issued by the City to all bidders.

2.5. Award of Contract

The City reserves the right to reject any and all proposals, to contract work with whomever and in whatever manner the City decides, to abandon the work entirely and to waive any informality or non-substantive irregularity as the interest of the City may require and to be the sole judge of selection process. The City also reserves the right to negotiate separately in any manner to serve the best interest of the City. The City retains the right at its sole discretion to select a successful vendor. The selected consultant will be required to obtain a City of Hayward business permit.

2.6. City's Rights Reserved

• The City reserves the right to select the proposal which in its sole judgment best meets the needs of the City. The recommended selection of the evaluation committee is final and subject only to review and final approval by the Steering Committee and the City Council.

• The City reserves the right to reject any or all proposals and to waive technicalities and informalities when such waiver is determined by the City to be in the City’s best interest.

• The City reserves the right to retain all accepted proposals, including proprietary documentation, regardless of which proposal is selected. No proposals will be returned to vendors.

• The City reserves the right to request any supplementary information it deems necessary to evaluate proposer’s experience or qualifications. This may include supplemental financial information, additional interview(s), and/or additional presentation by the proposer.

• The City reserves the right to reconsider any proposal submitted at any stage of the procurement. It also reserves the right to meet with select proposers at any time to gather additional information. Furthermore, the City reserves the right to delete or add functionality

(i.e., modules and components) until the final contract signing.

• The City reserves the right to cancel, in part or in its entirety, this RFP, including, but not limited to: selection schedule, submittal date, and submittal requirements. If the City cancels or revises this RFP, all proposers will be notified in writing by the City.

• The City reserves the right to revise the RFP prior to the date that proposals are due. The City will communicate changes through addendum to this RFP. All registered proposers will be notified of revisions to the RFP. The City reserves the right to extend the date by which the proposals are due.

• The City reserves the right to split the award from this RFP between multiple proposals when such split award is determined to be in the best interests of the City.

• The City reserves the right, in its sole discretion, to reject any and all proposals and to waive informalities and minor irregularities in any proposals received. Failure to furnish all information requested or to follow the format requested herein may disqualify the proposer, in the sole discretion of the City. False, incomplete, misleading or unresponsive statements in a proposal may also be sufficient cause for a proposal’s rejection.

• This RFP does not commit the City to award a contract. All proposals submitted in response to this RFP become the property of the City and public records, and as such, may be subject to public review.

• The City shall not be liable for any pre-contractual expenses incurred by prospective vendors or selected contractors, including but not limited to costs incurred in the preparation or submission of proposals. The City shall be held harmless and free from any and all liability, claims, or expenses whatsoever incurred by, or on behalf of, any person or organization responding to this

RFP.

• If the successful proposer defaults, the City may award this RFP to the next best proposal and may recover the loss occasioned by the successful proposer against a surety bond, if any, or by suit against the successful proposer.

• The City reserves the right to cancel, in part or in its entirety, this RFP including, but not limited to: selection procedures, submittal date, and submittal requirements. If the City cancels or revises the RFP, all interested firms will be notified.

• All proposals submitted in response to this RFP become the property of the City and public records and, as such, are subject to public review.

2.7. Protest

Should any proposer question or protest the award of the contract, such question or protest must be furnished in writing to the Purchasing Manager within three (3) calendar days after the City notifies all proposers of its Intent to Award. Such submittal must fully explain the basis of the objection supported by all relevant information facts and details. Letter must be signed by an authorized representative stating specific reason(s) for the protest including all relevant facts (law, rule, regulation, and criteria).

Questions or protests not furnished in writing as prescribed will not be accepted.

3. Scope of Work

3.1. Scope of Work

The preliminary Scope of Services provided below is intended to illustrate the desired project components. Consultants are encouraged to present innovative concepts to produce a complete project. In addition, tasks that the Consultant believes are necessary for the completion of the project should be included in the proposal.

The City expects flow monitoring to be conducted during the 2025-26 wet weather season, followed by completion of the hydraulic model and master plan in 2026.

Task 1: Project Administration and Management

Consultant shall provide a project schedule with key milestones identified. This task includes monthly (or as needed) project update meetings with the City using Microsoft Teams, beginning with a kickoff meeting to be held within the first month of the project.

