About this file

This document is a Bid Recommendation Letter from CPH Consulting, LLC to the City of Sanford, Florida, regarding the 2nd St. Streetscape Improvements Project (Bid No. IFB 24-25-07). The project involves rehabilitating approximately 1,300 linear feet of 2nd Street in downtown Sanford, including brick pavement rehabilitation, ADA-compliant sidewalk replacement, drainage adjustments, concrete parking, streetlights, and new landscaping. The bid was received on January 30th, 2025, with six contractors submitting proposals.

Condor Construction Corp submitted the lowest bid at $2,393,484.60 and was recommended for contract award. The bid was approximately 20% below the Engineer's Estimate of Probable Cost of $2,996,721.37. CPH noted some minor bid discrepancies among the submittals, including a missing Trench Safety Statement form from Condor, which they recommended could be obtained prior to contract award without disqualification. The recommendation suggests the City review Condor's financial statements and construction license, which was verified as active with no current complaints through the Florida Department of Business and Professional Regulation.

RE: 2nd St. Streetscape Improvements Project (Bid No. IFB 24-25-07)

Bid Recommendation Letter CPH Job No. S06227

To Whom It May Concern, Based on the Bid Tabulation, the following are the bid results for the City’s 2nd St. Streetscape Improvements Project (Bid No. IFB 24-25-07) project, received on January 30th, 2025.

6 Cathcart Construction Company – Florida, LLC $4,240,733.45 N/A N/A

* CPH did not perform a Bid Compliance Review for any bids other than the lowest bidder ** CPH did not review the qualifications for Bidders

Three of the six responsive bidders were below the Engineer’s Estimate of Probable Cost (EEOPC) of $2,996,721.37. The unit values for each pay item, for each Bidder, were input into a spreadsheet (attached) and reviewed in comparison to the EEOPC, current FDOT Item Average Unit Costs, as well as in comparison to the other Responsive Bidder’s values. Condor Const. and Cathcart Const. were the only two bids with zero errors found. All Terrain Tractor Service included a lump sum cost for large and small trees, whereas all other bidders correctly left this row empty as it was intended to serve as a header for the items that followed related to large and small trees. All Terrain Tractor Service also had several errors in their calculations resulting in a $84.62 difference in the Total Bid based on the calculated numbers by CPH. Gibbs & Register made a small error and put the unit price in for the total price as well for three items, but the Total Bid is accurate and matches CPH’s calculation. Gomez Const. had two outstanding errors in the bid submitted; one of the total price calculations was done incorrectly, and the Total Bid was calculated incorrectly resulting in a difference of $5,979.89 from CPH’s calculation. Oelrich Const. had several small deficiencies in their calculations that did not match CPH’s calculations resulting in a $6.20 difference in the Total Bid.

In consideration of the three (3) lowest bids being within 15% of each other (supporting commonality of pricing across multiple bids) and being lower than the Engineers Estimate Of Proposed Cost (EOPC); it is CPH’s recommendation that there are sufficient qualified bids (as based upon cost only) for the City to proceed with consideration of the award for construction. Furthermore, as the two (2)

During the bid compliance review, it was noted that the Trench Safety Statement form listed under Section 1.05 Misc. Requirements and Affirmations of the Bid Form 00410, was missing from Condor’s bid package. After review of the original project manual and 3 addendums issued during the bid phase, several unintentional errors by the EOR may have contributed to confusion of the bidders. Within Addendum No. 2, multiple required forms were added to Specification 410-5 section 1.05. Additionally, all the forms listed were included within the addendum with a “Please Complete and Submit” statement and warning at the bottom; except for the Trench Safety Statement form which was erroneously missing from the addendum. Furthermore, within Addendum No. 3, a revised Spec 00410 was included which was based upon the original bid specification, not the specification as revised within Addendum No. 2. This may have led to confusion of the bidder(s).

As noted on each of the other required forms, “Failure to submit this form may be grounds for disqualification of your submittal”, it is at the sole discretion of the City whether a missing form should be considered as sufficient grounds for disqualification of an otherwise complete/proper bid. In consideration of the non-compensatory impact (no direct cost impact to the bid as received) of the Trench Safety Statement, it is CPH’s recommendation that the City obtain the completed form from Condor prior to contract award. CPH suggests that disqualification of the lowest responsive bid is not warranted in this situation.

Financial information the City received from Condor Construction Corp. (audited financial statement) has not been reviewed by CPH and should be reviewed by the City. CPH has reviewed Condor’s construction license information by verifying the construction license is active. This verification was done through the Florida Department of Business and Professional Regulation (DBPR) website. The DBPR website also shows there are no current complaints on the Condor Construction, Corp. license that was checked at the time of this recommendation.

Subject to the City’s concurrent review for Bid Compliance and/or determination of qualification requirements being met (if any), as based upon review of the costs submitted within the Bid Tab; it is CPH’s recommendation that the City of Sanford Commission proceed with authorizing award of the 2nd St.

Streetscape Improvements (Bid No. IFB 24/25-07) construction contract to Condor Construction Corp.

If you have any questions or need additional information on the contract award recommendation we have made, or any of the information shown herein or attached, please do not hesitate to call.

Sincerely, CPH Consulting, LLC.
