About this file
This document is a Hazardous Material Investigation Bureau (HMIB) acceptance letter from the New Mexico Department of Transportation (NMDOT) regarding an Initial Site Assessment (ISA) Determination for the City of Rio Communities' Damon Street Repaving project. The project involves removing and replacing approximately 725 linear feet of existing pavement on Damon Street, spanning 20 to 29 feet in width, located within the city's right-of-way in Valencia County. The work will be conducted entirely within the existing right-of-way, with no property acquisition needed, and will involve removing the pavement surface down to 3 inches and compacting the disturbed subgrade before re-paving.
The HMIB reviewed the project documentation and agrees that a full ISA is unnecessary based on the project's limited scope and residential setting. The City of Rio Communities conducted a review of the NMED OpenEnviroMap database and found no hazardous material findings within the project limits. The project aims to address the poor condition of the existing asphalt pavement, which is characterized by extensive cracking, major potholes, and has reached the end of its service lifetime. No utilities will be impacted, and no structures will be modified during the project's implementation.

Subject: HMIB acceptance of an ISA Determination for the City of Rio Communities Damon St. Repaving project in Rio Communities, Valencia County, New Mexico, CN L300355
Dear Mr. Moore, Your ISA Determination letter dated February 11, 2025, for the project referenced above was received in this office on that day. Your submittal consisted of your letter, vicinity maps, a photolog, and excerpts from the project design plans.
In accordance with the direction in the 2019 Tribal/Local Public Agency Handbook (Revised December 2020), the Hazardous Material Investigation Bureau (HMIB) has reviewed your letter to verify that it meets the NMDOT’s reporting requirements and industry‐accepted standards for all appropriate inquiry (AAI). Our review should not be viewed as comprehensive, we do not fact check. Rather, we verify that you have provided information upon which you base your determination that a full ISA is unwarranted, and that you have evaluated the project for hazardous substance and/or petroleum products in the corridor that might adversely affect its design and/or construction. Naturally, if such conditions exist, we also verify that you have charted a path to reduce the risk these substances or contamination might pose through project development and construction. The HMIB assumes that you have fully described your project scope.
You describe the project scope as the removal and replacement of the existing pavement on Damon Street, located in a “fully developed, residential area”, with limited soil disturbance (3”). You state that the project is to occur within the ROW and that property acquisition will not be needed. It is also stated that no structures will be modified, and that no utilities will be impacted by the project.
In addition, you report that you reviewed the NMED OpenEnviroMap database, and found no Findings within the project limit. As such, you conclude that there are no RECs and, based on the scope of work and the developed residential area, an ISA is unwarranted. HMIB agrees.

We have reviewed the total of your submittal, and, in our opinion, you have presented sufficient information that an Environmental Professional, as defined by the USEPA, could reasonably draw conclusions about the risk of encountering hazardous substances or petroleum products during construction. As you identify no such risk, recommendations are unnecessary. We believe your submittal represents AAI and meets the NMDOT’s reporting requirements and so the HMIB is accepting it as complete.
If you have questions regarding the content of this letter or have comments, do not hesitate to call my office at 505‐469-9742.
Sincerely, Hanna Youngblut, Geoscientist Hazardous Material Investigation Bureau

Subject: ISA Determination for City of Rio Communities Damon St. Repaving
CN HW2-L300355
Dear Audrey Moore, The City of Rio Commw1ities proposes to resurface Damon Street from Horner Street to McKnight Place in the City of Rio Communities, Valencia County (Attachment A- Vicinity Maps). The project is located in a fully developed, residential area (Attachment B - Photo Log).
The purpose of the project is to address the poor condition of the asphalt pavement. The project is needed because the pavement is cracking, has major potholes, and has reached the end of its service lifetime. The project scope includes removing and replacing approximately 725 linear feet of existing roadway pavement on Damon Street, ranging from 20 to 29 feet in width (Attachment C - Project Plan Sheets). The project would occur entirely within existing right-of-way (ROW) and no ROW acquisition would be needed. No construction maintenance easements, tempora1y work permits, or other easements would be required. The pavement surface would be removed down to 3 inches, and the contractor would compact the distw-bed subgrade before re-pavement. No structmes would need to be modified, demolished, or replaced for the project. There are no utilities in conflict and no utilities would be impacted.
We anticipate that the project would not require a full ISA due to the scope of work and the developed, residential nature of the project area. Additionally, a review of the New Mexico Environment Department (NMED) OpenEnviroMap was conducted to determine if there were any sites of hazardous materials concerns within the project limits; no Findings were identified within the project limits, and therefore, no recognized environmental conditions (RECs) of concern were identified.
Should you have any comments or questions, please contact me by email at mmoore@riocommunities.net or by phone at (505) 274-0577.
Sincerely, City Manager