The Consultant shall conduct project management activities, which may include:

• Supervise, coordinate and monitor design for conformance with standard engineering practices and other governing agency requirements.

• Notify City of any changes in scope or budget as soon as possible and propose actions, if necessary, to correct these changes.

• Maintain communication by being available by phone, e-mail, or teleconference and responding in a timely fashion.

• Maintain project files.

• Provide monthly written progress reports and invoices to the City, over the duration of the project.

Task 2: Data & Information Collection

Consultant shall collect and review relevant data to inform the new flow monitoring program, hydraulic model update, and master plan update including the current InfoWorks ICM model files; as-built drawings for completed projects: 2012-2013 flow monitoring program data and report[1]; current GIS layers; pump station configurations, setpoints, and pump curves; wastewater plant data for specific periods; water usage data; residential and commercial sewer billing data; land use data; General and

Specific Plans; and other data and studies as identified by the Consultant and available from the City.

Any site visits are included in this task.

Task 3: Flow Monitoring Program

The current sewer collection system is divided into the following seven (7) basins, each with 8 to 38 subbasins.

Consultant shall review flowmeter locations and data from the 20 temporary flow meters used in the

2012-2014 flow monitoring effort and shall develop a new flow monitoring program that includes the following: 1) number of proposed meters and proposed rain gauges; 2) initial proposed locations of these meters and gauges; 3) start date and duration of flow monitoring program. The flow monitoring program shall include a sufficient number of flowmeters to allow comparison of new flows to previously collected flows, and to verify and/or adjust dry and wet weather characteristics within the hydraulic model. The City does not expect to see widespread changes in dry and wet weather flow characteristics.

Therefore, Consultant must analyze the current data as compared to previously-collected data to understand and explain discrepancies in measured flows. Further, new meters may be located as required to refine data related to flow splits, inflow and infiltration, or other flow characteristics.

Consultant shall verify the viability of proposed locations through a field visit and shall meet with City staff to receive concurrence on the program. Consultant shall calibrate, install, monitor, and remove the proposed meters including providing necessary traffic control. The work will require a no-cost encroachment permit and approved traffic control plan. Consultant shall submit application for an encroachment permit at least one month in advance to allow sufficient time for City to review the traffic control plans.

The City will assist Consultant to locate manholes as needed. However, manhole access shall be provided by Consultant. Consultant shall provide a comprehensive report summarizing the flow monitoring program, data collected, and results.

Task 4: Hydraulic Model Update and Calibration

Consultant shall update the City’s existing InfoWorks ICM model network to include:

• City’s system assets as represented in the most current GIS files and supplemental information from as-built drawings and the current model files. The current modeled network includes the

City’s backbone infrastructure.

• Confirmation of flow splits and other network knowledge as provided by City staff.

• Sewer base flows using land uses from the most current General Plan and Specific Plan and other appropriate flows, such as commercial sewer discharge rates calculated from water usage data, which is limited and available from the City.

Consultant shall calibrate the updated hydraulic model to dry and wet weather data obtained through the new flow monitoring program. Consultant shall furnish the hydraulic model upon completion of the

Task 5: Capacity Evaluation Criteria

Consultant shall work with the City to develop existing dry and wet weather system capacity criteria that will be used to 1) identify capacity constraints, and also to 2) size replacement pipelines and/or pumping. In addition to defining pipeline capacity criteria, Consultant shall work with the City to define an appropriate design storm, and to develop reasonable assumptions for changes in rainfall intensity and groundwater levels that may occur as a result of climate change.

Task 6: Capacity Analysis

Using the calibrated model, Consultant shall evaluate the system under peak dry weather flow and peak wet weather flow using the selected design storm. Consultant shall identify locations with predicted surcharges and spills and shall meet with the City by virtual meeting to discuss findings from the capacity analysis. Consultant shall develop recommended capacity improvement projects to address the identified capacity constraints. Consultant shall update the hydraulic model to include the proposed solutions and confirm that the proposed solutions enable the system to adequately convey flows from peak dry weather and design storm flow conditions.

In conjunction with developing capacity relief projects, Consultant shall complete a review of inflow and infiltration (I&I) using the new flow data. The objective of this task is to identify basins with high I&I that could potentially be addressed through in-system rehabilitation and replacement in lieu of capacity improvements. In order for an I&I reduction program to be effective, the flow data must clearly identify specific locations and volumes of I&I in an amount that will substantially reduce or eliminate the identified capacity constraint.

Task 7: Additional Tasks to Meet Statewide WDR for Element 8, Capacity Assessment

The following tasks are required by WQ 2022-0103-WDR and not included in the above tasks. Consultant shall apply a Statewide WDR lens to the results from the hydraulic analysis and provide additional recommendations that will be incorporated into the CIP.

• Existing system condition assessments, system inspections, system audits, spill history, or other available information that could change the capacity recommendations. Consultant shall discuss capacity recommendations with the City Collection Systems management group to determine if there are overlaps between capacity needs and rehabilitation needs, spill problem areas, etc.

The intent of this task is to overlay existing system knowledge onto capacity recommendations in order to help prioritize proposed projects. Additional analyses beyond those already completed by the City are not included in this scope.

• Discussion of the potential effects of a larger or more intense storm that the design storm, potential representing changes due to climate change. The existing system did not observe overflows during the recent December 2022 event, which may serve as an example of future trends.

• Review of gravity sewer pipelines that are near the ground or aboveground and near potentially erosive forces in canyons or streams, as related to capacity recommendations, based on field knowledge (see above).

• Review of available in-system storage upstream of the City’s pump stations.

Task 8: Capital Improvement Program

Consultant shall develop capital improvement project recommendations to address capacity needs from the above tasks. Project costs should be assigned using information from recent City bids and publicly-available information from other similar projects completed in the surrounding area.

Consultant shall prepare a prioritized capital improvement plan (“CIP”) that presents recommendations over a 5-year timeline (near-term improvements) and 10 to 20-year + timeline (long-term improvements). The CIP should include a discussion of any changes that have occurred from prior capacity recommendations and the reasons for these changes.

Task 9: Draft and Final Master Plan Report

Consultant shall prepare a draft and final Sewer Collection System Master Plan report. The report will discuss background information, key components of the analyses, key assumptions and discussions, master planning, hydraulic modeling, and risk modeling methodologies, recommended criteria, analysis results, and the recommended CIP. After submittal of the draft report, a virtual review meeting will be held to discuss the compiled document and to receive comments on the report. Comments shall be addressed in the final report.

[1] The City collected additional flow data during the 2023-24 wet weather period to confirm the need for the Harder Road Sewer project. This limited data is also available to the Consultant for use in completing Task 3.

3.2. Overview of Scope

A. Consultant Selection:

1. The purpose of this RFP is to solicit proposals to provide all of the above services.

B. Schedule:

1. The following provides milestones in the consultant selection process for City of Hayward

2025-26 Sewer Collection System Master Plan Update:

a. Electronically submit completed proposals to City of Hayward Utilities at 5:00 pm on

Friday, June 6, 2025 to https://procurement.opengov.com/portal/hayward-ca/projects/161418.

b. Refer to Section 1.4 of this RFP for the consultant selection process timeline.

3.3. Proposal Format

The City encourages economy and discourages overly lengthy proposals. The proposal shall be limited to a maximum 30 pages for the Letter of Transmittal, Statement of Qualifications, Project Manager and

Team, References, Work Plan and Approach, Schedule, Cost Proposal, and Revisions and Additions to

Scope of Services. Appendices, which are not accounted for in the page count, shall include resumes

(furnished at no more than 2 pages per team member), detailed scope of work, and exceptions to the

City's standard Professional Services Agreement. Do not include resumes for personnel that are not anticipated or available to work on this project. Section dividers and appendices do not count in the overall page count in the proposal.

A. Cover Letter. The cover letter should identify the primary contact person for your team.

B. Statement of Qualifications. Provide a statement of your firm's qualifications for performing the requested services, including relevant recent experience.

C. Project Manager and Team. List the consultant team members that will be dedicated to the

City's project, including Project Manager, who will be the primary point of contact with the City, and any other key team members. Provide concise statements of applicable qualifications and experience of each team member expected to be working on the project. List subconsultants, if any, that will be utilized for this project. Key tasks and associated responsible personnel should be identified, along with their geographic locations. Include the firm's organizational chart with respect to the project.

D. Example Projects and References. Describe a minimum of three (3) recently-completed projects similar in size and scope to the City’s Master Plan project, including references. Include brief descriptions of the projects, including project dates and duration, project location, client names and contact persons (with addresses and phone numbers), total project costs, and the roles of key team members on the referenced project. Public sector references are preferred.

E. Work Plan and Approach. Discuss your firms understanding of the scope of services to be performed. Include a narrative description, with a work plan to implement all tasks identified in the scope of work and any recommended additional tasks. All assumptions and any significant exclusions should be clearly identified. Describe the method for managing overall project costs, schedule, quality assurance/control, and other critical issues. Highlight approaches to promote successful collaboration and coordination with and between Consultant and City staff.

F. Schedule. Provide a detailed schedule to complete each task described in the scope of work.

G. Estimated Level of Effort. Provide the proposed level of effort based on the workplan indicating the estimated number of hours that each project team member will contribute for the individual tasks depicted in the scope of work. The fee estimate shall be included in a separate envelope and shall Include billing rates schedule(s), current and proposed, for the duration of the project.

Fee estimate shall use current and projected labor rates given the project schedule duration

(2025 through 2026), and expected adjustments to labor rates over the duration of the project.

H. Revisions and Additions to Scope of Services. Within this section of the proposal (included in the

30-page count), Consultant shall review the preliminary scope of services and provide input on recommended revisions or additions to the scope. This section is intended to allow Consultant to highlight key areas of the scope that Consultant proposes changes or deviations to that will improve the project delivery either from a schedule or efficiency standpoint. In addition, Consultant may propose additional tasks or highlight anything else about the scope that is recommended that would be helpful to successful project delivery. Consultant shall also prepare a detailed scope of work to be included in the appendix of the proposal which builds on the preliminary scope of work developed by the City.

I. Appendices.

1. Resumes (2 page limit per resume):

a. Provide resumes for key personnel in Appendices

b. Resumes should contain information on person's specific role on a project, and not just general project descriptions.

c. Provide not more than five (5) projects similar to the work to be undertaken performed by key personnel. Include name, address, and current telephone number of references for each of the projects described. In addition, provide start and end dates when project was performed and note if work was performed for a different firm.

d. Project references provided in resume shall be provided for work that demonstrate experience with projects similar to the Sewer Collection System Master Plan Update

2. Detailed Scope of Services - list agreement with and/or enhancements and modifications to draft scope of services included in this Request for Proposals. City appreciates a complete red-lined version of the original proposal scope for easy negotiation and incorporation into a final agreement.

3. If any portion of the City's standard Professional Services Agreement is unacceptable to your firm, please identify the particular clause(s) in a separate letter to the City submitted with your proposal. Proposers should not assume that the City will accept any proposed changes.

3.4. Interview Format

4. Evaluation Criteria

The City will review all proposals received as part of a structured evaluation process. For each decision point in the process, the City will evaluate proposers according to specific criteria and will then elevate a certain number of proposers to compete in the next level.

The sole purpose of the proposal evaluation process is to determine which solution best meets the City’s needs. The evaluation process is not meant to imply that one proposer is superior to any other, but rather that the selected proposer can provide and has proposed the best solution and implementation approach for the City’s current and future Library needs.

A review committee will evaluate all responses to the RFP that meet the submittal requirements and deadline. Submittals that do not meet the requirement or deadline will not be considered. The review committee will rank the proposals and arrange interviews with the finalist prior to selection.

The table below describes the criteria that will be used to review proposals and interview performance.

The proposals will be reviewed by City staff. The composition of the interview panel has not been determined; it could consist of the proposal reviewers, individuals that were not formally involved in proposal review and/or officials of partner agencies. The City reserves the right to select a consultant based on written proposals alone (i.e., without an interview). The City also reserves the right to not select a consultant.
